478 Regulations of Shenzhen Special Economic Zone on Popularization of Science and Technology 深圳经济特区科学技术普及条例

Chapter One General Provisions

     Article 1 In order to redouble the efforts of popularizing science and technology in Shenzhen Special Economic Zone, raise the citizens' scientific literacy, build a pilot demonstration zone of socialism with Chinese characteristics, and create a role model in the great modern socialist country, these Regulations are hereby formulated in accordance with the Law of the People's Republic of China on Popularization of Science and Technology, the basic principles of relevant laws and regulations, and in light of the actual circumstances.

    Article 2 These Regulations shall apply to science and technology popularization activities in Shenzhen Special Economic Zone.

    The popularization of science and technology (hereinafter referred to as PST) as mentioned in these Regulations refers to the activity that could popularize knowledge of science and technology, advocate scientific conduct, disseminate scientific ideologies and advance scientific spirit in such ways as may make it easy for the public to understand, accept and participate in.

    Article 3 PST aims to publicize the concept of innovative, coordinated, green, open and shared development, promote education, dissemination and popularization of science and technology, raise the citizens' scientific literacy, and create a favorable atmosphere in society for talking about, loving, learning and using science.

    Article 4 The PST work shall adhere to the leadership of the Communist Party of China, and major matters shall be timely reported to the Party Committee at the same level.

    Article 5 PST is a common task of the entire society. State organs, enterprises, public institutions, mass organizations and other social organizations as well as science and technology workers have the obligation of carrying out the PST work in accordance with law.

    Citizens are guaranteed the right to receive education of science and technology, to acquire knowledge of science and technology needed for work and life, and to share the state's fruits of scientific and technological progress and development.

    Article 6 The development of PST undertakings shall adhere to the principles of government promotion, participation by the whole society, open sharing of PST resources, and timely updating of PST content.

    Article 7 All quarters of society shall be encouraged to initiate PST undertakings. Enterprises, public institutions, social organizations and individuals shall be supported and guided to carry out public welfare PST activities.

    The role of market allocation of resources shall be given full play to support, cultivate and promote the development of PST industry.

Chapter Two Organization and Administration

    Article 8 In order to provide necessary support and guarantee for PST, the municipal and district people's governments shall incorporate PST into the plans for national economic and social development and formulate municipal PST work plan and related policies and measures.

    Article 9 The municipal and district associations for science and technology shall carry out PST work in accordance with these Regulations and perform the following duties:

    (1) formulating and organizing the execution of the municipal PST work plan and its implementation program;

    (2) organizing, coordinating and guiding citizens' scientific literacy surveys and PST work assessment;

    (3) organizing the formulation of PST-related standards;

    (4) guiding and coordinating the relevant entities and individuals to carry out PST activities;

    (5) organizing a general survey of PST resources and establishing an information platform for sharing PST resources;

    (6) promoting the PST talent team building and organizing, coordinating and guiding the professional training;

    (7) guiding PST volunteers to carry out PST volunteer services;

    (8) promoting cooperation and exchanges in PST;

    (9) organizing the appraisal and selection of outstanding PST works, PST products and PST platforms;

    (10) being responsible for the cultivation, identification, management and evaluation of PST bases and PST demonstration sites;

    (11) organizing the research of PST theories;

    (12) carrying out other PST work in accordance with law.

    Article 10 The relevant departments of the municipal and district people's governments shall carry out PST work within the scope of their respective duties and assist the municipal and district associations for science and technology in related work.

    Article 11 The municipal people's government shall establish a joint commission mechanism for PST work to perform the following duties:

    (1) deliberating the municipal PST work plan and submitting it to the municipal people's government for issuance with the approval;

    (2) examining and approving the implementation program for the municipal PST work plan;

    (3) deliberating major matters including PST development policies and measures, construction of PST venues and funding arrangements, and making relevant decisions according to the authorization by the municipal people's government;

    (4) examining and approving the evaluation report on PST work;

    (5) coordinating major matters related to PST work;

    (6) studying and dealing with other related work.

    Article 12 The joint commission of municipal PST work shall be convened by the leader of the municipal people's government in charge of the work, and shall be composed of relevant departments of the municipal people's government, the municipal association for science and technology, the municipal federation of trade unions, the municipal communist youth league committee, the municipal women's federation and other entities.

    Article 13 The office of the joint commission of municipal PST work is located in the municipal association for science and technology, responsible for day-to-day work.

    Article 14 The joint commission of municipal PST work shall be held at least once a year.

The municipal association for science and technology may convene some member entities of the joint commission of municipal PST work to study, coordinate and handle special PST-related work.

    Article 15 The municipal association for science and technology may set up a PST expert steering committee to undertake relevant consultation, demonstration and evaluation work. The work rules of the PST expert steering committee shall be formulated by the municipal association for science and technology.

    Article 16 The municipal PST work plan shall include the following contents:

    (1) PST work review and status quo analysis;

    (2) PST work development objectives;

    (3) key tasks such as the construction of PST facilities and PST service system, creation of PST works and development of PST products, improvement of scientific literacy of key groups, and PST talent team building;

    (4) responsibilities of relevant departments, entities and individuals for PST;

    (5) guarantee measures;

    (6) other PST-related matters.

    Article 17 The municipal PST work plan shall be prepared by the municipal association for science and technology in conjunction with relevant departments.

    The municipal PST work plan shall be prepared based on the wide solicitation of views from relevant entities and the public, and shall be fully demonstrated by experts in relevant fields.

    Article 18 The municipal association for science and technology shall organize the drafting of an implementation program according to the municipal PST work plan, submit it at the joint commission of municipal PST work for examination and approval, and then issue for implementation.

    District people's governments and relevant departments that undertake key PST tasks shall formulate their respective implementation programs according to the needs and organize the implementation.

    Article 19 The municipal association for science and technology shall guide, supervise and check the implementation of the municipal PST work plan and its implementation program and report the annual work at the joint commission of municipal PST work.

    Article 20 The municipal association for science and technology may organize an interim assessment of the implementation of the municipal PST work plan and its implementation program or a special assessment of any key work.

    Article 21 The municipal and district people's governments shall increase financial funding for PST, give full play to the guiding and promoting role of financial funds, and encourage and attract social capital to invest in PST undertakings through a variety of ways.

    The municipal and district financial departments shall guarantee the funds required for PST and increase the financial support for PST bases and PST demonstration sites.

    It is necessary to strengthen performance management on PST funding, ensure the PST funding is used for the designated purposes only, and raise the use efficiency of PST funding.

    Article 22 The municipal association for science and technology shall organize the establishment of local PST standards and technical specifications according to the needs, improve the system of PST standards, and provide guidance of standards and technical specifications for PST activities.

    Article 23 The municipal association for science and technology shall carry out regular monitoring and assessment of the citizens' scientific literacy, access to science and technology information, participation in PST activities, satisfaction with the PST environment, etc. The assessment report shall be released to the public after having been examined and approved at the joint commission of municipal PST work.

    Article 24 The municipal and district people's governments, associations for science and technology and relevant entities shall commend and award the entities and individuals that have made important contributions to PST work. The specific measures shall be formulated by the municipal people's government.

Chapter Three Responsibility of the Society

    Article 25 State organs, enterprises, public institutions, mass organizations and other social organizations shall earnestly perform the responsibility of PST in accordance with laws, regulations and the municipal PST work plan.

    Article 26 The education department shall, in conjunction with relevant departments, implement the requirements on strengthening science education and PST activities for youth, and include relevant work in the performance assessment of educational institutions at all levels and types; gradually implement a credit system for PST education at the compulsory education stage to improve the youth's scientific literacy.

    Article 27 The human resources and social security department shall, in conjunction with relevant departments, implement the requirements on strengthening vocational skill training for workers, work safety education and encouraging innovation and creativity, and include the requirements for scientific literacy of workers in the content of vocational training, assessment and appraisal.

    Article 28 The competent civil service department shall regard improving the scientific literacy of civil servants as an important task of civil service education and training, and include the requirements for scientific literacy in the content of civil servant examination and recruitment.

    Leading officials shall take the lead in participating in scientific literacy education and training to improve the scientific governance level, scientific governance capability and scientific life literacy. The requirements for scientific literacy shall be included in the content of office investigation and annual assessment of leading officials.

    Article 29 The health department shall, in conjunction with relevant departments, implement a nationwide health education program to popularize scientific health knowledge.

    Article 30 The market supervision and regulation department shall establish and improve the PST mechanism of food safety emergency response, popularize food safety knowledge, promptly clarify pseudoscience rumors about food safety, advocate healthy diet, and enhance the consumers' awareness of food safety and self-protection ability.

    Article 31 The emergency management department shall coordinate and strengthen the popularization for the emergency and production safety knowledge and organize knowledge publicity and basic skills training for production safety and disaster prevention and reduction to enhance the citizens' awareness of disaster prevention and reduction and ability of self-aid and mutual aid.

    In the event of a major safety production or natural disaster emergency, the emergency management department shall coordinate and guide the relevant departments to timely release disaster information to the public in accordance with law to clarify false rumors and pseudoscience rumors.

    Article 32 The development and reform, ecology environment and other departments shall, in conjunction with relevant departments, carry out PST work for energy-saving and ecology to enhance the citizens' awareness and ability of saving energy resources and protecting the ecological environment.

    Article 33 The planning and natural resources department shall carry out PST work for urban planning, urban design and green buildings to enhance the citizens' awareness and selection ability of the human environment.

    Article 34 The relevant municipal and district departments shall support the national defense mobilization department to build PST facilities for national defense education, engage in the creation of national defense PST works on national defense, and carry out various forms of national defense PST activities.

    Article 35 It is necessary to strengthen the construction of community PST facilities, optimize the PST function of community activity platforms, and enhance the community's PST capacity.

    Article 36 The municipal federation of trade unions shall, in the light of the tasks and characteristics of trade unions, organize PST activities that safeguard occupational safety and health, enhance vocational skills, and promote innovation and creativity, etc.

    Article 37 The municipal communist youth league committee shall, in the light of the tasks and characteristics of the communist youth league, organize a variety of featured PST activities, promote the construction of youth PST sites, organize and manage the PST volunteer teams, and strengthen the publicity and education among the youth in cherishing life, advocating science and civilization, and encouraging innovation and creativity.

    Article 38 The municipal women's federation shall, in the light of the tasks and characteristics of the women's federation, organize a variety of featured PST activities to publicize and popularize relevant knowledge of science and technology to women and children.

    Article 39 When financial funds are used to support technological innovation and technological transformation of enterprises, the applicant shall, in light of the characteristics of the project, agree in writing to undertake the obligation of PST in one or more of the following methods:

    (1) providing PST works and PST products that illustrate the scientific principles and advancements of the relevant project or product for use on PST platforms and by the public;

    (2) explaining to the public in the municipal major news media about paragraph (1) of this article by a professional technician;

    (3) offering PST sites or making relevant facilities and equipment available to the public and providing necessary instructions;

    (4) other appropriate methods.

    The implementation measures for this article shall be formulated by the municipal development and reform department in conjunction with the municipal science, technology, and innovation department, and industry and information technology department and the municipal association for science and technology.

    Article 40 The news media shall increase PST publicity and timely report major technological achievements, technological innovation projects, scientific figures, PST activities, scientific hot topics in life, etc.

    In municipal comprehensive newspapers and periodicals, there shall be a special column or page for PST under the guidance of the municipal and district associations for science and technology; the municipal and district radio and TV broadcasting stations shall have a PST program or relay such programs regularly under the guidance of the municipal and district associations for science and technology.

    The relevant department in charge shall strengthen the supervision and inspection of newspapers, periodicals, radio and TV broadcasting stations to fulfill their responsibility for PST in accordance with law.

    Article 41 Medical institutions shall, in accordance with the requirements of the health department, post and display a certain number of health PST knowledge articles, pictures, molds, etc., and place relevant PST information for the public to learn and refer to in their diagnosis and treatment venues.

    Medical institutions shall be encouraged to give appropriate explanations on the patient's illness causes and conditions, pathogenesis, treatment methods, etc., and to publicize preventive health knowledge in the course of medical diagnosis and treatment.

    Article 42 The management entities of such venues as parks, zoos, botanical gardens and nature reserves shall carry out relevant PST activities in combination with their respective characteristics.

    A brief, popular description for animal and plant species, mineral deposits and geological remains included in the municipal PST resources list that are open to the public shall be given in the form of text, pictures or electronic information.

    Article 43 The management entity of the municipal high-tech industrial park shall establish a platform for introducing and displaying the scientific research achievements and products of high-tech enterprises, and organize and guide them to carry out PST activities.

    Article 44 Scientific research institutions that mainly use financial funds for scientific research shall, in accordance with the relevant provisions or the fund use management agreement, timely transform scientific research achievements into PST products, and make use of their PST resources to carry out PST activities.

    Article 45 Science and technology workers in state organs, enterprises, public institutions, mass organizations and other social organizations shall carry out relevant PST activities in accordance with the work arrangements of their entities.

    The participation of science and technology workers in public welfare activities organized by national and local relevant departments and entities shall be supported by their entities.

    Institutions of higher education shall strengthen the PST backup talent team building. Postgraduate students who carry out PST activities shall be granted the credit according to the rules.

    Article 46 No entity or individual may commit any of the following acts:

    (1) publicizing feudal superstitions and pseudoscience;

    (2) disseminating opinions and ideas to the public that are contrary to the principle and spirit of science;

    (3) promoting products and services containing false advertising in PST activities;

    (4) deceiving consumers in the publicity of products and services by shifting scientific concepts, falsely claiming the use of patented or advanced technology, falsifying scientific expert verifications or opinions, and impersonating scientific and technical professionals;

    (5) other activities in the name of PST that harm the public interest or the legitimate rights and interests of others.

Chapter Four PST Resources

    Article 47 The municipal and district people's governments shall strengthen the development of PST resources and the construction of PST infrastructure, increase the overall quantity of PST resources, improve the layout of PST facilities, support the creation of excellent PST works and development of excellent PST products, and enhance the capacity of PST services.

    PST resources as mentioned in these Regulations refer to natural resources, venues, facilities, equipment, works, products, information, etc. with the function of PST that can be open to the public.

    Article 48 The municipal and district associations for science and technology shall, in conjunction with relevant departments, conduct regular general surveys of PST resources. The type, quantity, content, distribution, etc. of PST resources shall be registered to form a directory of PST resources which shall be timely released to the public.

    Entities and individuals shall be encouraged to apply for inclusion of their venues, facilities, equipment, works, products, information, etc. in the directory of PST resources.

    Article 49 The municipal and district associations for science and technology shall dynamically manage PST resources, timely adjust the directory of PST resources, and make a brief description in text, pictures or other methods.

    Article 50 The municipal and district associations for science and technology shall, in conjunction with the education, press and publication, culture and other departments, formulate a publishing plan for PST works and organize the preparation of PST readings, translation of foreign PST works, and regular publication of a certain number of PST books and electronic and audio-visual products.

    Article 51 The municipal and district associations for science and technology and relevant departments may provide support for the creation of excellent PST works and development of excellent PST products through commissioned creation, copyright purchase, publicity and promotion, etc.

    Article 52 Excellent PST works and PST products can be included in the scope of science and technology reward achievements or excellent achievements.

    Article 53 The municipal and district people's governments shall protect PST venues by including their construction land into urban planning according to national standards. The use, maintenance and renovation of existing PST venues shall be strengthened.

    PST venues constructed with government investment shall not be changed for other purposes without authorization. If the function of any PST venue is changed in accordance with law, alternative facilities shall be provided or rebuilding shall be done at no smaller scale or lower standard.

    PST venues constructed with government investment shall be open to the public free of charge all year round.

    Article 54 Enterprises, public institutions and social organizations shall be encouraged to build featured PST facilities open to the public.

    Article 55 State organs, institutions of higher education, scientific research institutions and other public institutions shall open their venues, facilities, equipment, etc. listed in the directory of PST resources to the public for at least fifteen days a year. Those involving state secrets and trade secrets and prohibited from openness according to laws and regulations shall be excluded.

    Private institutions of higher education and scientific research institutions that fulfill the obligation in the preceding paragraph may apply to the municipal and district associations for science and technology for financial funding according to the rules.

    Article 56 The municipal and district people's governments shall strengthen the construction of PST bases and PST demonstration sites, and actively promote PST work towards socialization, regularization and specialization.

    PST bases as mentioned in these Regulations refer to venues open to the public with specific functions of science and technology education, dissemination and popularization identified by the municipal and district associations for science and technology; PST demonstration sites as mentioned in these Regulations refer to other PST venues open to the public identified by the municipal and district associations for science and technology except for PST bases.

    Article 57 An identified PST base shall have the following qualifications:

    (1) having venues of a certain scale and open to the public regularly;

    (2) having PST resources of a certain number and quality;

    (3) having financial funding safeguard and full-time and part-time personnel necessary for carrying out PST activities;

    (4) being open to the public for not less than two hundred days per year unless otherwise provided by the state.

    Article 58 An identified PST demonstration site shall have the following conditions:

    (1) having featured PST resources and venues available for opening;

    (2) being able to carry out PST activities;

    (3) being open to the public for not less than fifty days throughout the year.

    Article 59 The construction and operation of PST bases and PST demonstration sites shall comply with the relevant standards, and accept the guidance of the municipal and district associations for science and technology. The municipal and district associations for science and technology may provide financial funding according to the rules.

    Institutions of higher education, scientific research institutions and high-tech enterprises shall be encouraged to set up PST bases and PST demonstration sites.

Donations for the construction and operation of PST bases and PST demonstration sites shall be encouraged.

    The municipal and district associations for science and technology may give necessary guidance, cultivation and funding to enterprises, public institutions and social organizations to construct PST facilities. PST bases that fall within the scope of cultivation may enjoy the relevant treatment in reference to the cultivation policy applicable to high-tech enterprises.

    PST education bases identified by the national and provincial associations for science and technology may enjoy the treatment of PST bases.

    Article 60 PST activities in PST bases and PST demonstration sites for minors shall be prioritized, and shall give the minors preferences on tickets, site rental, etc.

    Article 61 The ticket revenue of PST bases may be exempt from the corresponding tax in accordance with law.

    The municipal association for science and technology shall be responsible for the identification review of imported film and television works used by PST bases, whose result shall be issued by the municipal science, technology, and innovation department, and tax reduction or exemption may be enjoyed according to relevant rules.

    Enterprises making donations to the construction and operation of PST bases and PST demonstration sites may enjoy income tax deduction in accordance with law.

    Article 62 The municipal and district associations for science and technology shall assess and evaluate PST bases and PST demonstration sites according to the rules.

    A venue identified as a PST base or PST demonstration site shall no longer meet the qualifications specified in Article 57 and Article 58, or such venue failing to give preferences according to Article 60 shall be ordered by the municipal and district associations for science and technology to make correction; in the event of refusal of making correction, the title of such PST base or PST demonstration site shall be revoked.

    Article 63 PST activities shall be encouraged to be carried out through the Internet network and new media.

    The establishment of professional PST websites and opening of PST accounts on Weibo, WeChat and other new media shall be encouraged.

    Article 64 The municipal and district associations for science and technology shall establish a comprehensive PST website to provide PST services for the public.

    The comprehensive PST website shall provide the following services and make timely updates:

    (1) releasing the municipal PST resources and promote other featured PST resources;

    (2) releasing information on important PST activities;

    (3) publicizing PST laws and regulations;

    (4) setting up featured PST programs;

    (5) providing links to major PST websites according to relevant rules;

    (6) other PST services.

    Article 65 The municipal people's government and the member entities of the joint meeting of municipal PST work shall set up PST programs on their official websites or new media public platforms to provide relevant PST services.

    Article 66 The municipal comprehensive website shall set up a PST page to fulfill the responsibility of PST.

    The relevant municipal and district departments shall strengthen the supervision and guidance of comprehensive websites in performing the responsibility of PST in accordance with law.

Chapter Five PST Talents

    Article 67 The municipal and district people's governments shall strengthen the PST talent team building, expand the PST talent team and optimize the PST talent team structure to continuously improve its PST capabilities.

    PST talents as mentioned in these regulations refer to persons with certain expertise who are engaged in the following work in the city:

    (1) science and technology education and PST publicity;

    (2) creation of PST works and development of PST products;

    (3) PST organization management and PST operation management;

    (4) planning and organization of PST activities;

    (5) research of PST theories;

    (6) other PST work.

    Article 68 State organs, enterprises, public institutions, mass organizations and other social organizations that assume the responsibility of PST in accordance with law shall determine the relevant persons in charge and staff to assume the responsibility of PST.

    Article 69 The municipal and district associations for science and technology shall, in conjunction with relevant departments, establish a PST talent pool to include those who voluntarily engage in PST work in the city, and strengthen the cultivation, support and management of talents included in the pool in order to provide the guarantee of talent resources for PST activities.

    Article 70 The chief scientist system of science communication shall be established, with domestic and foreign well-known experts voluntarily engaging in PST hired by the municipal people's government as chief scientists in science communication-related fields in the city.

    Chief scientists of science communication shall mainly engage in the following work:

    (1) directing the creation of PST works and the development of PST products;

    (2) directing the education, communication and popularization of science and technology;

    (3) leading to carry out public welfare PST activities;

    (4) reviewing the content of PST works;

    (5) giving scientific explanations in case of major public events and natural disasters;

    (6) participating in other PST work.

    Article 71 Science and technology workers, college and university teachers and students, as well as civil servants, employees, retirees, etc. with a science and technology education background shall be encouraged to engage in PST volunteer services.

    The municipal association for science and technology shall, in conjunction with the municipal communist youth league committee, improve the training, incentive and management system for PST volunteers and strengthen the PST volunteer team building.

    Article 72 The system of PST professional qualifications and professional titles shall be implemented.

    Persons engaging in full-time or part-time PST work in the city who are eligible for applying for professional qualifications may apply for the corresponding PST professional qualifications; the management entities of schools, PST venues and other PST bases may appoint personnel from those with PST professional qualifications to hold corresponding PST professional titles.

    Professional qualifications and professional titles are divided into primary, middle and advanced levels.

    Article 73 In assessing and appointing PST professional qualifications and PST professional titles, if the applicant meets the basic conditions, his/her achievements in creating PST works, organizing PST activities and carrying out other PST work shall be taken as the primary basis. Applicants having received recognition and rewards in PST work at the district level or above shall be given priority in being awarded or appointed the corresponding professional qualification or professional title under the same conditions.

    The measures for assessment and appointment of PST professional qualifications and professional titles shall be formulated by the municipal human resources and social security department in conjunction with the municipal association for science and technology.

Chapter Six PST Activities

    Article 74 State organs, enterprises, public institutions, mass organizations and other social organizations shall organize and participate in a variety of forms of PST activities based on the needs of PST work they undertake.

    Article 75 The third week of September each year is Shenzhen PST Week.

    The municipal and district associations for science and technology shall formulate an activity program for Shenzhen PST Week, determine the theme and main plan, as well as organize, coordinate and direct relevant entities to carry out the following activities:

    (1) carrying out PST activities in public institutions, schools, communities, enterprises, etc. under the themes of the National PST Day and Shenzhen PST Week;

    (2) holding activities such as PST lectures, PST exhibitions, science and technology consultation, science and technology exchange forums, technological innovation competitions, etc.;

    (3) appraising and selecting outstanding PST works, PST products, PST platforms, etc.;

    (4) other PST activities.

    Article 76 The municipal and district associations for science and technology shall organize or support relevant entities to carry out featured PST activities.

    State organs, enterprises, public institutions, mass organizations and other social organizations may carry out relevant PST activities on specific festivals, anniversaries, etc.

    Article 77 The municipal and district people's governments and their relevant departments shall organize various forms of community PST activities to promote science and technology, safety, health, energy saving, environmental protection, etc. into the community as well as enhancing the ability of residents to solve practical problems, participate in the management of public affairs and resist feudal superstition and pseudoscience with scientific knowledge.

    Article 78 Primary and secondary schools shall, as required by the education department, establish a mechanism to link extracurricular PST activities with science curriculum and carry out various forms of extracurricular PST activities, including at least one school-wide science practice activity each academic year.

    Primary school students shall have at least one class period per week for science practice activities, while secondary school students shall be encouraged to actively participate in scientific practice and subject research activities.

    Article 79 The operation and management entities of commodity trading markets, network trading platforms, etc. shall carry out PST activities about commodity use, authenticity identification, etc.

    Article 80 The competent municipal and district tourism departments shall, in conjunction with the municipal and district associations for science and technology, formulate the municipal PST tourism guide to recommend featured PST tourism resources and give full play to the tourism function of PST resources.

Chapter Seven Supplementary Provisions

    Article 81 These Regulations shall become effective as of January 1st, 2020.
