各区政府(新区管委会)、各市级行政执法部门:

To all district governments (including the management committees of new districts) and all municipal administrative enforcement departments:

  为了全面贯彻落实《中共中央关于全面推进依法治国若干重大问题的决定》、中共中央国务院《法治政府建设实施纲要(2015-2020年)》,全面推行行政执法公示制度,促提全市严格规范公正文明执法质量和水平,经研究,我办组织制定了《深圳市推行行政执法公示制度工作方案》。现予印发,请遵照执行。

  In order to comprehensively implement the Decision of the Central Committee of the Communist Party on Several Major Issues Concerning Comprehensively Promoting the Rule of Law and the Outline of the State Council of the Central Committee of the Communist Party on the Implementation for Building a Law-based Government (2015-2020), and to fully implement the administrative enforcement publicity system, the Shenzhen municipality is urged to improve the quality of law enforcement in strict, fair and civilized way according to due procedures. Upon review and study, we organize to formulate the Work Program of Shenzhen Municipality of Promotion of the Administrative Enforcement Publicity System. It is hereby issued and shall be strictly observed.

  深圳市推行行政执法公示制度工作方案

  Work Program of Shenzhen Municipality of Promotion for the Administrative Enforcement Publicity System

  为了贯彻落实党的十八届四中全会精神,全面推行行政执法公示制度,促提全市严格规范公正文明执法质量和水平,保障和监督行政机关有效履行职责,维护人民群众合法权益,制定以下方案。

  In order to implement the spirits of the Fourth Plenary Session of the 18th CPC Central Committee, and to fully promote the administrative enforcement publicity system, Shenzhen municipality is urged to improve the law enforcement quality in strict, fair and civilized way according to due procedures, so as to safeguard and supervise effective performance of duties of the administrative agencies, and to protect people’s legitimate rights and interests. The Work Program is hereby formulated.

  一、总体要求

  I. General Requirements

  深入贯彻落实《中共中央关于全面推进依法治国若干重大问题的决定》、《法治政府建设实施纲要(2015-2020年)》以及广东省的实施意见,按照依法有序、科学规范、便捷高效的原则,紧密联系工作实际,积极稳妥推行行政执法公示制度,促进行政执法公开透明、合法规范,加快建设法治政府,进一步推进“放管服”、“强区放权”改革,优化我市经济社会发展环境。

  Promote proactively and steadily the administrative enforcement publicity system in a scientific, normative, convenient, efficient, orderly and in conformity with the law manner with strong links to the actual work situation, to comprehensively implement the Decision of the Central Committee of the Communist Party on Several Major Issues Concerning Comprehensively Promoting the Rule of Law, the Outline of the State Council of the Central Committee of the Communist Party on the Implementation for Building a Law-based Government (2015-2020) and implementation opinions of Guangdong Province. It is aimed to improve the transparency and normativity of administrative enforcement, and accelerate the building of a law-based government and advance the ‘reform to delegate power, streamline administration and optimize government services’ and the ‘reform of power decentralization for developed districts’ so as to improve the economic and social development environment of Shenzhen city.

  二、公示原则

  II.Principle of Publicity

  坚持以公开为常态、不公开为例外原则,除涉及国家秘密、商业秘密、个人隐私以及其他依法不予公开的信息外,行政执法信息应当及时、规范、全面、准确、便民地向社会公开。

  Uphold the principle of always remaining transparent other than in exceptional cases. All administrative enforcement information shall be disclosed to the public in a timely, normative, comprehensive, accurate and convenient manner, except for national secrets, trade secrets, personal privacy and other information which is not allowed to be disclosed according to law.

  三、公示方式

  III.Methods of Publicity

  除法律、法规、规章对公示方式有明确规定外,行政执法公示以门户网站为必要载体,市、区行政执法部门还可以采用发布公告、在办公场所设置公示栏、电子显示屏或放置宣传册、公示卡等方便社会公众监督的方式作为补充。

  Subject to other explicit provisions of laws, administrative regulations and rules, the publicity of administrative enforcement shall take the form of a portal website. Municipal and district administrative enforcement departments may also employ other methods convenient for public supervision, including publishing announcements, setting up bulletin boards and electronic visual displays and preparing brochures and publicity cards at office places, etc.

  四、任务措施

  IV. Measures

  (一)加强事前公开

  (I) Strengthen ex-ante publicity

  1.公告行政执法主体及委托执法

  1. Announcement of the administrative enforcement officers and entrusted administrative enforcement organizations

  按照《深圳市行政执法主体公告管理规定》(深府令第126号)的要求,行政执法主体及委托执法须报请市政府批准后在《深圳市人民政府公报》上进行公告。公告后,市、区行政执法部门应当分别将市政府批准的公告文本(扫描版或电子版,电子版链接网址以“深圳政府在线—信息公开—政府公报专栏”为准)在本部门、各区政府(新区管委会)门户网站上公布。委托执法公告应当在委托主体和受委托组织的门户网站公布。

  In accordance with the requirements of the Regulations of Shenzhen Municipality on Management of Announcement of Administrative Enforcement Officers (Order No. 126 of Shenzhen Municipal People's Government), administrative enforcement officers and entrusted administrative enforcement shall be announced after being approved by Shenzhen municipal government at the Gazette of the People's Government of Shenzhen Municipality. After the announcement, municipal and district administrative enforcement departments shall respectively publish the approved announcement document (scanned or electronic version, and the electronic version at "Shenzhen Government Online - Government - Government Gazette" shall prevail over other electronic versions) on the portal websites of the departments and on those of all district governments (including the management committees of new districts). The announcement of entrusted administrative enforcement shall be published on both the portal sites of the entrusting agencies and the entrusted organizations.

  2.公开行政执法权责清单

  2. Disclosure of the list of powers and responsibilities of administrative enforcement

  市、区行政执法部门应当按照我市清理行政职权和编制权责清单的工作要求,在网上办事大厅、门户网站、服务窗口等场所向社会主动公开行政许可、行政处罚、行政强制、行政征收、行政裁决、行政检查、行政确认、行政给付、行政指导、其他服务等行政执法职权、依据、标准、执法流程(办事指南)、监督方式、救济渠道。

  Municipal and district administrative enforcement departments shall, in accordance with the work requirements of sorting out administrative powers and compiling the list of powers and responsibilities of the administrative enforcement, take the initiative to disclose at online service centers, portal websites and service windows and other places the information of administrative enforcement powers, enforcement basis, enforcement standards, enforcement procedures (guidelines), supervision methods and legal remedies in administrative licensing, administrative penalty, administrative coercion, administrative expropriation, administrative ruling, administrative inspection, administrative confirmation, administrative supply, administrative guidance and other services.

  3.公开行政执法人员基本信息

  3. Disclosure of basic information of administrative enforcement officers

  强化执法人员资格管理,在“深圳政府法制信息网”提供全市行政执法人员基本信息公开查询服务,鼓励社会公众查询、监督。

  Strengthen the management of the qualification of administrative enforcement officers, and provide open inquiry service on the Shenzhen Government Online for basic information of the administrative enforcement officers of Shenzhen city to encourage the public’s inquiry and supervision.

  4.公开行政处罚裁量权基准制度

  4. Disclosure of discretionary power benchmark system in administrative penalty

  市级行政执法部门应当依据《深圳市规范行政处罚裁量权若干规定》(深府令第196号)的要求,制定(修订)并及时在门户网站公开本行业、本系统涉及的所有行政处罚裁量权基准制度,同时将公开的网址链接至“深圳政府法制信息网”专栏,供社会公众查阅、监督。

  Municipal administrative enforcement departments shall, in accordance with the requirements of the Several Provisions of Shenzhen Municipality on Regulating Discretionary Power in Administrative Penalty (Order No.196 of Shenzhen Municipal People's Government), formulate (revise) and promptly disclose on their portal websites all benchmark systems of discretionary power in administrative penalty involved in each industry and system. The portal websites shall be linked to the special column in Shenzhen Government Online for public inspection and supervision.

  通过深圳市权责清单管理系统公布的“行政裁量标准”内容,应当与市级行政执法部门正式印发的制度文件保持一致。

  The contents of “discretionary power standards” published via the system for the list of powers and responsibilities of administrative enforcement shall be in consistent with the contents of the institutional documents officially issued by the municipal administrative enforcement departments.

  5.公开行政执法检查随机抽查事项清单

  5. Disclosure of list of matters subject to random inspections in administrative inspection

  推行“双随机、一公开”的市、区行政执法部门,分别在本部门、各区(新区)门户网站向社会公布随机抽查事项清单。随机抽查事项清单要明确抽查依据、 抽查主体、 抽查内容、 抽查方式等,提高行政机关职责履行的透明度,加强社会监督。

  Municipal and district administrative enforcement departments that promote the “Dual Random and One Publication” Model should disclose the list of matters subject to random inspections to the public on the portal websites of the departments and all district governments (including the management committees of new districts). The list of matters subject to random inspections should clearly define the inspection basis, inspecting agency, inspection matters and inspection methods to improve the transparency of the administrative agency performing duties and enhance social supervision.

  6.公开行政收费主体、收费依据

  6. Disclosure of the agency and basis of administrative charges

  市、区行政收费部门应当在收费场所的显著位置并分别在本部门、各区政府(新区管委会)门户网站公开行政收费主体、收费依据、监督投诉方式。

  The municipal and district administrative enforcement departments responsible of administrative charges shall disclose the agency and basis of administrative charges as well as the supervision and complaints methods in a conspicuous place where the charges are collected and on the portal websites of the departments and all district governments (including the management committees of new districts).

  (二)规范事中公示

  (II) Regulate in-process publicity

  1.出示(公示)行政执法证件和文书

  1.Production (publication) of administrative enforcement certificates and instruments

  行政执法人员从事行政检查、行政处罚、行政强制执法活动,一律佩戴或者出示《深圳市人民政府行政执法证》或者其他有效执法证件。

  All administrative enforcement officers engaged in the activities of administrative inspection, administrative penalty and administrative coercion shall wear or produce the Administrative Enforcement Certificate of Shenzhen Municipal People’s Government or other valid administrative enforcement certificates.

  行政执法人员从事执法活动,要出示或公示有关执法文书,做好告知说明工作。

  Administrative enforcement officers shall produce or publicize relevant enforcement instruments and fulfill their duty to inform in performing administrative enforcement activities.

  2.明示服务窗口(场所)工作人员信息

  2. Publication of information of staff working at the service windows (sites)

  行政许可、行政收费等服务窗口或者其他服务场所,要明示工作人员岗位信息、监督投诉方式。

  The job descriptions of the staff and supervision and complaints methods shall be displayed clearly at the service windows or other service places for administrative licensing and administrative charges.

  (三)推动事后公开

  (III) Promote ex-post publicity

  1.公开行政执法检查随机抽查情况和查处结果

  1. Disclosure of results and handling outcomes of random inspections in administrative inspection

  市、区行政执法部门应当分别将开展“双随机”检查的抽查情况和查处结果在本部门、各区政府(新区管委会)门户网站及时、主动向社会公示,加大执法检查信息公开力度。

  Municipal and district administrative enforcement departments shall respectively publicize on the portal websites of the departments and all district governments (including the management committees of new districts) in a timely and proactive manner the results and handling outcomes of “Dual Random” inspections to widen the range of disclosure of the information of administrative inspection.

  2.公示行政许可、行政处罚信息

  2. Publication of administrative licensing and administrative penalty information

  市、区行政执法部门应当按照市发展改革委前期印发的“双公示”工作要求,继续推进行政许可、行政处罚信用信息公示工作。除法律、法规、规章另有规定外,自作出决定之日起7个工作日内分别通过本部门、各区政府(新区管委会)门户网站进行公示。公示的具体行政许可事项包括行政相对人名称及其身份代码(省里已明确:居民身份证号码报送系统数据时提供完整信息,但只对外公示前6位和后4位数字,中间8位数字作隐藏处理)、决定文书编号、许可内容、许可日期、有效期限、许可部门,以及作出行政许可决定的部门认为应当公示的相关信息。公示的具体行政处罚事项包括行政相对人及其身份代码、案件名称、决定文书编号、处罚事由、处罚依据、处罚结果、处罚时间、处罚部门,以及作出行政处罚决定的部门认为应当公示的相关信息。

  Municipal and district administrative enforcement departments shall continue to promote the publication of credit information of administrative licensing and administrative penalty in accordance with the work requirements of “Dual Publication” issued by the Development and Reform Commission of Shenzhen Municipality. Subject to other provisions of laws, administrative regulations and rules, the aforesaid information shall be publicized on the portal websites of the departments and all district governments (including the management committees of new districts) within 7 working days from the date when the administrative decision is made. Information of administrative licensing subject to disclosure includes name and identity code of the administrative counterpart (provincial government has made it clear that the resident’s full ID card number should be submitted, but only the leading 6 and the last 4 digits should be publicized while the 8 digits in the middle are concealed), code number of the administrative decision instrument, contents, date, validity of the administrative licensing, the licensing department, and any relevant information that the department making the administrative licensing decision deems necessary to be publicized. Information of administrative penalty subject to disclosure includes the administrative counterpart and its identity code, case name, code number of the administrative decision instrument, reasons, basis, result and time period of the penalty, the department imposing the penalty, and any relevant information that the department making the administrative penalty decision deems necessary to be publicized.

  鼓励执法部门公开行政许可决定书、行政处罚决定书全文。公开全文时,应当采取适当技术隐去以下信息:(1)被处罚人以及被处罚企业(或者其他组织)的法定代表人(或者负责人)以外的自然人的姓名;(2)居民身份证号码(中间8位数字作隐藏处理)、住址、通信方式、电话号码、银行账号、财产状况等个人信息;(3)法人或者其他组织的银行账号;(4)其他依法不宜公开的信息。

  The administrative enforcement departments are encouraged to disclose full text of the administrative licensing decision instrument and the administrative penalty decision instrument. When the full text is disclosed, the following information shall be concealed by proper means: (1) name of the natural persons other than the person or the legal representative (or person-in-charge) of the enterprise(or other organization) penalized; (2) the resident’s personal information, including the ID card number (the middle 8 digits should be concealed), address, method of communication, telephone number, bank account number, property status, etc.; (3) bank account number of the legal person or other organization; (4) any other information which is not suitable to be disclosed in accordance with law.

  3.公示行政强制文书

  3. Publicity of administrative coercion instruments

  市、区行政执法部门应当自行政强制措施、行政强制执行决定作出之日起7个工作日内分别通过本部门、各区政府(新区管委会)门户网站进行公示。公示的具体事项包括行政相对人名称其身份代码(参照行政许可、行政处罚的做法)、案件名称、决定文书编号、行政强制事由、行政强制措施内容和期限、行政强制执行方式和期限、强制决定作出时间、强制决定作出部门以及作出行政强制决定的部门认为应当公示的相关信息。

  Municipal and district administrative enforcement departments shall publicize the administrative coercive measures and coercive enforcement instruments on the portal websites of the departments and all district governments (including the management committees of new districts) within 7 working days from the date when the decision is made. Information of administrative coercion subject to disclosure includes the administrative counterpart and its identity code (in reference to the requirements in administrative licensing and penalty), case name, code number of the decision instrument, reasons, content and time period of the coercive measures, means and time period of the coercive enforcement, the department making the administrative coercion decision, and any relevant information that the department making the administrative coercion decision deems necessary to be publicized

  鼓励执法部门公开行政强制决定文书全文。公开全文时,应当采取适当技术隐去以下信息:(1)被强制人以及被强制企业(或者其他组织)的法定代表人(或者负责人)以外的自然人的姓名;(2)居民身份证号码(中间8位数字作隐藏处理)、住址、通信方式、电话号码、银行账号、财产状况等个人信息;(3)法人或者其他组织的银行账号;(4)其他依法不宜公开的信息。

  The administrative enforcement departments are encouraged to disclose full text of the administrative coercion decision instrument. When the full text is disclosed, the following information shall be concealed by proper means: (1) name of the natural person other than the person or the legal representative (or person-in-charge) of the enterprise(or other organization) being imposed the coercion decision; (2) the resident’s personal information, including the ID card number (the middle 8 digits should be concealed), address, method of communication, telephone number, bank account number, property status, etc.; (3) bank account number of the legal person or other organization; (4) any other information that is not suitable to be disclosed in accordance with law.

  五、保障措施

  V. Safeguarding Measures

  (一)强化组织领导。推行行政执法公示制度,对于规范行政执法行为意义重大。请各区政府(新区管委会)、各市级执法部门高度重视,加强组织领导,明确责任分工,强化内部督查,严格按照方案明确的时限推进各项工作,确保行政执法公示制度推行到位。特别说明的是,区级执法部门的执法公示工作请各区政府(新区管委会)负责统一组织、指导、协调。

  (1) Enhance organization and leadership. It is of great significance to regulate the performance of administrative enforcement to promote the administrative enforcement publicity system. All district governments (including the management committees of new districts) and municipal administrative enforcement departments shall attach great importance to it, strengthen organization and leadership, clarify roles and responsibilities, reinforce internal supervision, and strictly proceed the work in line with the time limit specified in the Program, to ensure that the administrative enforcement publicity system is well-implemented. In particular, the district governments (including the management committees of new districts) are responsible to carry out an unified organization, guidance and coordination for the administrative enforcement publicity work of their own administrative enforcement departments.

  (二)及时动态调整。新颁布或修改、废止法律、法规、规章和规范性文件,行政执法部门执法职能调整等原因引起行政执法公示内容发生变化的,相关单位应及时更正相关公示内容,确保所公示内容真实、完整、有效。

  (II) Timely adjust information. For changes in contents of administrative enforcement publicity due to newly-promulgated, amended or abolished laws, administrative regulations, statutes, other normative instruments and adjustment of functions of the administrative enforcement departments, responsible units shall timely make adjustments to relevant publicized information accordingly to ensure that the publicized information are true, complete and valid.

  (三)鼓励探索创新。市、区行政执法部门可以因地制宜、因时制宜,遵循从严执法精神,积极探索行政执法公示的范围、内容、方式、时限和程序,健全公开信息的审核、纠错和监督机制,不断提升执法公示质量。

  (III) Encourage exploration and innovation. Municipal and district administrative enforcement departments may adjust measures according to the local conditions and time, and uphold the principle of strict administrative enforcement, actively exploring the scope, content, method, time period and procedures of administrative enforcement publicity, advancing the review, correction and supervision of disclosed information mechanism, and continuously improving the quality of law enforcement publicity. ?

  (四)严格督查考核。推行执法公示制度工作已纳入我市2017年度法治政府建设考评指标体系。市、区行政执法部门应当建立健全各项执法公示事项的内部管理制度,强化督查、严格执行。请各区政府(新区管委会)予以指导督促。

  (IV) Urge strict supervision and assessment. The implementation of administrative enforcement publicity system has been incorporated into the 2017 Evaluation System for Building a Law-based Government of Shenzhen City. Municipal and district administrative enforcement departments shall establish and improve the internal management system for all administrative enforcement publicity matters, strengthen supervision and urge strict enforcement. All district governments (including the management committees of new districts) are required to guide and supervise the work.
