481 Decision of the Standing Committee of Shenzhen Municipal People's Congress on Building a High-level Elderly Care Service System 深圳市人民代表大会常务委员会关于构建高水平养老服务体系的决定

(Adopted at the thirty-sixth meeting of the Standing Committee of the Sixth Shenzhen Municipal People's Congress on October 31 , 2019)

    For the purposes of implementing Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era and the spirit of the 19th CPC National Congress, carrying out the Opinions of the CPC Central Committee and the State Council on Supporting Shenzhen in Building a Pioneering Demonstration Zone for Socialism with Chinese Characteristics, actively responding to the aging of population and meeting seniors' needs for multilevel and diversified elderly care services, and building a high-level and sustainable elderly care service system to provide care for the elderly and create a benchmark for people's well-being, the following decision is hereby made.

    Article 1 Building an elderly care service system from a high starting point

    The municipal government shall take the building of a high-level elderly care service system as an important part for strengthening social construction, adhere to the principle of government guidance, policy support, social participation and market operation in light of this Municipality's level of economic and social development and the existing state and development trend of the elderly population, and build a multilevel elderly care service system that coordinates home, community and institutions, combines medical care with elderly care, and provides adequate basic protection, quality mid-end supply and leading high-end development. The moderate and inclusive development of elderly care services shall be promoted, and a precise, refined, intelligent, and intensive urban elderly care model that is compatible with the pilot demonstration area of socialism with Chinese characteristics shall be actively explored to continuously enhance the feelings of fulfillment, happiness, and security of all the elderly.

    Article 2 Expanding elderly care supplies with diversified measures

    The municipal government shall establish and improve the basic elderly service system and effectively promote equal, inclusive and convenient services for the elderly to ensure that all eligible elderly people can enjoy basic elderly care services. The unified demand assessment system for elderly services within Shenzhen shall be improved to strengthen the classification of the elderly and precise services for the elderly. Professional long-term care and nursing service system coordinating home, community and institutions shall be improved, and long-term nursing insurance system with multi-channel financing and sustainable operation shall be established. Elderly care services shall be included in guiding catalogs for government procurement of services, and the focus shall be on the procurement of assisted living, convalescent care, training of elderly service personnel, demand assessment of elderly services, evaluation of elderly services, network information construction of elderly service, and other services. Development mode, management mode and operation mechanism suitable for the market economy shall be established and improved, reform on public elderly care institutions shall be promoted, and various models such as public-established and private-operated model, private-owned and public-assisted model, and government procurement of services shall be pursued. The system of classification and level-by-level management for elderly care institutions shall be established, pricing mechanism for government-run elderly care institutions shall be improved, and service standards, construction standards and evaluation system and other issues for elderly care service institutions shall be perfected. Priority of public elderly care institutions shall be given to elderly service demands of those disabled seniors with financial distress, from special families under family planning, with priority entitlements, making significant contributions to the society or under other circumstances. Business environment for elderly care services shall be optimized, market for elderly care services shall be fully liberalized, and social forces and business entities shall be guided and encouraged to actively participate in elderly care supplies. National preferential tax policies and administrative fee reduction policies for the development of elderly care service industry shall be implemented. Relying on the construction of the Guangdong-Hong Kong-Macao Greater Bay Area, the cooperation in elderly care services among Shenzhen, Hong Kong and Macao shall be promoted.

    Article 3 Constructing multilevel elderly care network

    A multilevel, full-coverage, efficient and convenient elderly care service network shall be built actively, each district (new district) shall be equipped with at least one district-level elderly care institution with demonstration, extending and driving role; and each subdistrict shall be equipped with at least one comprehensive elderly care service institution providing such services as short-term care, day care, home-based care and medical care combined with elderly care. Embedded, small and chain elderly care service stations according to the distribution of the elderly shall be built in communities and neighborhoods to develop a service model that combines community property services and elderly care services. The elderly care service commissioner system shall be established. Elderly care service commissioners shall be assigned according to the proportion of the resident seniors to lift barriers among the supply and demand of elderly care services.

    Article 4 Planning for elderly service facilities with high standard

    When formulating the overall and detailed plans of national land use, the elderly care facilities shall be planned by different districts and levels in accordance with the per capita land use standards stipulated by national provisions. Community-based and home-based elderly care facilities and medical, education, culture, sports, and other public service facilities shall be set up adjacently and functionally connected to each other. Newly-built residential communities shall be equipped with supporting elderly care facilities in accordance with planning standards, which shall be planned, constructed, accepted and delivered for use simultaneously, and district authority of elderly care services shall be involved in the acceptance and responsible for receiving the elderly care facilities. For the completed residential communities without elderly care facilities or with existing facilities failing to meet the planning and construction standards, elderly care facilities shall be supplemented through leasing, repurchase, renovation and other ways. Stock properties owned by the government, institutions, state-owned enterprises and cooperative stock companies formed by communities shall be used for the construction of elderly care facilities. Newly built, rebuilt, and expanded residential communities shall comply with national barrier-free design standards, and barrier-free renovation shall be carried out in old residential communities.

    Article 5 Vigorously promoting the coordinated development of home-based, community-based and institutional elderly care services

    Support for home-based and community-based elderly care services shall be increased by the government. For social forces that rent the property owned by the government to carry out home-based or community-based elderly care services, rent reduction and exemption shall be given. Embedded elderly care services shall be developed to ensure that communities provide the elderly in their homes with day care, temporary care, on-site services, meal and catering, medical care, rehabilitation assistance, emergency rescue, spiritual comfort, respite services, care training and other elderly care services. Large-scale, chained and standardized professional service institutions shall be supported to operate and manage elderly care facilities in communities, extending professional services to communities and families. Family elderly care beds shall be built to guide professional institutions such as elderly care service institutions and community health centers to provide on-site services. The eligible construction of family elderly care beds and renovation for elderly-suitable homes shall be provided with certain government subsidies, so as to ensure that the elderly have access to elderly care without leaving their homes. Family members shall be supported to perform their duty and responsibility to support the elderly as their main carers; scheme to support family carers of the elderly shall be implemented, and nursing leave for only children shall be explored to reduce the pressure of family care. All kinds of voluntary organizations providing home-based elderly care services shall be supported and developed and the time bank system for elderly care services shall be established to encourage and support mutual aid in elderly care.

    Article 6 Comprehensively promoting the combination of medical care and elderly care

    Medical and health resources distribution for the elderly shall be optimized in overall. Elderly care service institutions shall be connected with designated medical institutions for medical insurance to provide green channels for the elderly to seek medical treatment through first treatment in community, two-way referral and combination of medical care and elderly care. Geriatrics Department shall be set up by medical institutions in accordance with the relevant national provisions; increase of rehabilitation and nursing beds proportion in grass-roots health care institutions shall be supported, and the full coverage of medical and health services of elderly care institutions and community elderly care service institutions shall be realized. Based on the characteristics of elderly care institutions establishing independent medical institutions or setting up built-in medical institutions, qualified medical institutions shall be included into the management scope of the medical insurance agreement by the medical security department according to the relevant provisions, to improve the agreement management regulations and supervise in accordance with law. The development of elderly care services shall be promoted from the focus on life care to long-term nursing. The deep integration of medical and health and elderly care services shall be supported to provide the elderly with integrated health and elderly care services including treatment in the sick period, nursing care in the rehabilitation period, life care in the stable period and hospice care. Health promotion activities for the elderly shall be comprehensively carried out, and services such as disease prevention, health management and chronic disease control shall be provided for the elderly. Medical and nursing personnel shall be encouraged to practice in institutions combining medical care and elderly care and shall enjoy equal treatment in terms of professional title evaluation and other aspects.

    Article 7 Developing intelligent elderly care with innovation

    An intelligent elderly care service platform shall be built to realize one-stop service of elderly care affairs and unified planning of elderly care resources. Internet integration with elderly care services shall be accelerated to cultivate new service forms. The development of intelligent health and elderly care industry shall be pushed, in-depth application of new-generation technologies and smart products such as block chain, artificial intelligence, Internet of Things, cloud computing, and big data in the elderly care field shall be strengthened, and R&D and manufacturing of intelligent products, health management equipment and health and elderly care application software which are suitable for the elderly shall be supported to improve the elderly care efficiency. Elderly care industry clusters shall be cultivated, vigorously boosting the integrated development of elderly care service industry with advanced manufacturing, financial and insurance, cultural, tourism, vocational education and other industries.

    Article 8 Further advancing healthy and sustainable elderly care services

    Attention shall be paid to the service demands of the vigorous elderly and health education and physical examination work shall be strengthened to actively prevent the occurrence and development of diseases. Educational activities such as elderly fitness exercise, elderly health care services, elderly diseases prevention and rehabilitation, and mental health shall be carried out to improve the health and delay aging. Services supply such as elderly education, tourism elderly care, elderly culture, elderly leisure and entertainment and social participation shall be strengthened. Activities that are beneficial to physical and mental health shall be organized for the elderly. Community-based education shall be developed actively to facilitate the elderly to study nearby. The elderly shall be encouraged to engage on a voluntary basis and within their means in social activities such as disseminating cultural and technological knowledge, participating in the development and application of science and technology and establishing social welfare undertakings,, making the vigorous elderly use their strengths to make contributions to their families and the society.

    Article 9 Actively creating a social atmosphere of filial piety and elderly respecting

    Emergency rescue mechanism for the home-based elderly shall be improved, regular visit system for the elderly without other family members, the elderly living alone, the empty nesters and the elderly from special families under family planning shall be established. Qualified social organizations shall be supported to handle elderly care affairs for the special elderly people in accordance with law. Traditional virtues of showing filial piety and respect to the elderly shall be vigorously promoted to create an atmosphere of respecting, supporting, assisting and loving the elderly in the whole society. Demonstration units, model families and outstanding individuals in elderly care services shall be rewarded in accordance with the relevant regulations of the State and Guangdong Province. Enterprises, charitable organizations and individuals shall be encouraged to set up charitable trusts in the elderly care sector and carry out elderly care service charity projects to increase the effective supply of elderly care resources. Preparation for the whole life cycle of elderly care shall be advocated actively to deal with matters related to aging population at the earlier stage.

    Article 10 Strengthening the professionalization construction of elderly care service team

    The Municipal Government shall bring the professional construction of the elderly care service team into Shenzhen's mid- and long-term talent development plan, improve the training, evaluation, selection, employing and incentive guarantee measures for elderly care service talents, and build an elderly care service team with reasonable structure, clear arrangement, and high-quality. The scale of employees in elderly care services shall be expanded through multiple channels, and colleges and secondary vocational schools shall be encouraged to set up majors or courses related to elderly care services to strengthen the training of professionals in elderly care services and management. The professionalization and specialization development of elderly service personnel shall be promoted, the registration management system for elderly service practitioners shall be established, the training and continuing education system for elderly service practitioners shall be improved, salary guidance for elderly service practitioners shall be formulated, and policies related with training fee subsidies, job subsidies and vocational skill appraisal subsidies for elderly service practitioners shall be implemented.

    Article 11 Intensifying the guarantee measures for the construction of elderly care service system

    A systematic and comprehensive legal and policy guarantee system for elderly care services which is composed of this Decision, the implementation plan of the Municipal Government, laws, regulations and regulatory documents shall be established. Coordination mechanism for the construction of elderly care service system shall be established by the municipal and district governments to coordinate the implementation of elderly care service policies and projects. The construction of elderly care service system shall be included in the scope of the government's annual performance appraisal. Financial investment mechanism in the field of elderly care services shall be established and improved, social welfare lottery funds shall give priority to the construction of the elderly care service system, and the expansion of investment and financing channels for elderly care services shall be supported. A monitoring, analysis, and development evaluation mechanism for elderly care services shall be established and information disclosure and policy guidance shall be strengthened in the elderly services field. A comprehensive supervision responsibility list for elderly care services shall be formulated and a cross-industry, cross-field and cross-department joint supervision system shall be established and improved to promote the establishment of a social credit system in elderly care service sector and boost the high-quality development of Shenzhen's elderly care services.

    The Decision shall become effective as of the date of promulgation.
