458 The Administrative Regulations of Dapeng New District of Shenzhen Municipality 深圳市大鹏新区管理规定

　　(Adopted at the 94th Executive Meeting of the 6th Shenzhen Municipal People's Government on September 18, 2017)

　　Article 1 The Administrative Regulations of Dapeng New District of Shenzhen Municipality are hereby formulated in accordance with the relevant law, administration regulations, rules and in light of the actual circumstances of Shenzhen Municipality, with the purpose of  promoting the coordinated development of economy, society and environment in Dapeng New District of Shenzhen Municipality, innovating the new district management system, and ensuring the new district management agencies to perform their administrative authorities in accordance with law.

　　Article 2 The Shenzhen Municipal People’s Government shall create Dapeng New District (hereinafter referred to as the New District). The New District includes the subdistricts of Kuichong, Dapeng, and Nanao under the jurisdiction of Longgang District.

　　Article 3 The New District shall, according to the regional characteristics, regional advantages and functional positioning, establish the focus of economic, social and environmental development, continuously improve its urban functions, enhance the level of economic and social development, and promote the overall coordinated development of the New District.

　　Article 4 The New District shall strengthen the innovation of administrative system and social management systems, transformation of governmental functions, clarification of the government responsibilities, advancement of the government services, improvement of the administrative efficiency, and gradually establish a new type of streamlined administrative system with clear responsibilities and coordinated operation with efficiency.

　　Article 5 The Shenzhen Municipal People’s Government shall establish the Dapeng New District Management Committee (hereinafter referred to as the New District Management Committee). The New District Management Committee is the  agency of the Shenzhen Municipal People’s Government and exercises the duties to be exercised by the district government as decided by the Shenzhen Municipal People’s Government.

　　Article 6 The New District Management Committee shall mainly perform the following duties within the jurisdiction of the New District:

　　 (1) the duty to organize research on the formulation of economic and social development strategies and plans for the New District, and the duty to implement the strategies and plans upon approval;

　　(2) the duty to formulate medium-term and long-term plans, annual implementation plans and major investment plans for the development and construction within its jurisdictions, and the duty to implement the plans mentioned upon approval;

　　(3) the duty of the industrial planning, investment attraction and management and services of the enterprises that settled in the New District;

　　(4) the duty to participate in the preparation of urban planning and land use planning within the jurisdiction, and to assist in the preparation of statutory plans and special plans;

　　(5) the duty for the preparation of the annual budget of revenue and expenditure within the jurisdiction, and the duty to implement such annual budget of revenue and expenditure upon approval;

　　(6) the duty to engage in the urban construction, urban management (including comprehensive administrative law enforcement) and environmental protection in accordance with the administrative authorities;

　　(7) the duty to engage in the land preparation and housing expropriation within the jurisdiction;

　　(8) the duty of the administration of various administrative and social affairs within the jurisdiction, including finance, education, science and technology, agriculture, forestry, waterworks, culture, health and family planning, sports, human resources, institutional establishment, civil affairs, safe production, public security, ethnic religion, judicial administration, supervision, statistics and system of national accounts and people's armed forces, etc. in accordance with the administration authorities;

　　(9) the duty to supervise the state-owned assets of enterprises within the jurisdiction of the New District;

　　(10) Other duties as stipulated by the Shenzhen Municipal People’s Government.

　　Article 7 The relevant departments of the Shenzhen Municipal People’s Government shall actively support the construction and management of the New District.

　　Article 8 Upon the approval of the Municipal Preparation Department, the New District Management Committee shall establish relevant institutions in accordance with the requirements of economic construction, social development and New District management according to the principle of streamlining and high efficiency.

　　Article 9 Upon the approval of the departments of institutional organization of the Shenzhen Municipality, the relevant departments of the Shenzhen Municipal People’s Government shall, in accordance with the actual needs of the construction and development of the New District, establish an agency to perform its duties in accordance with the law within the jurisdiction of the New District.

　　Article 10 The Longgang District People's Government shall organize the district relevant departments to entrust the New District Management Committee to exercise the administrative authorities such as the authority of administrative approval and the authority of administrative penalty within the jurisdiction of the New District, as stipulated by laws, administrative regulations and rules which shall to be exercised by the county (district) level government and its subordinate departments.

　　The relevant departments of the Shenzhen Municipal People’s Government that have not established an agency in the New District shall, according to the needs of the management of the New District, entrust the New District Management Committee to exercise the administrative authorities such as the authority of administrative approval, and the authority of administrative penalty within the jurisdiction of the New District.

　　Article 11 Where the relevant departments of the Shenzhen Municipal People’s Government, the Dapeng New District Government and their relevant departments entrust the New District Administrative Committee to carry out administrative authorities such as the authority of administrative approval and the authority of administrative penalty, they shall sign an entrustment agreement, specifying the entrustment basis, the entrustment authority, the entrustment term, the rights and obligations of both parties, etc., and make an announcement to the public in accordance with the regulations.

　　Article 12 The relevant departments of the Shenzhen Municipal People’s Government shall provide guidance and supervision to the administrative actions carried out by the New District Administrative Committee to ensure that the New District Administrative Committee shall conduct the law-based administration.

　　Article 13 The New District Administrative Committee shall formulate specific implementation measures in accordance with the Regulations.

　　Article 14 The Regulations shall come into effect as of the date of announcement, and the Interim Regulations on the Administration of Longhua New District and Dapeng New District of Shenzhen Municipality (Decree No. 237 of Shenzhen Municipal People's Government) shall be abolished at the same time.
