324 Several Rules of Shenzhen on Long-Gang Great Industrial Park[深圳市龙岗大工业区若干规定(2004)]

Chapter One General Provisions  

 

     

 

      Article 1 In order to accelerate the development of Shenzhen Long-Gang Great Industrial Park and create good investment environment, these rules are hereby formulated. 

 

       

 

Article 2 Shenzhen Long-Gang Great Industrial Park ( hereinafter referred to as the industrial park ) refers to the area defined by the Shenzhen Municipal People’s Government ( hereinafter referred to as the  municipal government ) for carrying out economical and technical development under its leadership. The industry in the industrial park shall take the electronic information industry as the main industry, take the advanced technology industry as the core industry, and take the industries of finance, real estate, trading and service as the accessorial industries.  . 

 

  

 

Article 3  The industrial park shall provide good investment environment for investors and get done with the projects of land leveling, water supplying, power supplying, draining, communication, road, environment protection and other public facilities.  

 

  

 

Chapter Two Administrative Organization  

 

Article 4 The leading group of Shenzhen Long-Gang Great Industrial Park and Shenzhen Export Processing Zones Leading Group shall be the organization for making decisions and coordination of the industrial park. The leading group shall be composed of one chief which shall be hold by the mayor, several deputy chiefs, and members which shall be hold by the leading officials of relevant municipal functional departments.   

 

  

 

Article 5 The leading group shall exercise the following functions and duties: 

 

1. making the development guidelines and policies of the  industrial park;  

 

2.  examining and approving the development planning and annual financial plan of the  industrial park; 

 

3. making decisions and supervising on all important matters of the  industrial park; 

 

4. making coordination and solving big problems  in the development, construction and administration of the industrial park. 

 

  

 

      Article 6 The leading group shall establish an administrative committee of the industrial park as a detached agency (hereinafter referred to as the administrative committee) of the municipal government to take charge of the administrative affairs of the industrial park with the economic administration authority of the municipal level. The administrative committee shall be composed of one director and several deputy directors.  

 

  

 

      Article 7 The administrative committee shall exercise the following functions and duties:  

 

  

 

1. organizing the drafting of the overall planning and the planning of industry development, land utilization, information construction, city designing and environment protection of the industrial park, organizing the drafting of relevant rules and specific administration measures, and organizing the implementation of the planning, rules and measures after they are approved  by the municipal government through legal procedures;   

 

2.making the examination and approval when an investor applies for investing into a project in the industrial park with the authority entrusted by law.  

 

3. taking charge of distributing builder’s license in the  industrial park and other affairs with the authority entrusted by the municipal administrative department of construction according to law and under its guidance;   

 

4. taking charge of the affairs of personnel and social security  of the industrial park, making the annual recruitment plan according to needs and fulfilling the procedures of recruitment, examination and approval, and employment after the plan is approved by the municipal administrative departments of personnel and labor;   

 

5.  managing the finance of the industrial park and  the state-owned property which is in the industry park and belongs to the municipality;  

 

6. fulfilling the previous formalities when the Chinese staff member of the industry park applies for going abroad for a short-term on business or going to Hong Kong, Macau  or abroad for training, and submitting the application to the municipal foreign affairs department for approval.  

 

7. cooperating with the administrative departments of customs, tax and foreign exchange when they carry out administration;   

 

8.other authorities granted by the  municipal government.  

 

  

 

 Article 8 The municipal administrative departments of planning, state-owned land, industry and commerce, public security and taxation shall establish sub-bureaus in the industrial park, which shall be under the dual leadership of the administrative committee and their own competent departments which shall take the main leading responsibilities.    

 

  

 

Article 9  When an enterprise applies for establishing a project, signing a land-use contract, or starting construction, the Administrative Committee of the Industrial Park and the relevant governmental departments shall finish all the procedures within 15 working days.  

 

  

 

  Chapter Three  Investment and Operation  

 

Article 10 It is encouraged that domestic and abroad investors invest or initiate the following industries, or operate the following businesses:  

 

  

 

1、  new and high-tech enterprises; 

 

2、  enterprises with advanced technology; 

 

3、  enterprises earning foreign exchange through exportation; 

 

4、  large and important projects;  

 

5、  projects on basic facilities, such as energy, traffic, communications and environment protection facilities.  

 

  

 

It is forbidden in the industry park to establish any project which has serious pollution or is forbidden by national laws or regulations.  

 

  

 

Article 11 The administrative committee may entrust the developing management company of the industrial park in managing development construction and real estate.   

 

  

 

Article 12 Enterprises with new and high technology in the industrial park which are recognized by the municipal government shall enjoy all the preferential policies made by the municipal government for enterprises of the same kind.   

 

  

 

Chapter Four Supplementary Provision  

  Article 13 These rules shall take effect as of the date of promulgation. The Administrative Rules on Shenzhen Long-Gang Great Industrial Park, which is promulgated by the municipal government on February 10, 1995, shall be abrogated simultaneously.
