482 Decision of the Standing Committee of Shenzhen Municipal People's Congress on Winning the Battle Against Pollution and Comprehensively Strengthening the Construction of Ecological Civilization 深圳市人民代表大会常务委员会关于打好污染防治攻坚战全面加强生态文明建设的决定

    In order to fully implement Xi Jinping's Thought on Ecological Civilization, theOpinions of the CPC Central Committee and the State Council on Comprehensively Strengthening Ecological and Environmental Protection and Resolutely Winning the battle Against Pollution, the Opinions of the CPC Central Committee and the State Council on Supporting Shenzhen in Building a Pilot Demonstration Zone for Socialism with Chinese Characteristics, the Resolution of the Standing Committee of the National People's Congress on Comprehensively Strengthening Ecological and Environmental Protection and Promoting Triumph in the Battle Against Pollution in Accordance with Law, the Decision of the Standing Committee of Guangdong Provincial People's Congress on Vigorously Promoting the Prevention and Control of Water Pollution, and the Three-Year Action Plan of Shenzhen Municipality to Win the Battle Against Pollution (2018-2020), and to ensure that the goals of pollution prevention and control shall be achieved as scheduled, the following decision has been made on winning the battle against pollution, comprehensively strengthening the construction of ecological civilization, and taking the lead in building a model of Beautiful China with the harmonious coexistence between humans and nature.

    1. Enhancing political stance and making a successful pilot demonstration

    Xi Jinping's Thought on Ecological Civilization shall be adhered to as the direction guidance and fundamental pursuance, the concept that lucid waters and lush mountains are invaluable assets shall be practiced, the mechanism for developing ecological civilization shall be upheld and improved, and the harmonious coexistence between humans and nature shall be promoted. The basic state policy of conserving resources and protecting the environment, and the principle of giving high priority to the resource conservation, environmental protection and natural restoration shall be adhered to. Firm steps shall be taken on the path of sustainable development featuring increased production, higher living standards and healthy ecosystems. The mechanism for the efficient use of resources shall be established, the system for ecological protection and restoration shall be improved, and the strict accountability system for ecological and environmental protection shall be developed. In accordance with the requirements of the highest standards, the strictest rules, the toughest law enforcement, the greatest efforts, and the best environment, ecological civilization shall be constructed with perseverance to make a successful pilot demonstration. By 2020, the national and provincial tasks of pollution prevention and control shall be completed in an all-round way, the quality of ecological environment across the city shall be significantly improved, and the capability for ecological environment governance and the quality of ecological environment shall be in the forefront of the country.

    In terms of water pollution prevention and control, by the end of 2019, the extremely dirty and malodorous water bodies shall be thoroughly cleaned up; by the end of 2020, the national and provincial assessment objectives of water pollution prevention and control and the target tasks set in the three-year action plan shall be resolutely completed, water bodies with quality below Grade V shall be basically cleaned up, and the quality of centralized drinking water source shall be above the standard stably; chemical oxygen demand and ammonia nitrogen emissions shall be reduced by 24.8% and 22% respectively compared with that of 2015. In terms of air pollution prevention and control, the average annual density of PM2.5 shall be stabilized at 26 micro-grams per cubic meter in 2019 and reduced to 25 micro-grams per cubic meter in 2020, reaching the phase 2 standard of the World Health Organization; emissions of sulfur dioxide and nitrogen oxides shall be reduced by 16% and 2% respectively compared with that of 2015. In terms of soil pollution prevention and control, by the end of 2020, the soil pollution risks across the city shall be under basic control, and the safe utilization rate of contaminated land shall reach 95%. In terms of solid pollutant prevention and control, by the end of 2019, municipal capacity of household waste incineration shall reach 18,000 tons per day; by the end of 2020, the coverage of household waste classification measures shall be over 90%, the safe disposal rate of industrial hazardous waste and medical waste shall reach 100%, and the comprehensive utilization capacity of construction waste shall exceed 15 million tons per year.

    2. Upholding the Party's leadership and resolutely taking responsibilities at all levels

    The Party's leadership in the battle against pollution shall be adhered to, the accountability system which requires “joint responsibilities of both Party and government officials” for environmental protection shall be strictly implemented, and the political responsibilities of pollution prevention and control shall be shouldered in a determined manner. The pollution fighting mechanism involving Party committees' leadership, government direction, enterprises' responsibilities, and public engagement shall be adhered to, and efforts shall be focused on solving major environmental pollution issues to ensure that goals at each stage shall be achieved.

    The municipal and district governments shall assume a general responsibility for the ecological and environmental quality within their respective administrative regions, make the real effort to organize and implement pollution prevention and control measures, implement a strict accountability system and an assessment and evaluation system for environmental protection, and ensure that all tasks shall be actually performed. The principal responsible officials of all departments and districts shall be the primary responsible persons in the battle against pollution, who shall plan for important tasks, look into serious matters, coordinate vital processes, and supervise major cases in person.

    The mechanism for assessing performance of Party and government officials shall be improved, the achievements of enhancing the protection of ecological environment and fighting against pollution shall be included in the assessment of ecological civilization development, and the assessment results shall be an important basis for the general assessment and evaluation as well as awards, punishment, appointment, and removal of leading cadres and leading groups at all levels.

    Enterprises, public institutions, and other producers and business operators shall strictly abide by the laws and relevant regulations, shoulder their responsibilities for pollution prevention and control, and strengthen the operation management of pollution treatment facilities to ensure that pollutant emissions meet the standard.

    3. Adhering to overall coordination and implementing key measures

    A new layout for the city's green development shall be established. Priority shall be given to ecological protection, the functional zoning strategy shall be implemented, urban space planning shall be optimized, and the ecological protection red line shall be strictly observed. Taking the opportunity of building an innovative demonstration zone for the National Agenda for Sustainable Development, the establishment of a green and low-carbon circular development economic system shall be accelerated, and a market-oriented green technology innovation mechanism shall be built. The implementation of ecosystem service value accounting system shall be explored, and the Gross Ecosystem Product (GEP) accounting method system shall be established.

    Protection of quality water bodies shall be strengthened. Refined management and standardization development of drinking water sources protection areas shall be enhanced, and the work of clearing up and rectifying all illegal practices and converting reclaimed orchards to forests within protection areas shall be finished as scheduled. A long-term mechanism of comprehensive and strict control and daily patrol of protection areas shall be developed and improved, rainwater and sewage shall be completely separated within drainage basins across protection areas,  surface source pollution shall be eliminated, and that the water quality of centralized drinking water sources reaches or exceeds Grade III surface water quality standard shall be ensured. Ecological protection of river sources shall be enhanced, and the proportion of surface water with quality rating of Grade III or higher shall be increased comprehensively across the city.

     Extremely dirty and malodorous water bodies shall be thoroughly cleaned up. A thorough screening on extremely dirty and malodorous water bodies shall be conducted, relevant records and lists shall be established, and dynamic management shall be realized. To integrate the concept of sponge city development, a set of rectification and management strategies including discharge reduction from sources, process control, systemic management, and ecological restoration shall be adopted, holistic approaches shall be taken, a comprehensive water environment management system featuring harmony between water and city development shall be formed, and water bodies with quality below Grade V shall be gradually cleaned up. A long-term mechanism shall be established, and the maintenance of clean and clear waters for long shall be realized.

    Actions to enhance the quality and efficiency of treating polluted water shall be taken. Efforts to transform and construct urban domestic sewage collection and treatment facilities shall be accelerated, the system for screening and regularly testing sewage pipe networks shall be developed, and the mechanism for controlling and managing the quality of sewage pipe network construction shall be improved. Full coverage, full collection and full treatment of sewage pipe networks shall be realized, the efficiency of centralized collection of urban domestic sewage shall be significantly enhanced, and the main water output indicators of water purification facilities shall generally reach Grade V or higher. Professional drainage administration shall be practised in communities, and professional operation, maintenance, and management of pipe networks shall be enhanced. An integrated and multi-source water supply system, a sewage system with both centralized and separated sewage pipe networks, a resilient and safe rainwater system, and a smart and efficient management system shall be developed and improved.

    Comprehensive prevention and control of marine pollution shall be strengthened. Comprehensive screening and treatment of seagoing rivers with water quality below Grade V and sea outfalls shall be carried out, and the water discharge standards for water purification facilities in the offshore areas shall be leveled up. The principle of coordinating the sea and the land and determining the land by the sea shall be adhered to, a pilot program for controlling the overall amount of pollutants discharged into key seas shall be implemented, a sea-land coordination monitoring system shall be established, and major sea outfalls shall be monitored smartly. Monitoring and management of pollutants discharged from maritime activities such as maritime transport, ports and piers activities, and sea reclamation projects shall be enhanced. Actions to clean marine oil spills and floating garbage in the ocean shall be taken, and control and management of mariculture pollution shall be strengthened. The marine ecosystem restoration, and the transformation and restoration of underground canals shall be enhance, the sludge cleaning, polluted bottom soil treatment, and damaged bank restoration in key bay areas shall be carried out, ecological seawalls shall be built, and the slow lanes for coastal tourism and recreation shall be connected.

    Innovations in water pollution control mechanism shall be promoted. Efforts to control water pollution in trans-boundary rivers and bays in cooperation with cities such as Hong Kong, Dongguan, and Huizhou shall be reinforced, and joint efforts to protect environment within the region shall be enhanced. The upper reaches and lower reaches, the main stream and tributaries, and the left banks and right banks in drainage basins shall be managed under the same goals, at the same pace, and with the same effectiveness. Innovative models for drainage basin management shall be explored, establishment of relevant administrative organs shall be promoted, centralized management, coordination, and assessment of plants, networks, rivers, sites, pools, sludge, and other elements within various drainage basins shall be strengthened, and integrated and coordinated management across drainage basins shall be realized. Market-oriented and technology-based watercourse management shall be taken forward to achieve a more professional watercourse management level. The system of river chiefs and lake chiefs shall be firmly promoted to coordinate the organization and leadership of water pollution prevention and control regarding rivers, lakes, reservoirs, and ponds within respective areas of responsibility. The system of folk river chiefs shall be perfected, and citizens shall be entitled to participate in and benefit from river protection and management.

    500 kilometer clean waterways of Shenzhen shall be built with high standards. Efforts shall be focused on building 3 types of clean waterways: waterways based on rivers, waterways based on lakes and reservoirs, and waterways based on seas, beautiful and energetic waterfront spaces shall be created along with the construction of clear waterways, and aquatic ecosystem restoration within drainage basins, multi-purpose space utilization, industrial structure transformation, and urban space renewal and functional upgrade shall be promoted. Construction of 100 demonstration public spaces in 10 drainage basin systems across the city shall be accelerated to bring the picture of clear waters, green banks, and beautiful landscapes into life, and each clear waterway shall become a pretty image of the city and an ideal place of recreation for citizens.

    Air pollution prevention and control shall be enhanced. Control of pollution caused by diesel vehicles emissions shall be reinforced, and heavy-duty diesel vehicles emissions shall be monitored online in pilot areas; progress in phasing out diesel vehicles that comply with "China III" vehicle emission standards and have been in use for more than ten years shall be quickened, law enforcement control of inter-city diesel vehicles shall be strengthened, and law enforcement efficiency shall be increased by the application of remote sensor monitoring devices and intelligent devices specialized in capturing images of vehicles that discharge black smoke. The "Seven 100%" measures for controlling dust pollution shall be strictly implemented. Dust pollution control shall be supervised and inspected on a regular basis. Monitoring and control of ship emission pollution shall be enhanced.

    Surveys on soil environmental quality shall be carried out. The management of soil for construction land and agricultural land shall be based on specific use and types respectively, and risk management and control of soil environment in water sources shall be strengthened. Local soil environment standard systems shall be established and improved. Environmental risk assessment and pollution prevention and control of soil transfer under urban renewal projects shall be strengthened. A multi-department coordination and supervision mechanism for polluted lands shall be established, and soil environmental risks during the transfer of construction land shall be strictly controlled.

    “Zero-waste city” development shall be moved forward. The system of classified placement, classified collection, classified transportation, and classified disposal of household waste shall be promoted. The fee charging system for household waste treatment shall be perfected, and the price charged shall be gradually based on the type, quantity and weight of the waste. The layout planning and construction of household waste classification and treatment facilities shall be accelerated. Efforts to reduce the source of household sludge in water purification facilities shall be intensified, and sludge treatment methods shall be explored through multiple channels. The manufacturer responsibility extension system shall be launched, and manufacturing enterprises shall be encouraged to shoulder the responsibility for the recovery of waste products.

    Construction waste discharge reduction and treatment capacity shall be enhanced. Vertical planning management of construction projects shall be strengthened, underground space excavation shall be controlled, soil backfill shall be increased, and discharge reduction of construction projects from the source shall be promoted. The recordation of urban renewal, shanty areas renovation, illegal building dismantling, land requisition, and other building dismantling projects shall be comprehensively implemented, and integrated management of building dismantling, and construction waste clearing, transport, and comprehensive utilization shall be propelled. A reasonable industrial chain planning for utilizing construction waste resources shall be put in place. The preparation of theSpecial Plan of Shenzhen Municipality for Construction Waste Control shall be organized, the construction waste disposal facilities such as construction waste consumption sites, and comprehensive utilization facilities shall be comprehensively sorted out, planned and constructed, and the potential for construction waste disposal shall be further unlocked.

    Comprehensive environmental improvement shall be carried out.  Comprehensive management of urban villages shall be accelerated, cables of power supply, telecommunication, and television shall be embedded underground, gas pipelines, water drainage, property management, and farmers' markets shall be regulated with comprehensive measures, and problems of being dirty, messy, and inferior shall be solved. The city shall be managed in a manner as meticulous as doing embroidery, problems of repeated road building, noise pollution, and dispersed sewage discharge shall be addressed, toilet revolution shall be furthered, and the quality of parks and green ways shall be improved. Comprehensive improvement of enterprises that are scattered, messy, dangerous, and discharging pollutants shall be promoted continuously, and a long-term supervision mechanism for those enterprises shall be established and improved.

    4. Adhering to the rule of law and strict law enforcement

    The strictest system of ecological and environmental protection shall be put in force. The "Sword" series of law enforcement actions for ecological and environmental protection shall be carried out, law enforcement coordination and cooperation, and law enforcement with the help of technologies shall be enhanced, and the tough stance shall be maintained. The construction of a "three-in-one" accountability system that investigates civil, criminal, and administrative liability for offenses against ecological and environmental protection shall be explored. Environment-related public interest litigation system shall be improved, and accountability and compensation for environmental damages shall be strengthened. Ecological and environmental protection policies such as environmental credit assessment and mandated information disclosure shall be perfected, social supervision shall be tightened, and the mechanisms of complaint, report, and feedback shall be advanced.

    Law enforcement in construction waste pollution prevention and control shall be reinforced. The application of smart monitoring system for construction waste shall be promoted, the special rectification of construction waste discharge management shall be organized continuously, and the illegal transfer and dumping of construction waste shall be cracked down resolutely. Law enforcement, investigation and punishment shall be intensified regarding construction projects where the whereabouts of construction waste is unknown or where construction waste is not disposed of in compliance with applicable regulations. Unified punishment measures for safety management of dump trucks shall be strictly implemented, and strict investigation and action shall be taken on various illegal activities of dump trucks in road transport.

    Law enforcement regarding household waste pollution prevention and control shall be enhanced. Jurisdiction-based environmental sanitation accountability system shall be fully implemented, the red line of management responsibilities shall be made clear, and full coverage of clean-environment-keeping management shall be realized. Every corner along river courses and coastal lines shall be monitored, and the amount of pollutants discharged into the sea and rivers shall be reduced practically. Greater efforts shall be put in law enforcement in environmental sanitation, large-scale sanitation inspection and related law enforcement actions shall be continuously carried out, and acts such as littering shall be strictly punished.

    Law enforcement regarding the prevention and control of sludge pollution in water purification facilities shall be strengthened. Screening of sludge transfer and disposal shall be carried out, and the qualifications and capacity of sludge disposal facilities shall be verified. On-site supervision system shall be launched to conduct regular and unscheduled tour inspection and spot checks on sludge disposal enterprises. Enterprises that fail to dispose of sludge in compliance with applicable requirements shall be ordered to rectify their activities within specified time limit and shall not receive the sludge of the city until the rectification is completed.

    Law enforcement regarding hazardous waste pollution prevention and control shall be reinforced. The generation, storage, transfer, and disposal of hazardous waste by enterprises shall be investigated thoroughly, and such acts as unlawful transfer, disposal, and dumping of hazardous waste shall be strictly punished in accordance with law. Enterprises shall be urged to shoulder their responsibilities and to strictly implement mechanisms such as the declaration and registration of hazardous waste, and duplicate forms for transfer of hazardous waste. The training in standardized management of hazardous waste shall be conducted to raise enterprises' awareness of law compliance.

    5. Improving relevant mechanisms and accelerating legislation procedures

    Legislative power of the special economic zone shall be fully exercised. Ecological and environmental protection-related rules, administrative regulations, and regulatory documents shall be sorted out in a comprehensive manner, and the revision of theRegulations of Shenzhen Special Economic Zone on Environmental Protection and the Regulations of Shenzhen Municipality on Water Drainage as well as the formulation of the Regulations of Shenzhen Special Economic Zone on Air Pollution Prevention and Control shall be accelerated. Efforts shall be made to promote the Standing Committee of Guangdong Provincial People’s Congress to regulate the ecological protection, and pollution prevention and control within trans-boundary river basins in water pollution-related legislation, bringing the coordinated protection and control of trans-boundary rivers into the track of rule of law. A comprehensive review of technical standards in ecological environment shall be conducted, the standardization development of ecological environment shall be promoted vigorously, local standards and technical specifications in key areas such as soil, noise, exhaust gas, and sewage shall be formulated, and high quality development shall be promoted.

    6. Giving full play to functional roles and strengthening supervision by the people’s congresses

    The standing committees of municipal and district people's congresses shall take pollution prevention and control as their key supervisory work, and conduct real-time and collaborated supervision of prominent issues through a combination of measures such as law enforcement inspection, work report hearing and deliberating, and special inquiries and questioning to ensure supervision effectiveness. During the uphill battle against pollution, the report on the progress of water pollution prevention and control and on the implementation of the three-year action plan submitted by the people's government at the corresponding level shall be heard at least once every six months. To maximize the role of deputies to people’s congresses, channels and methods for deputies to participate in the supervision of pollution prevention and control shall be explored and enriched. The duty performance platform in the form of community liaison station for deputies to people’s congresses shall be made good use of, and the supervision of pollution prevention and control by deputies shall be extended to the grass-roots level. The coordinated supervisory role played by people’s congresses and the public shall be strengthened, and the influence and effectiveness of people’s congresses’ supervisory role shall be amplified and enhanced.

    7. Mobilizing social involvement to pursue co-development, co-governance and common interests

    The whole society shall be mobilized to participate in the development of ecological civilization, consciously perform the statutory obligations to protect ecological environment, and achieve co-development, co-governance and common interests in the development of ecological civilization. National green actions shall be taken, the idea of green life and the lifestyle of being simple, moderate, green, and low-carbon shall be advocated, extravagance and unreasonable consumption shall be opposed, and the public shall be led to consciously practise green ways of living. The development of resource-conserving organs and eco-friendly families, schools, and communities shall be encouraged, the whole society shall be mobilized to cut down on the amount of resource consumption and pollutant emission, and the formation of green development mode and ways of living shall be accelerated. To maximize their roles, non-governmental environmental protection organizations shall be supported to  carry out environmental protection activities in accordance with law. Laws and regulations regarding pollution prevention and control shall be further publicized and popularized, the social awareness of environmental protection and the rule of law shall be raised, the respect, study, compliance, and use of law shall be promoted, and the environmental protection in accordance with law shall become a social consensus and a conscious action taken by all members of the society.

    The Decision shall come into effect as of the date of promulgation.
