504Regulations of Shenzhen Municipality on Supervision of Household Waste Sorting深圳市生活垃圾分类管理条例

(Adopted at the Thirty-seventh Session of the Standing Committee of the Sixth People's Congress of Shenzhen Municipality on December 31, 2019, and approved at the Twenty-first Session of the Standing Committee of the Thirteenth People's Congress of Guangdong Province on June 23, 2020)

Chapter One General Provisions

  Article 1 For the purpose of strengthening the management of household waste sorting, improve the level of reduction, resource utilization and harmless treatment of household waste, improve the residents' living environment, and raise the level of urban civilization, these Regulations are hereby formulated in accordance with the relevant laws and regulations and in light of actual circumstances of Shenzhen Municipality.

  Article 2 These Regulations shall apply to disposal, collection, transportation, treatment, source reduction, and related management activities of household waste in a sorted manner in Shenzhen Municipality.

  Article 3 The "household waste" mentioned in these Regulations refers to the solid waste discharged from everyday life or from services provided for everyday life, as well as the solid waste that is regarded as household waste under laws and regulations.

  Construction and demolition waste discharged from the decoration of houses shall be treated according to the Regulations of Shenzhen Municipality on Discharge Reduction and Utilization of Construction and Demolition Wastes and other relevant provisions of Shenzhen Municipality.

  Article 4 The management of household waste sorting shall follow the principles of promotion by government, society-wide participation, institutional constraint, habit formation, systemic advancement, and gradual progress.

  Article 5 The municipal people's government shall incorporate the management of household waste sorting into plans for national economic and social development, determine the management objectives of household waste sorting, strengthen the publicity and education, training, administrative law enforcement and guarantee mechanism of funds for household waste sorting, and improve the management working mechanism for household waste sorting.

  Article 6 District people's governments shall be responsible for organizing the management of household waste sorting within their respective jurisdictions, and implement the management objectives of household waste sorting, for the purpose of providing corresponding security.

  Subdistrict offices shall be responsible for the management of household waste sorting within their respective jurisdictions.

  Community residents' committees shall assist the district people's governments and subdistrict offices in effectively handling publicity and guidance on household waste sorting. The requirements for disposal of household waste in a sorted manner shall be encouraged to be included in residents' conventions.

  Article 7 The municipal urban administration and law enforcement department (hereinafter referred to as the competent municipal department) is the competent department of the management of household waste sorting in Shenzhen Municipality. It shall be responsible for preparing or formulating the management rules for household waste sorting and organizing the implementation thereof, and undertaking coordination, supervision and administration of household waste sorting in Shenzhen Municipality.

  The district urban administration and law enforcement departments (hereinafter referred to as the competent district departments) shall be responsible for the management of household waste sorting within their respective jurisdictions.

  The municipal and district departments of development and reform, planning and natural resources, ecology and environment, housing and construction, education, commerce, culture, radio, television, tourism and sports, and market regulation shall effectively carry out the work related to the management of household waste sorting according to the law within the scope of their responsibilities.

  Article 8 The competent municipal department shall organize the preparation of a municipal development plan for household waste sorting to set forth work objectives, arrangements and safeguards, incorporate the layout of facilities for transfer, recycling and disposal of household waste sorting into the municipal plan for environmental health facilities, and organize the implementation thereof upon approval by the municipal people's government.

  Article 9 The municipal and district planning and natural resources departments shall incorporate the construction of facilities for disposal, collection, transportation and treatment of household waste in a sorted manner into the construction requirements for public service facilities, and incorporate the land required for the construction of relevant infrastructure into the land supply program.

  Newly built, rebuilt and expanded construction projects shall be equipped with household waste sorting facilities according to standards. The household waste sorting facilities built as ancillaries shall be designed, constructed, accepted, and put into use at the same time as the principal part of the project.

  Article 10 The municipal center of household waste sorting management affairs is a dedicated body in charge of management services of household waste sorting allocation by the government, and it shall perform the following duties:

  (1) Participating in the formulation of development plan and work plan for household waste sorting, and drafting the formulation of catalog, relevant standards and technical specifications for household waste sorting;

  (2) Participating in the work related to guidance, supervision, assessment and evaluation of municipal household waste sorting;

  (3) Organizing professional training related to the management of household waste sorting;

  (4) Preparing publicity and education materials for the management of household waste sorting, carrying out publicity and promotion campaigns, and popularizing knowledge related to household waste sorting;

  (5) Promoting the research and application of collection, transportation, and disposal techniques for household waste in a sorted manner, and exploring the dispoal mechanism of household waste with dedicated garbage bags;

  (6) Organizing and guiding the sorted reduction pilots, construction of demonstration sites, establishment of compliance standards regarding household waste, and promotion of the implementation thereof;

  (7) Undertaking other relevant work assigned by the competent municipal department.

  Article 11 Entities and individuals shall dispose of household waste in a sorted manner, pay due fees for the disposal of household waste, and reduce the volume of household waste generated in accordance with the provisions.

  The municipal people's government shall, in accordance with the principles of producer-pays and differentiated pricing, improve the household waste disposal charging system to gradually implement classified pricing and pay-as-you-throw scheme.

  Article 12 Technological innovation in household waste sorting shall be encouraged, and research and application of advanced equipment and process for waste sorting shall be supported to enable intelligent, specialized and information-based management of household waste sorting.

  The municipal and district competent departments may leverage intelligent information systems to collect information on the management of household waste sorting and relevant evidence.

  Chapter Two Disposal in a Sorted Manner

  Article 13 Household waste is classified into recyclables, kitchen waste, hazardous waste, and other waste according to the following requirements:

  (1) Recyclables, which refer to waste that can be recycled and utilized as resources, including waste glass, metal, plastics, paper, fabric, furniture, electrical and electronic products, among others;

  (2) Kitchen waste, which refers to putrescible food residues, melon rinds and kernels, and other waste containing organic matter, including household kitchen waste, restaurant kitchen waste, and other kitchen waste;

  (3) Hazardous waste, which refers to waste that is directly or potentially hazardous to human health or natural environment and shall be specially disposed of, including battery, lamp tube, and household chemicals;

  (4) Other waste, which refers to other household waste except for recyclables, kitchen waste, and hazardouse waste.

  Article 14 The competent municipal department shall formulate a catalog of household waste sorting in conjunction with the municipal departments of ecology and environment and commerce as per the economic and social development level, characteristics of household waste sorting, and disposal and utilization methods, supplement relevant requirements as appropriate, and publish it to the public.

  Article 15 The competent municipal department shall formulate the specifications for allocation of household waste sorting facilities and equipment, and publish them to the public.

  Colors, sorting marks, and relevant warning signs of household waste sorting containers shall be standardized, clear, eye-catching, and easy to identify.

  The district competent departments may refine the categories and reasonably standardize the number of household waste sorting containers based on the actual circumstances of different areas within their jurisdictions.

  The district competent departments shall guide subdistrict offices to explore the provision of convenient disposal services in a sorted manner of household waste.

  Article 16 Entities and individuals, as obligors of disposal of household waste ina sorted manner, shall throw household waste in a sorted manner into corresponding collection containers or designated disposal stations.

  Article 17 Household waste shall be disposed in a sorted manner according to the following provisions:

  (1) Waste furniture and electrical and electronic products shall be thrown into designated disposal stations, while other recyclables shall be thrown into recyclables collection containers or be recycled by recycling entities or individuals;

  (2) Household kitchen waste shall be thrown into dedicated collection containers at the designated time after draining of grease and water and if packaged in disposable storage bags, such storage bags shall be separately thrown into collection containers for other waste.

  (3) Kitchen waste that cannot be applied to in-situ treatment shall be thrown into collection containers dedicated for kitchen waste after draining of grease and water;

  (4) Other kitchen waste generated from agricultural product wholesale markets, farmer's markets, large supermarkets, etc., shall be separately managed;

  (5) Hazardous waste shall be disposed of in a sorted manner according to the collection container marks; waste drugs and devices shall be thrown into corresponding collection containers after their packages have been destroyed or destructive marks have been made;

  (6) Discarded new year flowers and plants shall be thrown into designated disposal stations for new year flowers and plants at the time announced by the district competent departments or be collected by recycling entities or individuals door-to-door;

  (7) Discarded ordinary flowers and plants shall be separated into pots, plants and soil, which shall be thrown into collection containers for recyclables, kitchen waste and other waste respectively, or thrown into designated disposal stations or be collected by recycling entities or individuals door-to-door;

  (8) Greening waste generated by tree pruning in parks, on municipal roads, and within residential areas, including wood or bamboo, tree branches, flowers and leaves, shall be dumped separately.

  The municipal and district competent departments shall publish the list, contact information and charging fees of entities that collect waste furniture, electrical and electronic products, new year flowers and plants, and other flowers and plants.

  Article 18 A system of household waste disposal at fixed time and fixed places shall be established.

  The district competent departments shall determine the specific household waste disposal time according to the system of household waste disposal at fixed time and fixed places and in light of the actual situation within their administrative areas. In particular, there shall be not less than two periods a day for household kitchen waste disposal.

  Article 19 A manager system of sorted household waste disposal shall be implemented. A manager responsible for disposal of household waste in a sorted manner shall be determined according to the following provisions:

  (1) Where a State organ, enterprise, public institution, mass organization or other social organization entrusts a property service enterprise or a specialized institution to be responsible for the management of environmental health in office and production premises, such entrusted property service enterprise or specialized institution shall serve as the manager of disposal of household waste in a sorted manner; where the entity itself is responsible for the management of environmental health in its office and production premises, it shall serve as the manager responsible for disposal of household waste in a sorted manner;

  (2) Where a residential area entrusts a property service enterprise or a specialized institution to be responsible for the management of environmental health, such entrusted property service enterprise or specialized institution shall serve as the manager of the disposal of household waste in a sorted manner; where the owners themselves are responsible for the management of environmental health, the owners' committee shall serve as the manager responsible for disposal of household waste in a sorted manner;

  (3) For roads, squares, parks, beaches, public green space and other public places, their management agencies or their authorized environmental health management agencies shall serve as the manager responsible for disposal of household waste in a sorted manner;

  (4) For stations, airports, jetties and other public places for tourism, culture, sports, entertainment and commerce, their operation and management entities or their authorized environmental health management entities shall serve as the manager responsible for disposal of household waste in a sorted manner.

  If the manager cannot be identified according to the preceding paragraph, the local subdistrict office shall determine the manager responsible for disposal of household waste in a sorted manner.

  Article 20 The manager responsible for disposal of household waste in a sorted manner shall perform the following duties:

  (1) Setting up disposal stations and collection containers according to the allocation specifications for household waste sorting facilities and equipment, and keeping them in good conditions and clean;

  (2) Discouraging the acts that do not conform with the requirements of the disposal, and timely reporting to the district competent department or subdistrict office for handling according to the law if any party fails to make corrections;

  (3) Cooperating with the municipal and district competent departments and subdistrict offices in carrying out publicity and guidance on household waste sorting;

  (4) Timely transferring sorted household waste to corresponding collection and transportation entities;

  (4) Establishing the management ledger for sorted household waste to record the category, volumn, whereabouts and other things of household waste, and submitting to local subdistrict office according to relevant requirements;

  Where a manager responsible for disposal of sorted household waste performs duties in accordance with the provisions, relevant entities and individuals shall provide cooperation.

  Article 21 An organizer of a large public event shall, in conjunction with the local manager responsible for the disposal of sorted household waste, develop a plan for the disposal, collection and transportation of household waste in a sorted manner generated from the event, effectively inform and guide the disposal of household waste in a sorted manner, and reasonably arrange the collection and transportation of sorted household waste.

  Article 22 The manager responsible for the disposal of household waste in sorted manner in a residential area shall reasonably determine the number of the disposal stations of household waste according to the coverage of the residential area to collectively allocate collection containers of recyclables, household kitchen waste and other waste, and determine the disposal stations of waste furniture, electrical and electronic products, and new year flowers and plants based on the characteristics and fire control safety specifications in the area. Collection containers for hazardous waste and waste fabric in a residential area may be separately allocated.

  Disputes over the determination of disposal stations of household waste in a residential area may be submitted to the local subdistrict office for settlement.

  Article 23 No household waste collection container shall be allocated         in any public space on residential floors in a residential area; no containers used for waste collection in any public space (including underground public space) of a residential area shall be allocated, except those that conform to the allocation specifications for household waste sorting facilities and equipment.

  Article 24 Collection containers for recyclables, hazardous waste and other waste shall be allocated in production and operation areas and office areas, while collection containers for recyclables and other waste shall be allocated           in other public places.

  In addition to the provisions of the preceding paragraph, collection containers for kitchen waste shall be allocated in centralized dining entities, while collection containers for other kitchen waste shall be allocated in agricultural product wholesale markets, farmer's markets, large supermarkets, etc.

Chapter Three Collection, Transportation and Treatment in a Sorted Manner

  Article 25 Household waste disposed of in a sorted manner shall also be collected, transported and treated in a sorted manner rather than in a mixed manner in accordance with the provisions.

  Article 26 The municipal and district people's governments shall, according to relevant technical standards and specifications, coordinate the construction of centralized transfer and disposal facilities commensurate with the management of household waste sorting.

  Article 27 The district competent departments and subdistrict offices shall sign with the household waste transportation entity an agreement on transportation operations, which shall set forth the operating period, service scope, service standards, prices, requirements for transportation in a sorted manner, withdrawal mechanism, liability for breach of contract, among others.

  Article 28 The manager responsible for the disposal of sorted household waste shall notify relevant entities or individuals of door-to-door collection of recyclables thrown into collection containers or designated disposal stations.

  Household kitchen waste, restaurant kitchen waste and other waste shall be collected and transported on a daily basis. Among them, household food waste shall be deposited in an airtight way immediately once the designated disposal time ends, and be cleared away within 12 hours.

  Hazardous waste shall be collected and transported to storage stations that conform to national standards according to relevant laws and regulations.

  Article 29 The municipal and district competent departments shall, in conjunction with relevant departments, reasonably arrange the operating hours and routes of household waste transport vehicles to avoid traffic congestion and noise nuisance.

  Article 30 Entities and individuals of household waste collection and transportation shall implement the relevant technical specifications and operating procedures, and comply with the following provisions:

  (1) They shall be equipped with appropriate transport vehicles, safety equipment and operating personnel according to the category, volumn, operating hours and other requirements for household waste;

  (2) Transport vehicles shall be maintained in an airtight and clean condition, and with sorting markings sprayed;

  (3) Positioning and monitoring systems shall be installed for transport vehicles, and such systems shall be networked with the management information platform for household waste sorting;

  (4) Household waste in a sorted manner shall be collected abd transported according to the specified time, frequency, route and requirements;

  (5) Contact phone number shall be published, a management ledger shall be established to record the source, category, volumn, whereabouts and other information of household waste, and such information shall be regularly reported to the district competent departments;

  (6) Sorted household waste shall be safely collected and transported according to law, an emergency response plan shall be developed and filed with the district competent departments for record.

  Article 31 The treatment of recyclables shall comply with the following provisions:

  (1) Waste glass, metal, plastics and paper shall be recycled by recycling entities;

  (2) Waste fabric shall be reused or recycled by recycling entities or by fabric producers and sellers engaged in recycling;

  (3) Waste furniture shall be recycled based on the components and properties of disassembled parts;

  (4) Waste electrical and electronic products shall be recycled or treated harmlessly by qualified entities.

  Article 32 The municipal commerce department shall, in conjunction with the competent municipal department, develop the recycling guide directory for recyclables and recycling support policies for low-value recyclables, for the purpose of promoting the recycling of low-value recyclables.

  The municipal and district commerce departments shall provide citizens with appointment-based recycling services as well as information including directory and recycling method for recyclables through the management information platform for household waste sorting.

  Article 33 Recycling entities of renewable resources shall be encouraged to set up convenient recycling stations or recycling facilities in residential areas, shopping malls, supermarkets, convenience stores, etc., and establish a platform for appointment-based recycling services, and publicize the transaction catalog and prices, for the purpose of raising the recycling rate of recyclables through such methods as fixed-point recycling and door-to-door recycling.

  Production and operation entities shall be encouraged to recycle related waste items and packages in appropriate ways.

  Article 34 Kitchen waste shall be treated primarily by biochemical means including but not limited to methane and fertilizer production.

  Agricultural product wholesale markets, farmer's markets, large supermarkets, canteens, catering entities and qualified residential areas shall be encouraged to install kitchen waste disposal facilities that meet the standards for in-situ treatment.

  Article 35 Kitchen waste that cannot be applied to in situ treatment shall be collected, transported and treated in full volumn by kitchen waste franchised operators.

  Any entity or individual without franchising shall not carry out collection, transportation and treatment of kitchen waste.

  Article 36 Hazardous waste shall be stored collectively in hazardous waste storage stations for regular recycling or harmless treatment by an enterprise with    a business permit.

  The municipal ecological environment department shall promote the improvement of the treatment capabilities and enhance supervision and guidance over treatment of hazardous waste.

  Article Discarded new year flowers and plants shall be transplanted and cultivated according to their characteristics; those without transplantation value or being unable to be transplanted shall be treated as discarded ordinary flowers and plants.

  Article 38 Greening waste disposal entities shall take advantage of tree branches and leaves through composting or biofuel production after crushing procedures, while large trunks with use value may be recycled directly after removal of branches and leaves.

  Article 39 Household waste disposal entities shall strictly implement the relevant technical specifications and operating procedures, and comply with the following provisions:

  (1) They shall be equipped themselves with appropriate disposal facilities and devices, safety equipment and operating personnel according to category, volumn of household waste, operating hours and other requirements for household waste treatment, and carry out treatment of the received sorted household waste in a sorted manner;

  (2) Treatment measurement and monitoring systems for household waste and networking with the management information platform for household waste sorting shall be installed;

  (3) A management ledger shall be established to record the category and volumn of household waste received and treated as well as quality inspection report and whereabouts after sales of recycled products, and the ledger information shall be regularly submitted to district competent departments as required;

  (4) Business shall not be suspended or closed in violation of the provisions or agreements, unless a written report on applying for suspension or closure of business has been submitted to and approved by the district competent departments in accordance with the provisions or agreements;

  (5) Name, method, concentration and total volume of main pollutants discharged as well as the operating status of household waste disposal facilities shall be regularly disclosed to the public;

  (6) Laws and regulations with regard to production safety management shall be complied with, safe treatment of sorted household waste shall be conducted, and an emergency response plan shall be developed and submittd to the district competent departments for record filing.

  Household waste disposal entities shall be encouraged to study, develop and update recycling and harmless treatment techniques.

  Article 40 An entity or individual that carries out collection, transportation and treatment of household waste in a sorted manner may, upon discovering that any received household waste does not conform to the sorting standards, require the manager responsible for disposal of household waste in a sorted manner or collection and transport entities to conduct sorting again, otherwise, it may refuse to collect, transport and treat the waste and make a report to the municipal and district competent departments.

  The manager responsible for disposal of sorted household waste may, upon discovering that the household waste collection and transportation entity or individual violates any provisions of collection and transportation in a sorted manner, require it to carry out collection and transportation in a sorted manner again, otherwise, it may make a report to the district competent departments.

  The district competent departments shall, upon receiving a report on incompliance on disposal, collection, transportation or treatment of household waste in a sorted manner, handle the matter within 24 hours according to law.

  Chapter Four Source Reduction and Recycling

  Article 41 A mechanism of household waste source reduction from such processes as production, circulation and consumption shall be established to encourage entities and individuals to reduce the generation of household waste in production and livelihoods, thus promoting resource conservation.

  Entities and individuals shall be encouraged to promote the reuse of idle items through online and offline transactions.

  Article 42 State organs, public institutions and mass organizations shall play a demonstration role in household waste source reduction. In government procurement, priority shall be given to the procurement of office supplies that can be reutilized or recycled, and disposable cups shall not be procured for use in internal office areas. Disposable tableware shall not be provided for centralized dining.

  Enterprises and social organizations shall be encouraged to use office supplies that can be reutilized or recycled, and to reduce the use of disposable cups.

  Recycled kitchen waste products shall be preferentially used in the soil improvement in public green spaces and public benefit forests.

  The market regulation department shall, in conjunction with the commerce department, promote the marketing of clean vegetables in fruit and vegetable production bases, agricultural product wholesale markets, farmer's markets, shopping malls, supermarkets, etc.

  Article 43 Producers and operators shall strictly observe the national standards and requirements for restricting excessive packaging, and recover the products and packages listed in the national catalog of compulsory recycling.

  Producers and operators shall, according to the extended producer responsibility system according to relevant national regulations, assume the responsibility for recovery and disposal of waste products and their packages.

  Article 44 Third-party platforms for online trading as well as enterprises including but not limited to cargo transport service providers, express delivery enterprises shall be encouraged and guided to explore the establishment of a recycling and utilization system based on cooperative reverse logistics to facilitate the recovery and recycling of packages.

  Third-party platforms for online trading shall be encouraged to simplify packages and reduce the utilization of disposables.

  Article 45 Retailers shall not provide consumers with plastic shopping bags free of charge.

  Hotel operators shall not voluntarily provide consumers with disposable daily necessities.

  Article 46 Catering service providers and catering delivery service providers shall advise consumers to make reasonable consumption and order food appropriately, and shall not provide disposable chopsticks, spoons and other tableware for consumers free of charge. The use of tableware that can be cleaned, disinfected and reused in catering delivery services and the provision of recovery services shall be encouraged.

  The reduction of waste packages, food residues and other household waste generated from take-out food shall be supported.

  Recyclable tableware shall be encouraged to be used for centralized dining in a mass event.

Chapter Five Publicity, Education and Social Participation

  Article 47 The municipal and district culture, radio, film, television, tourism and sports departments shall, in conjunction with the municipal and district competent departments, carry out publicity and education campaigns on household waste sorting to foster the habit of waste sorting and improve the level of urban civilization.

  The municipal committee office of social construction of ideological infrastructure shall incorporate the work related to household waste sorting into indexes of the evaluation index system of public civilization.

  Article 48 The municipal education department shall incorporate the knowledge on household waste sorting into the educational programs of kindergartens and primary and secondary schools.

  Article 49 The municipal and district competent departments shall establish and make available to the public for free the publicity and education bases and experience facilities for household waste sorting according to the actual circumstances.

  The municipal and district culture, radio, film, television, tourism and sports departments shall strengthen promotion and supervision of household waste sorting in tourist attractions, hotels and tourism activities, organize industry associations to carry out training in household waste sorting knowledge for tour guides, and urge tourism enterprises to incorporate the household waste sorting guidance for tourists into the tour guide assessment content.

  Article 50 State organs, enterprises, public institutions, and mass organizations shall carry out publicity and education on household waste sorting within the scope of their responsibilities and business scope to promote the society-wide participation in household waste sorting activities.

  Industry associations of renewable resources, property management, environmental health, environmental protection, e-commerce, express, hotel, restaurant, tourism, and domestic services shall formulate industry self-disciplines, carry out industry training, guidance and evaluation on household waste sorting, and guide and urge their members to effectively carry out household waste sorting.

  Relevant requirements for household waste disposal and collection in a sorted manner shall be incorporated into the management stipulations and the property service contracts of the property management areas.

  Article 51 Radio, television, newspapers, the Internet and other media agencies shall carry out public-interest publicity of the management of household waste sorting, and strengthen public opinion supervision on violations of management regulations for household waste sorting.

  Operation and management entities of parks, stations, airports, jetties and other public places for tourism, culture, sports, entertainment and commerce shall carry out publicity of household waste sorting under the guidance of the municipal and district competent departments.

  Article 52 November 8 shall be determined as Waste Reduction Day. A simple, moderate, green and low-carbon lifestyle shall be advocated to reduce household waste at source.

  The competent municipal and district departments shall organize publicity and education on waste reduction on the Waste Reduction Day, and guide entities and individuals to participate in waste reduction experience activities by appropriate means.

  Article 53 Social capital shall be encouraged and guided to participate in the collection, transportation, treatment and other activities of household waste sorting.

  Article 54 The municipal and district competent departments and subdistrict offices may arrange for volunteers or professionals to participate in household waste sorting activities including but not limited to publicity, guidance, supervision, and services by recruiting volunteers, service procurement, and other means.

  Article 55 A supervisor system for disposal of household waste in a sorted manner shall be established.

  The competent municipal department shall develop work specifications for supervisors, and the district competent departments and subdistrict offices shall organize property service enterprises and volunteer organizations to designate employees of property service enterprises, volunteers, residents in residential areas as supervisors as needed for guiding residents to dispose of household waste in a sorted manner as required. Where property service enterprises are organized to designate supervisors, the approach of service procurement may apply.

  Article 56 The municipal and district people's governments shall establish an incentive mechanism for household waste sorting, improve the assessment and evaluation system, and commend or reward the entities, households or individuals with outstanding contribution in accordance with relevant provisions.

Chapter Six Supervision and Administration

  Article 57 The municipal and district competent departments shall establish and improve the supervisory inspection system for household waste sorting management to strengthen supervisory inspection over activities related to household waste sorting conducted by obligors of the disposal of household waste in a sorted manner, managers responsible for the disposal of household waste in a sorted manner, and entities or individuals engaged in the collection, transportation and treatment of household waste in a sorted manner.

  Article 58 The competent municipal department shall investigate the composition, volume, etc. of household waste, assess household waste sorting, and publish the relevant investigation results and evaluation reports to the public.

  The district competent departments, subdistrict offices and relevant entities shall, as required, timely and accurately collect whole-process waste sorting information, and upload such information to the management information platform for household waste sorting.

  The district competent departments shall develop an emergency response plan for collection, transportation and disposal of household waste in a sorted manner within their respective jurisdictions to improve the prevention and response capabilities of household waste emergencies.

  Article 59 The municipal and district ecology and environment departments shall monitor the release of wastewater, waste gas, waste residue, noise and other pollutants from facilities related to centralized transfer and treatment of household waste, and publish the monitoring information to the public as required.

  Article 60 The municipal housing and construction department shall incorporate the requirements for household waste sorting into the template of property service contract and the green property management evaluation system, and incorporate the information related to administrative penalties on property service enterprises due to violation of the administrative provisions on household waste sorting into the credit information archives of property service enterprises.

  Article 61 Entities and individuals shall have the right to discourage, complain about and report violations of the administrative provisions on household waste sorting. The municipal and district competent departments shall publish their hotlines and online channels for complaints and reporting.

  Article 62 A social supervisor system for household waste sorting management shall be established.

  The municipal and district competent departments may engage social supervisors from the public-spirited volunteers to carry out the supervision and administration over household waste sorting.

  Social supervisors shall have the right to supervise the implementation of the disposal, collection, transportation and treatment of household waste in a sorted manner in residential areas, schools, offices and places related to production and operation, and put forward opinions and suggestions on the administration of household waste sorting.

  Relevant entities and individuals shall cooperate in the supervision and inspection by social supervisors. Social supervisors shall not disclose the business secrets or know-how obtained in the course of supervision and inspection.

  Where social supervisors report to the municipal and district competent departments the problems found in household waste sorting, the municipal and district competent departments shall timely handle them and give feedback according to law.

  Article 63 The competent municipal department shall establish the credit information archives for entities engaged in collection, transportation and disposal of household waste in a sorted manner to record the illegal and non-compliance acts, their handling results, and other information.

  Article 64 Relevant departments and industry associations shall incorporate the performance in household waste sorting into the requirements for assessment of civilized entities, civilized subdistricts, civilized communities, civilized families, etc.

Chapter Seven Legal Liability

  Article 65 If a relevant department of the municipal or district people's government, or a household waste sorting management service institution and their staff, in violation of the provisions hereof, commit any of the following acts, the entity or its superior shall be ordered to make corrections; if no correction is made within the prescribed time limit, the directly liable person in charge and other directly liable person shall be given punishment in accordance with the law:

  (1) Failing to perform the guidance, supervision and administration responsibility of household waste sorting as required;

  (2) Failing to build and maintain disposal facilities for household waste as required;

  (3) Failing to investigate and deal with the received relevant reports, complaints or reported information;

  (4) Other acts of negligence, abuse of power, or malpractice for personal gains.

  Article 66 If an obligator of disposal of household waste in a sorted manner, in violation of Article 17 hereof, fails to dispose of household waste in accordance with the provisions, the competent department shall order the violator to make corrections; if no correction is made, a fine of 50 yuan shall be imposed to the violator as an individual or 50,000 yuan to the violator as an entity; if the circumstance is severe, a fine of 200 yuan shall be imposed to the violator as an individual or not less than 50,000 yuan but not more than 500,000 yuan to the entity.

  An individual who shall be punished in accordance with the preceding paragraph not under a severe circumstance and voluntarily participates in household waste sorting activities including but not limited to training, publicity and on-site supervision organized by the municipal and district competent departments shall not be given an administrative penalty.

  Article 67 A manager responsible for the disposal of household waste in a sorted  manner, in violation of Article 20 hereof, shall be punished by the district competent departments in accordance with the following provisions:

  (1) In case of failure to allocate disposal stations and collection containers and to keep them in good conditions and clean, the violator shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed to the violator;

  (2) In case of failure to cooperate with the municipal and district competent departments and subdistrict offices in carrying out publicity and guidance on household waste sorting, a fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed to the violator;

  (3) In case of failure to timely transfer sorted household waste to corresponding collection and transportation entities, a fine of not less than 5,000 yuan but not more than 10,000 yuan shall be imposed;

  (4) In case of failure to establish the management ledger for sorted household waste to record the category, volumn, whereabouts and other things of household waste, or failure to submit the ledger to local subdistrict office according to relevant requirements, it shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed;

  Where, in violation of Article 23 hereof, household waste collection container is allocated in any public space on residential floors in a residential area, a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed.

  A manager responsible for the disposal of household waste in a sorted manner who has performed the management responsibility as specified in subparagraphs (1)  of the first paragraph of Article 20 and Article 23 hereof may not be punished, but a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed on the relevant violator by the district competent department.

  Article 68 Where an organizer of a large public event, in violation of Article 21 hereof, fails to effectively advise and guide the disposal of household waste in a sorted manner, or fails to reasonably arrange the collection and transportation of household waste in a sorted manner, the district competent department shall order an immediate rectification, and a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed.

  Article 69 If a household waste collection or transportation entity violates Article 30 hereof, it shall be punished by the district competent department in accordance with the following provisions:

  (1) In case of failure to equip itself with appropriate transport vehicles, safety equipment and operating personnel, it shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed;

  (2) In case of failure to keep transport vehicles airtight, clean, and sprayed with sorting markings, or install positioning and monitoring systems for transport vehicles and network with the management information platform for household waste sorting, it shall be ordered to make corrections within the prescribed time limit; if correction is made within the prescribed time limit, a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed;

  (3) In case of failure to collect and transport household waste in a sorted manner according to the specified time, frequency, route and requirements, it shall be ordered to make corrections within the prescribed time limit and a fine of not less than 5,000 yuan but not more than 50,000 yuan may be imposed;

  (4) In case of collection or transportation of sorted household waste in a mixed way, a fine of 50,000 yuan shall be imposed; if the circumstance is severe, a fine of not less than 50,000 yuan but not more than 500,000 yuan shall be imposed;

  (5) In case of failure to publish collection and transportation phone numbers, or establish a management ledger to record the source, category, volumn, whereabouts and other information of household waste and regularly report to the district competent departments, it shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed;

  (6) In case of failure to collect and transport sorted household waste according to relevant laws and regulations for safety management, or failure to develop an emergency response plan and submit it to the district competent departments for record, it shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 10,000 yuan but not more than 30,000 yuan shall be imposed;

  Article 70 Where, in violation of Article 35 hereof, kitchen waste that cannot be applied to in-situ treatment fails to be collected, transported and disposed of fully by a franchising enterprise, the district competent departments shall order the violator to make corrections within the prescribed time limit and impose a fine of not less than 100,000 yuan but not more than 1,000,000 yuan on the entity or not less than 100 yuan but not more than 500 yaun on the individual; if there is any illegal income, the illegal income shall be confiscated; in case of failure to engage in collecting, transporting and disposing of kitchen waste upon approval, the district competent department shall order the violator to stop the illegal act and impose a fine of not less than 100,000 yuan but not more than 1,000,000 yuan on the violator, and if there is any illegal income, the illegal income shall be confiscated.

  Article 71 If a household waste disposal entity violates Article 39 hereof, the entity shall be punished by the district competent departments in accordance with the following provisions:

  (1) In case of failure to equip itself with appropriate disposal facilities and devices, safety equipment and operating personnel, the house waste disposal entity shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed to the household waste disposal entity;

  (2) In case of disposal of sorted household waste in a mixed way, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be imposed on the house waste disposal entity; if the circumstance is severe, a fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed on the house waste disposal entity; if there is any illegal income from disposal of household waste, the illegal income shall be confiscated;

  (3) In case of failure to install household waste disposal measurement and monitoring systems, and network with the management information platform for household waste sorting, the house waste disposal entity shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of 30,000 shall be imposed to the house waste disposal entity;

  (4) In case of failure to establish the management ledger or submit it as required, the house waste disposal entity shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed to the house waste disposal entity;

  (4) In case of stopping the disposal of sorted household waste without authorization, a fine of 100,000 yuan but not more than 1,000,000 yuan shall be imposed to the house waste disposal entity;

  (6) In case of failure to regularly disclose the name, method, concentration and total volume of main pollutants discharged as well as the operation of household waste disposal facilities to the public, the house waste disposal entity shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 100,000 yuan but not more than 200,000 yuan shall be imposed to the house waste disposal entity;

  (7) In case of failure to dispose of sorted household waste according to relevant laws and regulations for safety management, or failure to develop an emergency response plan and submit it to the municipal and district competent departments for record filing, the house waste disposal entity shall be ordered to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 10,000 but not more than 50,000 shall be imposed to the house waste disposal entity.

  Article 72 Where a retailer, in violation of the first paragraph of Article 45 hereof, provides consumers with free plastic shopping bags, the market regulation department shall order the retailer to make corrections; if no correction is made within the prescribed time limit, a fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed the retailer.

  Where a hotel operator, in violation of the second paragraph of Article 45 hereof, voluntarily provides consumers with disposable daily necessities, the market regulation department shall order the hotel operator to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed to the hotel operator.

  Where a catering service provider or catering delivery service provider, in violation of the first paragraph of Article 46 hereof, provides disposable chopsticks, spoons and other tableware for consumers free of charge, the market regulation department shall order the catering service provider or catering delivery service provider to make corrections within the prescribed time limit; if no correction is made within the prescribed time limit, a fine of not less than 1,000 yuan but not more than 5,000 yuan shall be imposed to the catering service provider or catering delivery service provider.

  In case of provision of disposable plastic products prohibited or restricted by the State as mentioned in the first three paragraphs of this article, punishment shall be imposed by the market regulation department in accordance with the Law of the People's Republic of China on the Prevention and Control of Environment Pollution Caused by Solid Wastes.

  Article 73 Where an entity or individual fraudulently obtains fiscal subsidies or incentives, the municipal and district competent departments shall recover the funds fraudulently obtained, and impose a fine five times the amount of the funds fraudulently obtained on the entity or individual; if the violation is criminally punishable, the violator shall be held criminally liable in accordance with the law.

Chapter Eight Supplementary Provisions

  Article 74 The terms used in these Regulations bear the meanings set out below:

  (1) Household chemicals refer to the waste drugs and pharmaceutical instruments and their packages, insecticides, disinfectants and their packages, paints, solvents and their packages, etc. generated by residents in their daily lives.

  (2) Household kitchen waste refers to putrescible waste that is discharged in family life by residents, including vegetable stem and leaves, fruit peels and cores, leftovers, discarded food, etc.

  (3) Restaurant kitchen waste refers to food residue, food processing waste, expired food, waste cooking fat and oil, etc., originated in activities including but not limited to food processing, catering services, and entity dining.

  (4) Other kitchen waste refers to perishable waste including vegetables and fruits, rotting meat, meat bones, aquatic products, and livestock and poultry offal generated in agricultural product wholesale markets, farmer's markets, large supermarkets, etc.

  Article 75 These Regulations shall come into force on September 1, 2020.

深圳市生活垃圾分类管理条例

(2019年12月31日深圳市第六届人民代表大会常务委员会第三十七次会议通过  2020年6月23日广东省第十三届人民代表大会常务委员会第二十一次会议批准)  

第一章 

  第一条  为了加强生活垃圾分类管理,提高生活垃圾减量化、资源化、无害化水平,改善居民生活环境,提升城市文明水平,根据有关法律、法规的规定,结合深圳市实际,制定本条例。  

  第二条  深圳市生活垃圾分类投放、分类收集、分类运输、分类处理、源头减量及其相关管理活动适用本条例。  

  第三条  本条例所称生活垃圾,是指在日常生活中或者为日常生活提供服务的活动中产生的固体废物以及依照法律、法规规定视为生活垃圾的固体废物。  

  房屋装饰装修产生的建筑废弃物按照《深圳市建筑废弃物减排与利用条例》和本市其他相关规定处理。  

  第四条  生活垃圾分类管理工作遵循政府推动、全民参与、制度约束、习惯养成、系统推进、循序渐进的原则。  

  第五条  市人民政府应当将生活垃圾分类管理工作纳入国民经济和社会发展规划,确定生活垃圾分类管理工作目标,加强生活垃圾分类宣传、教育、培训、行政执法和经费保障,完善生活垃圾分类管理工作机制。  

  第六条  区人民政府负责组织实施辖区内生活垃圾分类管理工作,落实生活垃圾分类管理工作目标,提供相应保障。  

  街道办事处负责辖区内生活垃圾分类管理工作。  

  社区居民委员会应当协助区人民政府和街道办事处做好生活垃圾分类的宣传、引导工作。鼓励将生活垃圾分类投放要求纳入居民公约。  

  第七条  市城市管理和综合执法部门(以下简称市主管部门)是市生活垃圾分类管理工作主管部门,负责拟订或者制定生活垃圾分类管理制度并组织实施,承担全市生活垃圾分类统筹协调和监督管理工作。  

  区城市管理和综合执法部门(以下简称区主管部门)负责辖区内生活垃圾分类管理工作。  

  市、区发展改革、规划和自然资源、生态环境、住房建设、教育、商务、文化广电旅游体育、市场监管等部门在各自职责范围内依法做好生活垃圾分类管理相关工作。  

  第八条  市主管部门应当组织编制本市生活垃圾分类发展规划,明确工作目标、任务安排和保障措施等内容,并将生活垃圾分类转运、回收利用和处理设施布局纳入本市环境卫生设施规划,经市人民政府批准后组织实施。  

  第九条  市、区规划和自然资源部门应当将生活垃圾分类投放、分类收集、分类运输、分类处理的设施建设纳入建设项目公共服务设施配套建设要求,将相关基础设施建设所需土地纳入土地供应计划。  

  新建、改建、扩建建设项目应当按照标准配套建设生活垃圾分类设施。配套建设的生活垃圾分类设施应当与主体工程同步设计、同步施工、同步验收、同步使用。  

  第十条  市生活垃圾分类管理事务中心是政府设立从事生活垃圾分类管理服务工作的专门机构,履行下列职责:  

  (一)参与拟订全市生活垃圾分类发展规划、工作计划,研究拟订生活垃圾分类目录、相关标准和技术规范;  

  (二)参与全市生活垃圾分类指导、监督、考核、评价相关工作;  

  (三)组织开展生活垃圾分类管理相关业务培训;  

  (四)编制生活垃圾分类管理宣传教育资料,开展宣传推广活动,普及生活垃圾分类相关知识;  

  (五)推动生活垃圾分类收集、运输、处理技术研究和应用工作,探索生活垃圾使用专用垃圾袋投放;  

  (六)组织、指导生活垃圾减量分类试点、示范点建设、达标创建和推广实施工作;  

  (七)承办市主管部门交办的其他相关工作。  

  第十一条  单位和个人应当按照规定分类投放生活垃圾,缴纳生活垃圾处理费,减少生活垃圾产生量。  

  市人民政府应当按照谁产生谁付费和差别化收费的原则,完善生活垃圾处理收费制度,逐步实行分类计价、计量收费。  

  第十二条  鼓励开展生活垃圾分类技术创新,支持垃圾分类先进设备、工艺的研究应用,实现生活垃圾分类管理智能化、专业化、信息化。  

  市、区主管部门可以使用智能化信息系统收集生活垃圾分类管理相关信息,采集相应证据。  

第二章分类投放 

  第十三条  生活垃圾分为可回收物、厨余垃圾、有害垃圾、其他垃圾,具体按照下列要求分类:  

  (一)可回收物,是指适宜回收和资源化利用的垃圾,包括废弃的玻璃、金属、塑料、纸类、织物、家具、电器电子产品等;  

  (二)厨余垃圾,是指容易腐烂的食物残渣、瓜皮果核等含有有机质的垃圾,包括家庭厨余垃圾、餐厨垃圾、其他厨余垃圾等;  

  (三)有害垃圾,是指对人体健康或者自然环境造成直接或者潜在危害且应当进行专门处理的垃圾,包括电池、灯管、家用化学品等;  

  (四)其他垃圾,是指除可回收物、厨余垃圾、有害垃圾以外的其他生活垃圾。  

  第十四条  市主管部门应当会同市生态环境、商务等部门,根据经济社会发展水平、生活垃圾的特性以及处理利用方式制定生活垃圾分类目录,适时补充细化相关要求,并向社会公布。  

  第十五条  市主管部门应当制定生活垃圾分类相关设施设备配置规范,并向社会公布。  

  生活垃圾分类收集容器的颜色、分类标志和相关提示标识应当统一规范、清晰醒目、易于辨识。  

  区主管部门可以根据本辖区不同区域实际情况细化生活垃圾分类收集容器种类,合理规范收集容器设置数量。   

  区主管部门应当指导街道办事处探索提供便利化的生活垃圾分类投放服务。  

  第十六条  产生生活垃圾的单位和个人为生活垃圾分类投放义务人,应当将生活垃圾分类投放至相应的收集容器或者指定的投放点。  

  第十七条  生活垃圾应当按照下列规定分类投放:  

  (一)可回收物中废弃的家具、电器电子产品应当投放至指定投放点,其他可回收物应当投放至可回收物收集容器,可回收物也可以交由回收单位或者个人回收;  

  (二)家庭厨余垃圾应当沥除油水,在指定时间段投放至专用收集容器,使用一次性收纳袋装纳的,应当将收纳袋另行投放至其他垃圾收集容器;  

  (三)不能就地处理的餐厨垃圾,应当沥除油水后投放至餐厨垃圾专用收集容器;  

  (四)农产品批发市场、农贸市场、大型超市等场所产生的其他厨余垃圾应当单独投放;  

  (五)有害垃圾应当按照收集容器的标识分类投放,其中废弃药品药具应当对包装物予以毁形或者进行破坏性标记后投放至相应的收集容器;  

  (六)废弃的年花年桔应当按照区主管部门公布的时间段,投放至指定的年花年桔投放点,也可以由回收单位、个人上门收集;  

  (七)日常废弃的花卉绿植应当按照花盆、植物和泥土等成分进行分离并分别投放至可回收物、厨余垃圾和其他垃圾收集容器,也可以投放至指定的投放点或者由回收单位、个人上门收集;  

  (八)公园、市政道路、住宅区等因修剪树木产生的木竹、树枝、花草、落叶等绿化垃圾应当单独投放。  

  市、区主管部门应当公布废弃的家具、电器电子产品、年花年桔和其他花卉绿植收集单位的名单、联系方式和收费标准。  

  第十八条  建立生活垃圾定时定点投放制度。  

  区主管部门根据生活垃圾定时定点投放制度和本行政区域实际情况,确定生活垃圾具体投放时间段。其中,家庭厨余垃圾每日投放时间段原则上不少于两个。  

  第十九条  实行生活垃圾分类投放管理人制度。生活垃圾分类投放管理人按照下列规定确定:  

  (一)国家机关、企业事业单位、群团组织以及其他社会组织委托物业服务企业或者专业机构负责办公和生产经营场所环境卫生管理的,受委托的物业服务企业或者专业机构为生活垃圾分类投放管理人,自行负责办公和生产经营场所环境卫生管理的,自行管理的单位为生活垃圾分类投放管理人;  

  (二)住宅区委托物业服务企业或者专业机构负责环境卫生管理的,受委托的物业服务企业或者专业机构为生活垃圾分类投放管理人,业主自行管理环境卫生的,业主委员会为生活垃圾分类投放管理人;  

  (三)道路、广场、公园、沙滩、公共绿地等公共场所管理单位或者其委托的环境卫生管理单位为生活垃圾分类投放管理人;  

  (四)车站、机场、码头以及旅游、文化、体育、娱乐、商业等公共场所经营管理单位或者其委托的环境卫生管理单位为生活垃圾分类投放管理人。  

  按照前款规定无法确定生活垃圾分类投放管理人的,由所在地街道办事处确定生活垃圾分类投放管理人。  

  第二十条  生活垃圾分类投放管理人应当履行下列职责:  

  (一)按照生活垃圾分类设施设备设置规范设置分类投放点,配置分类收集容器,并保持投放点和收集容器完好、整洁;  

  (二)对不符合分类投放要求的投放行为予以劝阻,投放人拒不改正的,应当及时报告区主管部门或者街道办事处依法处理;  

  (三)配合市、区主管部门和街道办事处开展生活垃圾分类宣传、引导;  

  (四)及时将生活垃圾分类移交给相应的收集、运输单位;  

  (五)建立生活垃圾分类管理台账,记录生活垃圾种类、数量、去向等情况,并按照有关要求报送街道办事处。  

  生活垃圾分类投放管理人按照规定履行职责的,有关单位和个人应当予以配合。  

  第二十一条  大型群众性活动承办者应当会同活动场所生活垃圾分类投放管理人制定因活动产生的生活垃圾分类投放、收集、运输方案,做好生活垃圾分类投放提示和引导,合理安排生活垃圾分类收集、运输。  

  第二十二条  住宅区生活垃圾分类投放管理人应当根据住宅区规模合理确定生活垃圾分类投放点的数量,集中设置可回收物、家庭厨余垃圾和其他垃圾收集容器,并结合区域特点和消防安全规范确定废弃的家具、电器电子产品和年花年桔投放点。住宅区有害垃圾、废旧织物收集容器可以单独设置。  

  因确定住宅区生活垃圾分类投放点发生争议的,可以提请所在地街道办事处协调解决。  

  第二十三条  住宅区居住楼层公共区域不得设置生活垃圾收集容器;除符合生活垃圾分类设施设备设置规范的收集容器外,住宅区公共区域(含地下公共空间)不得设置其他用于收集垃圾的容器。  

  第二十四条  生产经营区、办公区应当设置可回收物、有害垃圾和其他垃圾收集容器,其他公共场所应当结合区域特点合理设置可回收物和其他垃圾收集容器。  

  除前款规定外,集中用餐单位应当设置餐厨垃圾专用收集容器,农产品批发市场、农贸市场、大型超市等场所应当设置其他厨余垃圾专用收集容器。  

第三章分类收集、运输和处理 

  第二十五条  分类投放的生活垃圾应当按照规定分类收集、分类运输、分类处理,不得混合收集、运输、处理。  

  第二十六条  市、区人民政府应当按照有关技术标准、规范,统筹组织建设与生活垃圾分类管理相适应的集中转运、处理设施。  

  第二十七条  区主管部门、街道办事处应当与从事生活垃圾运输的单位签订运输经营协议,约定经营期限、服务范围、服务标准、价格、分类运输要求以及退出机制、违约责任等事项。  

  第二十八条  已投放至收集容器或者指定投放点的可回收物,由生活垃圾分类投放管理人通知相关回收单位或者个人上门回收。  

  家庭厨余垃圾、餐厨垃圾和其他垃圾应当每日定时收集、运输。其中,家庭厨余垃圾应当在指定投放时间段结束后立即密闭存放,并在十二小时内清运。  

  有害垃圾应当按照相关法律、法规的规定进行收集,并运输至符合国家标准的贮存点。  

  第二十九条  市、区主管部门应当会同相关部门合理安排生活垃圾运输车辆的作业时间和路线,避免交通拥堵和噪声扰民。  

  第三十条  生活垃圾收集、运输单位或者个人应当执行相关技术规范和操作规程,并遵守下列规定:  

  (一)根据生活垃圾的种类、数量、作业时间等要求,配备相应的运输车辆、安全设备和作业人员;  

  (二)保持运输车辆密闭、整洁,并喷涂分类标识;  

  (三)为运输车辆安装定位和监控系统,并与生活垃圾分类管理信息平台联网;  

  (四)按照规定的时间、频次、路线和要求分类收集、运输生活垃圾;  

  (五)公开联系电话,建立管理台账,记录生活垃圾来源、种类、数量、去向等情况,并定期向区主管部门报告;  

  (六)依法安全收集、运输已分类的生活垃圾,制定应急预案并向区主管部门备案。  

  第三十一条  可回收物处理应当遵守下列规定:  

  (一)废弃的玻璃、金属、塑料、纸类交由再生资源回收单位进行资源化利用;  

  (二)废旧织物交由再生资源回收单位或者实施回收利用的织物生产者、销售者进行再使用或者资源化利用;  

  (三)废旧家具拆解后按照拆解物的成分、属性分类进行资源化利用;  

  (四)废弃电器电子产品交由具备处理资质的单位进行资源化利用或者无害化处理。  

  第三十二条  市商务部门应当会同市主管部门编制可回收物回收指导目录,制定低价值可回收物回收扶持政策,促进低价值可回收物的回收利用。  

  市、区商务部门应当通过生活垃圾分类管理信息平台向市民提供预约回收服务以及可回收物目录、回收方式等信息。  

  第三十三条  鼓励再生资源回收单位在住宅区、商场、超市、便利店等设置便民回收点或者回收设施,建立预约回收平台,公开交易目录以及价格,通过定点回收和上门回收等方式,提高可回收物的回收率。  

  鼓励生产经营单位采用适当方式回收相关废弃物品及包装物。  

  第三十四条  厨余垃圾应当主要采用产沼、制肥等生化处理方式进行资源化利用。  

  鼓励农产品批发市场、农贸市场、大型超市、食堂、餐饮单位以及有条件的住宅区安装符合标准的厨余垃圾处理装置,进行就地处理。  

  第三十五条  不能就地处理的餐厨垃圾应当全量交由餐厨垃圾特许经营企业收集、运输、处理。  

  未取得特许经营权的单位或者个人不得收集、运输、处理餐厨垃圾。  

  第三十六条  有害垃圾应当集中存放至有害垃圾贮存点,定期交由取得经营许可证的企业进行资源化利用或者无害化处理。  

  市生态环境部门应当推动提高属于危险废物的有害垃圾处理能力,并加强上述危险废物处理的监督指导。  

  第三十七条  废弃的年花年桔应当根据植物特性移植栽培;没有移植价值或者无法移植的,作为日常废弃的花卉绿植处理。  

  第三十八条  绿化垃圾处理单位应当将绿化垃圾枝叶粉碎后通过堆肥或者作为生物质燃料等方式资源化利用,有使用价值的较大树干可以在除去枝叶后直接进行资源化利用。  

  第三十九条  生活垃圾处理单位应当严格执行相关技术规范和操作规程,并遵守下列规定:  

  (一)根据生活垃圾的种类、数量、作业时间等要求,配备相应的处理设施设备、安全设备和作业人员,对接收的已分类的生活垃圾进行分类处理;  

  (二)安装生活垃圾处理计量和监控系统,与生活垃圾分类管理信息平台联网;  

  (三)建立管理台账,记录每日接收、处理生活垃圾的种类、数量,以及资源化利用产品质量检验报告、出厂销售流向等情况,并按照要求向区主管部门报送台账信息;  

  (四)不得违反规定或者约定擅自停业、歇业,确需停业、歇业的,应当按照规定或者约定向区主管部门提交书面报告,依法经核准后方可停业、歇业;  

  (五)定期向社会公开排放的主要污染物名称、排放方式、排放浓度和总量,以及生活垃圾处理设施的运行情况等;  

  (六)遵守安全生产管理相关法律、法规,安全处理已分类的生活垃圾,制定应急预案并向市、区主管部门备案。  

  支持生活垃圾处理单位研究、开发、更新资源化利用和无害化处理技术。  

  第四十条  生活垃圾分类收集、运输、处理单位或者个人发现接收的生活垃圾不符合分类标准的,可以要求生活垃圾分类投放管理人或者收集、运输单位重新分类,未进行重新分类的,可以拒绝收集、运输、处理,并向市、区主管部门报告。  

  生活垃圾分类投放管理人发现生活垃圾收集、运输单位或者个人违反分类收集、运输规定的,可以要求其重新分类收集、运输;拒不改正的,应当向区主管部门报告。  

  区主管部门接到未按照规定分类投放、分类收集、分类运输、分类处理生活垃圾的报告后,应当在二十四小时内依法处理。 

  第四章源头减量与循环利用 

  第四十一条  建立生产、流通、消费等环节生活垃圾源头减量机制,鼓励单位和个人在生产、生活中减少产生生活垃圾,促进资源节约。  

  鼓励单位和个人通过线上、线下交易等方式,促进闲置物品再利用。  

  第四十二条  国家机关、事业单位和群团组织应当发挥生活垃圾源头减量示范作用。政府采购应当优先采购可以循环利用或者资源化利用的办公用品,不得采购提供内部办公场所使用的一次性杯具。集中用餐的,不得提供一次性餐具。  

  鼓励企业、社会组织使用可以循环利用或者资源化利用的办公用品,减少使用一次性杯具。  

  公共绿地、公益林的土壤改良应当优先使用厨余垃圾资源化利用产品。  

  市场监管部门应当会同商务部门在果蔬生产基地、农产品批发市场、农贸市场、商场、超市等推行净菜上市。  

  第四十三条  生产经营单位应当严格执行国家限制产品过度包装的标准和要求,对列入国家强制回收目录的产品和包装物按照规定回收。  

  生产经营单位应当按照国家有关规定落实生产者责任延伸制度,承担产品及其包装物废弃后的回收和处理责任。  

  第四十四条  鼓励和引导网络交易第三方平台以及货运、快递等企业探索建立逆向物流协同回收利用体系,促进包装物回收和循环利用。  

  鼓励网络交易第三方平台推动简化包装物和减少一次性用品使用。  

  第四十五条  商品零售经营者不得免费向消费者提供塑料购物袋。  

  旅馆业经营者不得主动向消费者提供客房一次性日用品。  

  第四十六条  餐饮服务和餐饮配送服务提供者应当提示消费者合理消费,适量点餐,不得免费向消费者提供一次性筷子、叉子、汤匙等餐具。鼓励在餐饮配送服务中采用可以清洗消毒、重复使用的餐具,并提供回收服务。  

  支持减少因外卖产生的废弃包装物、食物残渣等生活垃圾。  

  举办大型群众性活动且集中用餐的,鼓励采用可循环餐具。  

第五章宣传教育和社会参与 

  第四十七条  市、区文化广电旅游体育部门应当会同市、区主管部门开展生活垃圾分类宣传教育活动,推动垃圾分类习惯养成,提升城市文明水平。  

  市精神文明建设委员会办公室应当将生活垃圾分类工作纳入公共文明指数测评体系。  

  第四十八条  市教育部门应当将生活垃圾分类知识纳入本市幼儿园、中小学教育内容。  

  第四十九条  市、区主管部门应当根据实际情况建立生活垃圾分类宣传教育基地和体验设施,免费向市民开放。  

  市、区文化广电旅游体育部门应当加强旅游景点、酒店和旅游活动中的生活垃圾分类宣传和督促,组织行业协会对导游进行生活垃圾分类知识培训,督促旅游企业将引导游客分类投放生活垃圾纳入导游带团考核内容。  

  第五十条  国家机关、企业事业单位和群团组织应当结合工作职责或者业务范围开展生活垃圾分类宣传教育,推动全社会共同参与生活垃圾分类活动。  

  再生资源、物业管理、环境卫生、环境保护、电商、快递、酒店、餐饮、旅游、家政服务等行业协会应当制定行业自律规范,开展本行业生活垃圾分类培训、指导和评价工作,引导、督促会员单位做好生活垃圾分类工作。  

  生活垃圾分类投放、收集的相关要求应当纳入物业管理区域管理规约和物业服务合同。  

  第五十一条  广播、电视、报刊、互联网等媒体应当开展生活垃圾分类管理公益宣传,加强对违反生活垃圾分类管理规定行为的舆论监督。  

  公园、车站、机场、码头以及旅游、文化、体育、娱乐、商业等公共场所的经营管理单位,应当在市、区主管部门指导下开展生活垃圾分类宣传。  

  第五十二条  每年11月8日为垃圾减量日。倡导简约适度、绿色低碳生活方式,从源头减少生活垃圾产生。  

  市、区主管部门应当在垃圾减量日组织开展垃圾减量宣传教育,并可以通过适当方式引导单位和个人参与垃圾减量体验活动。  

  第五十三条  鼓励和引导社会资本依法参与生活垃圾分类收集、运输、处理等工作。  

  第五十四条  市、区主管部门和街道办事处可以招募志愿者或者通过购买服务等方式,安排志愿者或者专业人员参与生活垃圾分类宣传、引导、督促和服务等活动。  

  第五十五条  建立生活垃圾分类投放督导员制度。  

  市主管部门应当制定督导员工作规范,由区主管部门和街道办事处组织物业服务企业、志愿者组织等根据需要安排物业服务企业员工、志愿者、住宅区居民等担任督导员,引导居民按照要求分类投放生活垃圾。组织物业服务企业安排督导员的,可以采用购买服务的方式。  

  第五十六条  市、区人民政府应当建立生活垃圾分类激励机制,完善考核评估制度,对成绩突出的单位、家庭或者个人按照有关规定给予表彰或者奖励。  

第六章监督管理

  第五十七条  市、区主管部门应当建立和完善生活垃圾分类管理监督检查制度,加强对生活垃圾分类投放义务人、生活垃圾分类投放管理人和从事生活垃圾分类收集、运输、处理的单位或者个人的生活垃圾分类相关活动的监督检查。  

  第五十八条  市主管部门应当定期对生活垃圾的成分、产生量等进行调查,并对生活垃圾分类情况进行评估,调查结果和评估报告应当向社会公布。  

  各区主管部门、街道办事处以及相关单位应当按照规定及时、准确采集垃圾分类全过程信息,并录入生活垃圾分类管理信息平台。  

  区主管部门应当制定辖区生活垃圾分类收集、运输、处理应急预案,提高生活垃圾突发事件的防范和应急处置能力。  

  第五十九条  市、区生态环境部门应当对生活垃圾集中转运和处理有关设施产生的废水、废气、废渣、噪声等污染物排放情况进行监测,并按照规定向社会公布监测信息。  

  第六十条  市住房建设部门应当将生活垃圾分类要求纳入物业服务合同示范文本和绿色物业管理评价体系,并将物业服务企业违反生活垃圾分类管理规定受到行政处罚的有关信息纳入物业服务企业信用信息档案。  

  第六十一条  任何单位和个人有权对违反生活垃圾分类管理规定的行为予以劝阻、投诉和举报。市、区主管部门应当向社会公布投诉举报电话,并提供网络投诉举报途径。  

  第六十二条  建立生活垃圾分类管理社会监督员制度。  

  市、区主管部门可以从热心公益的志愿者中选聘社会监督员,开展生活垃圾分类管理监督工作。  

  社会监督员有权进入住宅区、学校、办公以及生产经营相关场所监督生活垃圾分类投放、收集、运输、处理实施情况,对生活垃圾分类管理工作提出意见和建议。  

  相关单位和个人应当对社会监督员的监督检查工作予以配合。社会监督员不得泄露在监督检查工作中获悉的商业秘密或者专有技术信息。  

  社会监督员发现生活垃圾分类工作存在问题向市、区主管部门反映的,市、区主管部门应当依法及时处理,并反馈处理情况。  

  第六十三条  市主管部门应当建立生活垃圾分类收集、运输和处理单位的信用信息档案,将涉及生活垃圾分类管理的违法、违约行为和处理结果等信息予以记录。  

  第六十四条  有关部门、行业协会在开展文明单位、文明街道、文明社区、文明家庭等评选活动时,应当将生活垃圾分类情况纳入评选要求。  

第七章法律责任

  第六十五条  市、区人民政府有关部门、生活垃圾分类管理服务机构及其工作人员违反本条例规定,有下列行为之一的,由所在单位或者其上级主管部门责令改正;逾期未改正的,依法对直接负责的主管人员和其他直接责任人员给予处分:  

  (一)未按照规定履行生活垃圾分类指导和监督管理职责的;  

  (二)未按照规定要求建设、维护生活垃圾分类处理设施的;  

  (三)接到相关报告、投诉、举报,未依法调查处理的;  

  (四)有其他玩忽职守、滥用职权、徇私舞弊行为的。  

  第六十六条  生活垃圾分类投放义务人违反本条例第十七条规定,未按照规定要求投放生活垃圾的,由区主管部门责令改正;拒不改正的,对个人处五十元罚款,对单位处五万元罚款;情节严重的,对个人处二百元罚款,对单位处五万元以上五十万元以下罚款。  

  依据前款规定应当受到处罚的个人,没有严重情节且自愿参加市、区主管部门组织的生活垃圾分类培训、宣传服务或者现场督导等活动的,不予行政处罚。  

  第六十七条  生活垃圾分类投放管理人违反本条例第二十条规定的,由区主管部门按照下列规定予以处罚:  

  (一)未按照要求设置分类投放点、配置分类收集容器,未保持投放点或者收集容器完好、整洁的,责令限期改正,逾期不改正的,处二千元以上一万元以下罚款;  

  (二)未配合市、区主管部门和街道办事处开展生活垃圾分类宣传、引导的,处一千元以上一万元以下罚款;  

  (三)未及时将生活垃圾分类移交给相应的收集、运输单位的,处五千元以上一万元以下罚款;  

  (四)未建立生活垃圾分类投放管理台账,未如实记录生活垃圾种类、数量、去向等情况,或者未按照有关要求向街道办事处报送台账的,责令限期改正,逾期不改正的,处二千元以上一万元以下罚款;  

  违反本条例第二十三条规定,在住宅区居住楼层公共区域设置生活垃圾收集容器的,处二千元以上一万元以下罚款。  

  生活垃圾分类投放管理人已经依法履行本条例第二十条第一款第一项、第二十三条规定的管理责任的,可以不对生活垃圾分类投放管理人进行处罚,由区主管部门对相关违法行为人处二千元以上一万元以下罚款。  

  第六十八条  大型群众性活动承办者违反本条例第二十一条规定,未做好生活垃圾分类投放提示和引导,合理安排生活垃圾的分类收集、运输的,由区主管部门责令立即改正,处二千元以上一万元以下罚款。  

  第六十九条  生活垃圾收集、运输单位违反本条例第三十条规定的,由区主管部门按照下列规定处罚:  

  (一)未配备相应运输车辆、安全设备和作业人员的,责令限期改正,逾期不改正的,处二万元以上五万元以下罚款;  

  (二)分类收集、运输车辆未保持密闭,未喷涂分类标识,运输车辆未安装定位和监控系统并与生活垃圾分类管理信息平台联网的,责令限期改正,逾期不改正的,处二千元以上一万元以下罚款;  

  (三)未按照规定的时间、频次、路线和要求分类收集、运输生活垃圾的,责令限期改正,并可以处五千元以上五万元以下罚款;  

  (四)混合收集、运输已分类的生活垃圾的,处五万元罚款,情节严重的,处五万元以上五十万元以下罚款;  

  (五)未公示收集、运输电话,建立管理台账,记录生活垃圾来源、种类、数量、去向等情况,并定期向区主管部门报告的,责令限期改正,逾期不改正的,处一千元以上一万元以下罚款;  

  (六)未遵守安全管理相关法律、法规规定收集、运输已分类的生活垃圾,或者未制定应急预案向区主管部门备案的,责令限期改正,逾期不改正的,处一万元以上三万元以下罚款。  

  第七十条  违反本条例第三十五条规定,未将不能就地处理的餐厨垃圾全量交由特许经营企业收集、运输、处理的,由区主管部门责令限期改正,并对单位处十万元以上一百万元以下罚款,对个人处一百元以上五百元以下罚款,有违法所得的,没收违法所得;未经许可从事餐厨垃圾收集、运输和处理活动的,由区主管部门责令停止违法行为,处十万元以上一百万元以下罚款,有违法所得的,没收违法所得。  

  第七十一条  生活垃圾处理单位违反本条例第三十九条规定的,由区主管部门按照下列规定处罚:  

  (一)未配备相应处理设施设备、安全设备和作业人员的,责令限期改正,逾期不改正的,处二万元以上五万元以下罚款;  

  (二)混合处理已分类的生活垃圾,处五万元以上十万元以下罚款,情节严重的,处十万元以上五十万元以下罚款,违法处理生活垃圾并牟取利益的,没收违法所得;  

  (三)未安装计量和监控系统并与生活垃圾分类管理信息平台联网的,责令限期改正,逾期不改正的,处三万元罚款;  

  (四)未建立管理台账或者未按照要求报送台账的,责令限期改正,逾期不改正的,处二千元以上一万元以下罚款;  

  (五)擅自停止处理生活垃圾的,处十万元以上一百万元以下罚款;  

  (六)未定期向社会公开排放的主要污染物的名称、排放方式、排放浓度和总量,以及生活垃圾处理设施的运行情况的,责令限期改正,逾期不改正的,处十万元以上二十万元以下罚款;  

  (七)未遵守安全管理相关法律、法规规定处理已分类的生活垃圾,或者未制定应急预案向市、区主管部门备案的,责令限期改正,逾期不改正的,处一万元以上五万元以下罚款。  

  第七十二条  违反本条例第四十五条第一款规定,商品零售经营者免费向消费者提供塑料购物袋的,由市场监管部门责令改正;拒不改正的,处一千元以上一万元以下罚款。  

  违反本条例第四十五条第二款规定,旅馆业经营者主动向消费者提供客房一次性日用品的,由市场监管部门责令限期改正;逾期不改正的,处一千元以上五千元以下罚款。  

  违反本条例第四十六条第一款规定,餐饮服务提供者或者餐饮配送服务提供者免费向消费者提供一次性筷子、叉子、汤匙等餐具的,由市场监管部门责令限期改正;逾期不改正的,处一千元以上五千元以下罚款。  

  本条前三款涉及提供国家禁止、限制使用的一次性塑料制品的,由市场监管部门依照《中华人民共和国固体废物污染环境防治法》的规定给予处罚。  

  第七十三条  任何单位和个人弄虚作假,骗取财政补贴或者奖励的,由市、区主管部门追缴所骗取的资金,并按照所骗取资金金额五倍处以罚款;构成犯罪的,依法追究刑事责任。  

第八章 

  第七十四条  本条例下列用语的含义:  

  (一)家用化学品,是指居民日常生活中产生的废弃的药品药具及其包装物、杀虫剂和消毒剂及其包装物、油漆和溶剂及其包装物等。  

  (二)家庭厨余垃圾,是指居民家庭日常生活产生的菜帮、菜叶、瓜果皮壳、剩菜剩饭、废弃食物等易腐性垃圾。  

  (三)餐厨垃圾,是指在食品加工、饮食服务、单位供餐等活动中产生的食物残渣、食品加工废料、过期食品和废弃食用油脂等。  

  (四)其他厨余垃圾,是指农产品批发市场、农贸市场、大型超市等场所产生的蔬菜瓜果、腐肉、肉碎骨、水产品、畜禽内脏等易腐性垃圾。  

  第七十五条  本条例自2020年9月1日起施行。
