Chapter One General Provisions
Article 1 for the purpose of safeguarding public security and social order, create a social governance model based on collaboration, participation and common interests, and to promote the urban order of Shenzhen, these Regulations are hereby formulated in accordance with the Decision of the Standing Committee of the National People's Congress on Enhancing Comprehensive Management of Social Security and the basic principles of relevant laws and regulations and in light of the actual circumstances of Shenzhen Special Economic Zone.
Article 2 These Regulations shall apply to the State organs, enterprises, public institutions, people's organizations, and other social organizations that carry out the urban order construction in Shenzhen Special Economic Zone.
Article 3 The urban order construction shall be under the leadership of the CPC, a people-centered approach, and based on collaboration, participation and common interests. Systematic governance, law-based governance, comprehensive governance and source governance shall be practically combined for the urban order construction.
Article 4 The municipal and district people's governments shall incorporate the urban order construction in their national economic and social development plans, fulfill their duties, and provide corresponding support for the urban order construction.
Article 5 The municipal and district organization and coordination institutions for the urban order construction (hereinafter referred to as "organization and coordination institution(s)") shall carry out urban order construction under the leadership of the Party Committees at the same levels.
Article 6 Agencies and individuals shall be encouraged to take part in the urban order construction. Agencies and individuals that have made outstanding contributions to the urban order construction shall be commended and rewarded.
Chapter Two Power and Duty
Article 7 The municipal and district organization and coordination institutions shall perform the following duties:
(1) Organizing and providing guidance for the implementation of laws and regulations regarding the urban order construction;
(2) Grasping the dynamic information, studying major issues, and providing suggestions regarding the urban order construction;
(3) Coordinating the work for the urban order construction for all agencies concerned and supervising them to do their respective work;
(4) Establishing a linkage and coordination mechanism for the urban order construction;
(5) Coordinating to address major emergencies;
(6) Formulating evaluation and assessment standards to assess the urban order construction, and offering suggestions to relevant departments;
(7) Coordinating other tasks regarding the urban order construction.
Article 8 The municipal and district organization and coordination institutions shall, based on the demands of the urban order construction, relevant agencies including agencies in charge of public security, judicial administration, planning and natural resources, market regulation, urban administration and law enforcement shall be determined as the member agencies (hereinafter collectively referred to as member agencies) of the linkage and coordination mechanism for the urban order construction.
All or some member agencies may be convened by the municipal and district organization and coordination institutions to study and arrange related tasks as needed.
Article 9 The member agencies shall establish and improve the work system for the urban order construction, formulate and implement relevant work plans, fulfill relevant duties, and conduct guidance, supervision, inspection, and assessments on relevant work regarding their industries and systems for the urban order construction.
The member agencies shall, in accordance with the provisions, report their work for the urban order construction to the organization and coordination institutions at the same levels.
Article 10 Public security organs shall establish a mechanism to check, analyze, prevent, and handle public security issues; properly handle mass incidents and emergencies that endanger public security, and investigate and deal with illegal and criminal acts that endanger public security in accordance with the law; direct and supervise the crime prevention and control, and provide relevant agencies with suggestions in time on the weaknesses and prominent problems in the urban order construction.
The administrative departments for justice shall carry out publicity and education on the urban order construction, properly carry out, including but not limited to, legal aid, community corrections, legal services, in accordance with the law, and supervise and direct the people's mediation carried out by community-level people's mediation organizations.
Relevant departments of the municipal and district people's governments shall effectively carry out the work related to the urban order construction according to their responsibilities.
Article 11 People's courts and people's procuratorates shall fulfill their duties of combating crimes in accordance with the law and provide relevant agencies with judicial and procuratorial suggestions in time on the weaknesses and prominent problems in the urban order construction.
Article 12 State organs, enterprises, public institutions, people's organizations, and other social organizations shall establish and improve the system for the urban order construction, clarify the responsibilities of relevant agencies, and strengthen internal preventive measures in terms of personnel, material resources and conditions and technologies to resolve the conflicts and potential hazards affecting the urban order construction, and thus promote the urban order.
Article 13 Subdistrict offices shall make innovation in the models of community-level governance and public services, carry out activities regarding joint prevention and governance and building of orderly communities within their jurisdictions, properly handle the community correction and dispute resolution.
Article 14 The municipal, district, and subdistrict departments shall establish centers for comprehensive management of social security (hereinafter referred to as "comprehensive management centers") as the work platforms for the urban order construction. The comprehensive management centers shall implement the following matters:
(1) Organizing and coordinating with relevant agencies to collect and sort out basic social information including but not limited to population, agencies, houses, and events within their jurisdictions and to carry out dynamic monitoring and judgment of social security and social stability;
(2) Directing and supervising relevant agencies to take comprehensive measures to improve and safeguard social security, and eliminate public security hazards, crimes, and other unstable factors;
(3) Organizing publicity and education on the rule of law;
(4) Organizing resolution of conflicts and disputes.
Comprehensive management centers may be equipped with necessary workplaces and personnel as required by their work, and establish a distribution, circulation and collaboration mechanism to deal with relevant issues in a timely manner.
Article 15 Member agencies shall carry out publicity and education on the rule of law and the urban order construction among citizens through public service advertisements, brochures, bulletin boards, the Internet, etc.
Article 16 A target-oriented and responsibility-based management system shall be implemented for the urban order construction. Relevant State organs, enterprises, public institutions, people's organizations, and other social organizations shall determine the objectives, tasks, responsible agencies, and responsible personnel as required by their responsibilities, and effectively fulfill their duties of target-oriented management.
Chapter Three Infrastructure
Article 17 A grid-based management approach shall be adopted for the urban order construction, and grids shall be partitioned based on principles of territorial administration, street demarcation, moderate scale, and dynamic adjustment. Based on grids, the relevant departments shall prevent and control crimes, eliminate social conflicts, disputes and public security hazards, and check and collect basic social information including but not limited to population, agencies, houses, and events.
Article 18 Ways shall be explored to establish a smart social governance system based on basic social information.
The municipal and district organization and coordination institutions and relevant departments shall intensify the building and application of video surveillance systems for public security, adopt a unified platform for management based on different levels and classifications, and user permissions shall be strictly restricted to ensure network information security.
Article 19 The information-sharing mechanism shall be established and improved for urban order construction. Any municipal and district organization or coordination institution shall strengthen the interconnection and sharing of information with relevant departments, and improve the cross-departmental, cross-regional, and regular mechanism for information sharing.
When collecting and using relevant information, any relevant agency shall protect personal privacy and business secrets in a strict manner accordance with the law.
Article 20 Any State security organ, public security organ, or other relevant department shall establish an analysis and judgment mechanism for national security, social security, and social risks; conduct research and judgment on the overall security situation; strengthen the analysis and prediction of public opinions, public security trends and hotspots, and sensitive issues; provide opinions and suggestions on relevant tasks.
Article 21 Any public security organ shall establish and improve an early warning mechanism for social public security. For public security issues including but not limited to telecom fraud, financial fraud, producing and selling fakes, and cult-related activities that occur frequently in a certain period or area, any public security organ shall issue early warnings to the public in a timely manner to guide the public to take effective measures to cope with and prevent these issues.
Any public security organ shall promptly report significant criminal and security situations in specific areas and special industries to the organization and coordination institutions. Whenever necessary, the organization and coordination institution at the same level shall coordinate with various departments for joint launch of a rectification movement
Article 22 Any municipal public security organ shall, in conjunction with relevant department(s), formulate and improve the standards of preventive measures regarding personnel, material resources and conditions and technologies for key areas and important places, and submit such standards to the municipal people's government for approval before implementation.
Article 23 Any relevant department shall formulate its emergency response plan for public security, fire rescue, public health, and any other emergency in accordance with its respective responsibility, and handle relevant emergencies in accordance with the law to maintain social stability.
Article 24 For any cross-departmental and cross-regional major criminal and security issue, potential hazard, or the prominent problem in the urban order construction, any competent department shall promptly inform relevant department(s) and report to the organization and coordination institution at the same level. If any cross-departmental or cross-regional collaboration is required, the organization and coordination institution shall coordinate and handle the issues; a competent department may also convene other relevant department(s) to jointly analyze and judge the issues, formulate joint action plans and measures, and clarify responsibilities to jointly and properly address the problems.
Article 25 A mechanism shall be established and improved for the handover of public security cases. When receiving reports on public security cases that are not within the scope of its duties, a relevant department shall hand over relevant clues and materials to the department(s) performing relevant duties; if suspected crimes are discovered during the law enforcement, they shall be handed over to a public security organ for handling in accordance with the law.
Chapter Four Prevention and Control in Key Areas
Article 26 For key areas including but not limited to schools, hospitals, parks, large shopping malls, airports, stations, ports, entry and exit ports, security personnel, material resources, and technical facilities and equipment shall be allocated in these areas in accordance with relevant provisions and standards, emergency response plans and action plans shall be prepared, and emergency drills shall be organized regularly by the responsible management agencies to improve their actual prevention and control capabilities.
Any public security organ shall guide relevant agencies on how to carry out prevention and control tasks in key areas, supervise and inspect their work, and offer rectification opinions on weaknesses and prominent problems regarding public security. Any relevant agency shall complete the rectification in time.
Article 27 For any large-scale event, effective measures shall be taken in accordance with the law to ensure the safety of people's lives and property.
Before a large-scale event is held, any organ that decides to host or approve the event shall make assessment on the security risks in terms of factors including but not limited to the time, location, scale, and mode of the event.
Any organizer of a large-scale event shall formulate an emergency response plan to ensure that the surrounding public areas of the event remains safe and the entrances and exits of the event remains unblocked, and take precautions against situations that might affect the public security and deal with them in a timely manner; if necessary, the organizer shall install explosion-proof, security inspection and other devices and equipment to strengthen security; in case of an emergency, the organizer shall take emergency measures in a timely manner.
Any organizer of a large-scale event shall obtain the information of the participants in the event according to security requirements and may require real-name authentication of participants if necessary.
Article 28 Any public security organ shall crack down on gang crimes in accordance with the law, step up the investigation and inspection of reports and clues, and promptly investigate and handle cases of gang crimes.
During administrative law enforcement in terms of market regulation, transportation, engineering construction, medical and health, etc., any relevant department shall report to the public security organ(s) in time if it discovers any clues of gang crime; and promptly carry out rectification if there are any problems in the industry supervision.
Article 29 For major illegal criminal activities including but not limited to frauds in financial, telecom and Internet areas, trafficking of women and children, pornography, gambling, pyramid schemes, and cults in specific periods and areas, a public security organ shall organize key and special actions to crack down on such crimes, and carry out special rectification in conjunction with relevant departments as needed.
Article 30 Any Internet and telecommunication enterprise shall take technical measures for security management in accordance with laws, regulations, and relevant national regulations to block the illegal release, search, and dissemination of information, and prevent Internet and telecommunication users from releasing and disseminating false and harmful information.
A public security organ shall guide Internet and telecommunication enterprises on how to improve the collection and preservation of evidence of Internet and telecommunication crimes, and focus on monitoring the abnormal changes in personnel, regions, and flow involved in online capital transactions; issue warnings when discovering any significant security risks; require any relevant enterprise to take blocking measures immediately in case of suspected crimes
Article 31 Any financial institution, or Internet and telecommunication enterprise shall abide by laws and regulations, strengthen education and publicity on preventing frauds in financial, telecommunication, and network areas, and promptly remind their customers of such circumstances and report to a public security organ when it discover any suspected crimes or major abnormal circumstances.
Any public security organ or other law enforcement agency shall, in accordance with the law, crack down on any fraud in financial, telecommunication and network areas or any other related illegal and criminal activity carried out through telecommunication, the Internet, and other means. Financial institutions, Internet, and a telecommunication enterprise shall cooperate with any public security organ accordingly.
Article 32 Any logistics and delivery enterprise shall take full-coverage measures including but not limited to sender identity verification, item inspection, and safety inspection in accordance with State laws and regulations. A transportation department and postal administration department shall strengthen their supervision over the implementation of sender identity verification, item inspection, and safety inspection by any logistics and delivery enterprise.
A logistics and delivery enterprise shall verify the name of the sender or its proxy when receiving and sending items, inspect the items before receiving and sending them, and conduct safety inspections before sending them. If the sender or its proxy refuses inspection or safety inspection, the logistics or delivery enterprise shall not receive or send such items.
Any logistics and delivery enterprise shall record the whole process of the safety inspection of the delivered items in accordance with the law, and keep any nrelated record in accordance with relevant provisions.
Article 33 Any District and subdistrict integrated management institutions of population and housing shall establish and improve the mechanism for rented housing management based on different levels and classifications, collect and verify the information of population in rented housing and the housing information, detect potential hazards in rented housing, and assist any relevant department in special rectification work.
A lessor shall report the rented housing information in accordance with the law, ensure the security of rented housing facilities, and promptly eliminate or urge any lessese to eliminate any potential hazard.
Any lessee shall not carry out any illegal or criminal activity in the rented housing. When discovering any suspected crimes, a lessor shall promptly report to the public security organ(s) or relevant department(s).
Article 34 An education department shall, in conjunction with any public security organ, establish a long-term mechanism for preventing bullying at a primary or secondary school. A primary or secondary school shall set up a channel for anonymous reporting of bullying and designate a personnel in charge of the channel; establish a mechanism for communication with parents, promptly publish relevant information, properly investigate and verify the circumstances, and handle school bullying in a timely manner. A public security organ shall establish a mechanism for the communication on bullying at a primary or secondary schools and strengthen the monitoring and handling of bullying outside any school.
Chapter Five Prevention and Control of Social Risks and Conflict Resolution
Article 35 When making a significant decision, any relevant State organ shall carry out analysis and assessment on possible risks to social stability, and propose corresponding measures to prevent and mitigate the risks.
Article 36 The municipal and district organization and coordination institutions shall, together with relevant departments, carry out study and judgement on possible risks to social stability every year, determine the risk levels, and establish a mechanism to cope with major emergencies. In the event of emergencies, quick response shall be made to emergencies in accordance with the law.
Article 37 Departments of human resources and social security shall establish a mechanism for preventing risks of labor disputes to resolve labor disputes in a timely manner in accordance with the law. Enterprises that seriously violate labor laws and regulations, including but not limited to being in arrears with wages, shall be included in list of enterprises under the credit-based regulation.
Article 38 For projects including but not limited to house demolition, land reclamation, urban renewal, shantytown renovation, and NIMBY projects, the departments in charge of development and reform, planning and natural resources, and housing and construction, as well as the district people's governments shall assess the risks to social stability, and establish and improve the mechanism for preventing the risks to social stability according to relevant provisions to prevent mass incidents.
Article 39 The people's courts, public security organs, and judicial administrative departments shall, in conjunction with relevant departments, people's organizations, and other social organizations, establish and improve the mechanism for resolving family disputes and make full use of personal protection orders and admonition notices to prevent and resolve family conflicts and disputes.
Family members who suffer or face physical or mental violence and injuries including but not limited to beating, binding, mutilating, restricting personal freedom, and frequent abuse, and intimidation, may apply to people's courts or public security organs for personal protection orders in accordance with the law. Public security organs shall take measures in a timely manner to protect the victims.
Article 40 The municipal and district organization and coordination institutions shall push forward the establishment of a sound mechanism for diversified resolution of conflicts and disputes and give full play to their roles in people's mediation, administrative mediation, judicial mediation, commercial mediation, litigation, arbitration, administrative adjudication, administrative reconsideration, etc., to facilitate the timely and effective resolution of social conflicts and disputes.
Article 41 The municipal and district organization and coordination institutions shall work with relevant departments to develop a special work program for the resolution of conflicts and disputes and investigate and manage conflicts and disputes.
Chapter Six Community-Level Service and Management
Article 42 The judicial administrative departments shall strengthen the supervision and management of community corrections, education, assistance, etc., and organize education and learning, skills training, psychological corrections, and public welfare activities to help enhance the sense of compliance and social responsibility of the personal who accepts community correction.
Article 43 The municipal and district organization and coordination institutions shall work with relevant departments to promote the education and rehabilitation of personnel involved in cult activities and help them return to their normal lives in society.
Article 44 A multi-party mechanism shall be established and improved for caring for and assisting patients with mental disorders.
The municipal mental health center shall strengthen the management of patients with mental disorders, carry out education and training on matters including but not limited to the identification of patients with severe mental disorders and the daily care for such patients, and share and exchange information with relevant departments, subdistrict offices, residents committees, etc., to prevent patients with mental disorders from causing damage to others.
Medical institutions, residents committees, guardians of patients with mental disorders, etc., shall properly provide services including but not limited to information collection, medical diagnosis, treatment, and assistance in difficult situations, to protect the lawful rights and interests of patients with mental disorders and their family members.
Departments of public security, civil affairs, and health, as well as subdistrict offices, residents' committees, and medical institutions, shall promptly notify the municipal mental health center if they discover any patients with severe mental disorders.
Article 45 Support shall be given to the establishment of community-based psychological studios that provide psychological counseling services and crisis interventions for those who feel frustrated in life, have personality imbalances, behavioral disorders, and are with paranoia, and those who participate in cult activities.
Article 46 Families, schools, and society shall cooperate with one another to strengthen publicity and education on the rule of law among young people to prevent young people from being negatively affected by drugs, cults, and bad ideas.
The education department and other relevant departments shall promote the building of special schools and special education, and properly carry out the education and correction of juveniles and community minor prisoners with misbehaviors and carry out measures on crime prevention.
Article 47 All agencies shall include the publicity and education on the rule of law into the education and training tasks of their agencies, and carry out education on social ethics, professional ethics, and family virtues in various forms for their employees.
Chapter Seven Public Engagement
Article 48 The municipal and district organization and coordination institutions shall coordinate the efforts of all parties, and organize and encourage parties including but not limited to residents' committees, joint-stock cooperative enterprises, owners' committees, community-based agencies, to participate in the urban order construction at the community-level and fulfill their respective duties.
The municipal and district organization and coordination institutions shall coordinate departments of public security, housing and construction, and other relevant departments to give full play to the role of property service companies in community-level social governance, and direct and encourage property service companies to participate in the urban order construction.
Property service companies may assist in matters including inspections, residence registration as entrusted by relevant agencies.
Article 49 State organs, enterprises and public institutions, people's organizations, and other social organizations shall strengthen the building of their internal security organizations in accordance with the law.
Residents' committees shall establish and improve a public security system, and mobilize residents to jointly implement public security tasks in their communities.
Article 50 Citizens shall be encouraged to voluntarily take part in the urban order construction and the community-level governance in the name of "guadians", "vigilante" and "officers", and assist relevant departments in safeguarding public security. Relevant departments shall strengthen the organization, guidance, and training of volunteers.
Article 51 Residents' committees, owners' assemblies, and other autonomous organizations shall be encouraged to clarify and subdivide the rights, obligations, and codes of conduct related to the urban order construction in the form of residents' codes of conduct, owners' conventions, etc. Agencies and individuals shall be encouraged to specify the contents of relevant codes of conduct or conventions in the lease contracts for their business including but not limited to house leasing.
Article 52 Citizens shall be encouraged to report illegal and criminal acts and offer opinions and suggestions on the urban order construction.
Support shall be given to citizens who bravely fight against illegal and criminal acts and safeguard public security.
Article 53 The role of social organizations that actively and properly take part in the urban order construction shall be brought into full play. Municipal and district people's governments may direct social organizations to take part in community-based anti-drug services, anti-cult services, corrections, social assistance and education, and the serving and management of patients with mental disorders by purchasing services provided by social organizations and offering subsidies.
Article 54 News media shall strengthen the publicity of the urban order construction and actively report the advanced deeds, policies, and measures in the urban order construction to create a civilized, harmonious and peaceful social atmosphere.
Chapter Eight Assessment, Rewards and Punishment
Article 55 Municipal organization and coordination institutions shall carry out supervision, inspection and assessment on the implementation of the target-oriented and responsibility-based system of the district people's governments, relevant departments, and relevant agencies for the urban order construction. The assessment on the district people's governments and relevant departments shall be included in the municipal and district performance assessments.
Any district people's governments, relevant departments, enterprises, public institutions, people's organizations, and other social organizations that fail to meet the requirements for the urban order construction, shall not be rated as advanced agencies of social construction of ideological infrastructure, and shall not be granted with comprehensive honorary titles; the persons in charge of the agencies and the persons directly responsible shall not be rated as advanced individuals.
For the assessment of target-oriented and responsibility-based systems for the urban order construction, the municipal and district organization and coordination institutions may entrust a third-party organization to conduct public opinion surveys in terms of indicators including but not limited to sense of security and public security satisfaction. Public security organs may organize technical evaluations on the prevention performance of relevant responsible agencies as an important basis for assessing their performance in the urban order construction.
Article 56 If any relevant agencies fail to fulfill their responsibilities for the urban order construction in accordance with the law, under any of the following circumstances, the municipal and district organization and coordination institutions shall, based on the severity of the circumstances and in the form of notification, interview, and supervision, etc., supervise them to rectify the circumstances within a specified time:
(1) Paying little attention to the urban order construction, ineffective implementation of relevant measures, poor performance in the basic community-level task implementation, ineffective rectification of significant safety hazards in relevant regions, systems, or industries, social conflicts and disputes being prominent;
(2) Continuous occurrence of major criminal cases, mass incidents, or public security incidents in a short period of time;
(3) Failing to pass the performance assessment in the urban order construction;
(4) Failing to take effective measures in a timely manner to address public security issues of keen concern to the citizens;
(5) Other circumstances that require supervision and rectification.
Article 57 For any agencies under any of the circumstances listed in Article 56 hereof that cause particularly serious damage or a particularly significant impact, the municipal or district organization and coordination institutions shall, in accordance with the relevant procedures, recommend that the agencies be disqualified for any integrated honorary titles within one year and that the persons in charge of the agencies be disqualified for any prizes, awards, and promotion.
Article 58 Staff members of State organs, enterprises, public institutions, people's organizations, and other social organizations who refuse to perform their duties in the urban order construction or abuse their power, neglect their duties and commit wrongdoings to serve their own interests, shall be disciplined by the departments they work for or be given administrative penalties by supervisory organs. If these malpractices constitute crimes, their criminal liability will be investigated according to the law.
Chapter Nine Supplementary Provisions
Article 59 These Regulations shall come into force on October 1, 2020, and the Regulations of Shenzhen Special Economic Zone on Comprehensive Management of Public Security shall be repealed simultaneously.
深圳经济特区平安建设条例

第一章总则
第一条 为了维护社会治安秩序,营造共建共治共享的社会治理格局,推进平安深圳建设,根据《全国人民代表大会常务委员会关于加强社会治安综合治理的决定》和有关法律法规的基本原则,结合深圳经济特区实际,制定本条例。
第二条 深圳经济特区内国家机关、企业事业单位、人民团体以及其他社会组织开展平安建设工作,适用本条例。
第三条 平安建设坚持党的领导,坚持以人民为中心,坚持共建共治共享,坚持系统治理、依法治理、综合治理、源头治理。
第四条 市、区人民政府应当将平安建设工作纳入国民经济和社会发展规划,履行平安建设相关职责,为平安建设工作提供相应的保障。
第五条 市、区平安建设组织协调机构(以下简称组织协调机构)在同级党委的领导下,组织开展平安建设工作。
第六条 鼓励单位和个人积极参与平安建设工作,对在平安建设工作中做出突出贡献的单位和个人可以给予表彰奖励。
第二章工作职责
第七条 市、区组织协调机构履行下列职责:
(一)组织、指导实施平安建设相关法律、法规;
(二)掌握平安建设动态,研究平安建设有关重大问题,提出平安建设工作建议;
(三)协调、督促各有关单位开展平安建设工作;
(四)建立平安建设联动和协调工作机制;
(五)协调处置重大突发事件;
(六)制定评价考核标准,对平安建设工作进行考核,向有关部门提出工作建议;
(七)协调处理平安建设其他工作。
第八条 市、区组织协调机构应当根据平安建设工作需要,确定辖区内的公安、司法行政、规划和自然资源、市场监管、城管和综合执法等相关单位作为平安建设联动和协调工作机制成员单位(以下简称成员单位)。
市、区组织协调机构可以根据工作需要召集全体或者部分成员单位研究部署相关工作。
第九条 成员单位应当建立健全本单位平安建设工作制度,制定平安建设工作计划并组织实施,履行相应的平安建设工作职责,指导、督促、检查、考核本行业、本系统平安建设工作。
成员单位应当按照规定向同级组织协调机构报告平安建设工作。
第十条 公安机关应当建立社会治安排查、分析、防范和处置工作机制;依法妥善处置危害社会治安秩序的群体性事件和突发事件、查处危害社会治安秩序的违法犯罪行为;指导、监督社会治安防控工作,对平安建设工作的薄弱环节和突出问题及时向有关单位提出工作建议。
司法行政部门应当加强平安建设宣传教育,依法做好法律援助、社区矫正、法律服务等方面的工作,监督、指导基层人民调解组织开展人民调解工作。
市、区人民政府相关部门应当按照各自职责,做好平安建设工作。
第十一条 人民法院、人民检察院应当依法履行惩治违法犯罪的工作职责,并对平安建设工作的薄弱环节和突出问题及时向有关单位提出司法建议、检察建议。
第十二条 国家机关、企业事业单位、人民团体以及其他社会组织应当建立和完善平安建设工作制度,落实平安建设主体责任,加强内部人防、物防、技防等防范措施,及时化解影响平安建设的矛盾纠纷和隐患,推进平安建设工作。
第十三条 街道办事处应当创新基层治理和公共服务方式,组织开展辖区内群防群治、创建平安社区等活动,指导开展基层社会治理,做好社区矫正、化解矛盾纠纷等方面的工作。
第十四条 市、区、街道设立社会治安综合治理中心(以下简称综治中心)作为平安建设工作平台,主要开展下列工作:
(一)组织协调有关单位收集整理辖区内人口、单位、房屋、事件等社会基础信息,开展社会治安和社会稳定形势动态监测和研判;
(二)指挥调度、检查督促有关单位开展综治维稳工作,排查公共安全隐患、违法犯罪和其他不安定因素;
(三)组织开展法治宣传教育;
(四)组织化解矛盾纠纷。
综治中心可以根据工作需要,配备必要的办公场所以及人员,建立分拨、流转、协同工作机制,及时处置有关问题。
第十五条 成员单位应当利用公益广告、宣传手册、宣传栏、互联网等多种形式,对市民开展平安建设法治宣传教育。
第十六条 平安建设工作实行目标管理责任制。有关国家机关、企业事业单位、人民团体以及其他社会组织应当根据工作职责,确定工作目标,明确工作任务、责任单位和责任人,切实落实目标管理责任。
第三章 基础建设
第十七条 平安建设实行网格化管理,按照属地管理、街巷定界、规模适度、动态调整的原则划分网格,依托网格开展防控违法犯罪,排查社会矛盾纠纷和社会治安隐患,核查采集人口、单位、房屋、事件等社会基础信息等工作。
第十八条 探索建立以社会基础信息大数据库为基础的智慧社会治理机制。
市、区组织协调机构和有关部门应当加强公共安全视频监控系统的建设和应用,实行统一平台和分级分类管理制度,严格设置使用权限,切实保障网络信息安全。
第十九条 建立健全平安建设信息共享机制。市、区组织协调机构应当强化同各有关部门信息资源的互联共享,健全跨部门、跨区域、常态化的信息资源共享机制。
有关单位收集、使用相关信息时应当严格依法保护个人隐私和商业秘密。
第二十条 国家安全机关、公安机关和其他相关部门应当建立国家安全、社会治安和社会风险形势分析研判机制,对安全形势进行整体研判,加强对社会舆情、治安动态和热点、敏感问题的分析预测,提出工作意见和建议。
第二十一条 公安机关应当建立健全社会治安形势预警机制,对于在一定时期或者区域内高发频发的电信诈骗、金融诈骗、制假售假、涉邪教活动等社会治安问题,应当及时向社会发布预警,指导公众采取有效措施应对和预防。
公安机关应当及时向组织协调机构报告特定区域、特殊行业的重大刑事治安警情。必要时,由同级组织协调机构协调各部门进行联合整治。
第二十二条 市公安机关应当会同相关部门制定和完善重点区域和重要场所的人防、物防、技防标准,报市人民政府批准后实施。
第二十三条 各有关部门应当根据各自职责制定社会治安、消防救援、公共卫生等突发事件应急预案,依法处置相关突发事件,维护社会稳定。
第二十四条 对跨部门、跨区域的重大刑事治安警情和隐患以及平安建设中存在的突出问题,主管部门应当及时通报相关部门,并报告同级组织协调机构;需要跨部门、跨区域协作的,由组织协调机构协调处理,主管部门也可以主动召集其他相关部门共同分析研判,制定联动方案和措施,明确责任,协同行动,稳妥处置。
第二十五条 建立健全治安案件移送机制。相关部门在接到不属于本部门职责范围的治安案件举报时,应当向履行相关职责的部门移交线索和相关资料;在执法过程中发现有涉嫌犯罪情形的,应当依法转送公安机关处理。
第四章 重点防控
第二十六条 学校、医院以及公园、大型商场、机场、车站、港口码头、出入境口岸等区域管理单位应当按照有关规定、标准配备安保人员以及物防和技防设施设备,编制突发性事件应急预案和行动方案,定期组织演练,提高实际防控能力。
公安机关负责指导有关单位开展重点防控工作,进行监督检查,对治安薄弱环节和突出问题提出整改意见,相关单位应当按期完成整改。
第二十七条 举办大型活动应当依法采取有效措施,保障人民生命财产安全。
举办大型活动前,决定举办或者批准活动的机关应当就活动涉及的时间、地点、规模、举办方式等影响安全的因素进行安全风险评估。
大型活动承办者应当制定应急预案,保证活动周边区域公共安全和活动场所出入口畅通,对可能影响公共安全的情形做好防范并及时处置;必要时设置防爆、安检等装置和设备,提升安全防范强度;发生突发事件时,应当及时采取应急处置措施。
大型活动承办者应当根据安全需要掌握活动参加人员的情况,必要时可以要求参加人员进行实名认证。
第二十八条 公安机关应当依法严厉打击黑恶势力,加强摸排核查举报线索,及时查办涉黑涉恶案件。
相关部门在市场监管、交通运输、工程建设、医疗卫生等行政执法过程中,发现涉黑涉恶案件线索的,应当及时报告公安机关;对行业监管存在的问题,及时开展整治。
第二十九条 公安机关对特定时期、特定区域发生的金融、电信和网络诈骗以及拐卖妇女儿童、涉黄赌毒、传销、邪教等重大违法犯罪行为,应当组织重点专项打击行动,并根据需要会同有关部门开展专项治理。
第三十条 互联网和电信企业应当依照法律、法规和国家有关规定落实安全管理技术措施,阻断违法信息发布、搜索、传播渠道,阻止互联网和电信用户发布和传播虚假、有害信息。
公安机关应当指导互联网和电信企业改进互联网和电信违法犯罪证据提取和保全措施,对互联网上发生的资金往来所涉及的人员、地域、流向等异常变动情况进行重点监控;发现存在重大安全风险的,应当进行风险提示;对涉嫌违法犯罪的,可以要求相关企业立即采取阻断措施。
第三十一条 金融机构、互联网和电信企业应当遵守法律、法规的规定,加强防范金融、电信和网络诈骗的教育宣传,发现涉嫌违法犯罪的行为或者重大异常情况应当及时向客户作出提示并向公安机关报告。
公安机关等执法部门应当依法严厉打击利用电信、互联网及其他方式实施的金融、电信和网络诈骗活动及其他相关违法犯罪行为,金融机构、互联网和电信企业应当予以配合。
第三十二条 物流、寄递企业应当按照国家规定实行寄件人身份核查、物件验视和安全检查全覆盖措施。交通运输部门、邮政管理部门应当加强对物流、寄递企业落实寄件人身份核查、物件验视和安全检查工作的监督。
物流、寄递企业在收寄物件时应当对寄件人或者其委托人的姓名予以核实,在收寄前验视物件并在寄送前进行安全检查。寄件人或者其委托人拒绝验视或者安全检查的,物流、寄递企业不得收寄。
物流、寄递企业应当依法对交寄物件安全检查进行全程录像,并按照有关规定保存。
第三十三条 区、街道人口和房屋综合管理机构应当建立、完善出租屋分类分级管理机制,开展出租屋人口信息和房屋信息核查采集,排查出租屋安全隐患,并协助相关部门开展相关专项整治工作。
出租人应当依法申报出租屋信息,保障出租屋设施安全,及时排除或者督促承租人排除安全隐患。
承租人不得利用出租屋从事违法犯罪活动。出租人发现涉嫌违法犯罪的,应当及时向公安机关或者相关部门报告。
第三十四条 教育部门应当会同公安机关建立防治中小学校学生欺凌行为长效机制。中小学校应当开辟有专人负责的不记名举报欺凌行为通道,并建立家长沟通机制,及时通报有关信息,认真调查核实、及时处理学生欺凌行为;公安机关应当与中小学校建立学生欺凌行为信息沟通机制,并加强校外学生欺凌行为的监控和处置力度。
第五章 社会风险防范与矛盾化解
第三十五条 有关国家机关在做出重大决策时,应当对可能引起的社会稳定风险进行分析和评估,提出防范和化解风险的相应措施。
第三十六条 市、区组织协调机构应当每年会同相关部门研判可能存在的社会稳定风险,并划分风险等级,建立重大突发事件应对机制。发生突发事件,应当快速反应,依法处置。
第三十七条 人力资源和社会保障部门应当建立劳动争议风险防范机制,依法及时处理劳动争议;对拖欠工资等严重违反劳动法律、法规的企业应当纳入信用监管。
第三十八条 对于房屋拆迁、土地收回、城市更新、棚户区改造以及邻避项目等工程,发展改革、规划和自然资源、住房建设等部门以及各区人民政府应当做好社会稳定风险评估,按照规定建立完善社会稳定风险防范机制,防止引发群体性事件。
第三十九条 人民法院、公安机关、司法行政部门应当会同有关部门、人民团体和其他社会组织等建立完善家事情感纠纷调处机制,充分运用人身安全保护令和公安告诫书等多种形式,预防和化解家庭矛盾纠纷。
家庭成员遭受或者面临以殴打、捆绑、残害、限制人身自由以及经常性谩骂、恐吓等方式实施身体、精神等侵害行为的,除依法向人民法院申请人身安全保护令以外,也可以向公安机关申请人身安全保护,公安机关应当及时采取措施保护受害人。
第四十条 市、区组织协调机构应当推动建立健全矛盾纠纷多元化解机制,充分发挥人民调解、行政调解、司法调解、商事调解、诉讼、仲裁、行政裁决、行政复议等作用,促进社会矛盾纠纷及时有效化解。
第四十一条 市、区组织协调机构应当会同相关部门制定矛盾纠纷化解专项治理工作方案,开展矛盾纠纷排查和专项治理。
第六章 基层服务与管理
第四十二条 司法行政部门应当加强社区矫正监督管理、教育帮扶等工作,通过组织教育学习、技能培训、心理矫治、参加公益活动等方式,增强社区矫正对象的遵纪守法意识和社会责任感。
第四十三条 市、区组织协调机构应当会同有关部门积极推进参与邪教活动人员教育转化工作,帮助其回归社会正常生活。
第四十四条 建立健全多方参与的精神障碍患者关爱帮扶工作机制。
市精神卫生中心应当加强精神障碍患者管理工作,开展严重精神障碍患者病情识别以及日常护理等教育培训,并与相关部门、街道办事处、社区居民委员会等实现信息互通共享,防止精神障碍患者对他人造成伤害。
医疗机构、社区居民委员会、精神障碍患者监护人等应当做好信息采集、医疗诊治、困难救助等服务,保护精神障碍患者及其家庭成员的合法权益。
公安、民政、卫生健康等部门以及街道办事处、社区居民委员会、医疗机构发现严重精神障碍患者,应当及时通报市精神卫生中心。
第四十五条 支持建立社区心理工作室,对生活失意、性格失衡、行为失常以及性格偏执人员、参与邪教活动人员提供心理咨询服务和危机干预。
第四十六条 家庭、学校和社会应当相互配合,加强对青少年法治宣传教育,防止毒品、邪教以及其他不良思想对青少年的影响。
教育部门以及有关部门应当加强专门学校建设和专门教育,做好有不良行为青少年、未成年社区服刑人员的教育矫治和违法犯罪预防工作。
第四十七条 各单位应当将法治宣传教育纳入本单位教育培训范围,并对职工开展多种形式的社会公德、职业道德和家庭美德教育。
第七章 公众参与
第四十八条 市、区组织协调机构应当统筹协调各方力量,组织动员社区居民委员会、股份合作公司、业主委员会、驻社区单位等参与基层平安建设,落实平安建设责任。
市、区组织协调机构应当统筹协调公安、住房建设等相关部门充分发挥物业服务企业在基层社会治理中的作用,引导、鼓励物业服务企业参与平安建设工作。
物业服务企业可以根据相关单位的委托,协助开展巡查、居住登记等方面的工作。
第四十九条 国家机关、企业事业单位、人民团体以及其他社会组织应当依法加强内部治安保卫组织建设。
社区居民委员会应当建立健全治安保卫工作制度,发动社区居民共同做好本社区社会治安相关工作。
第五十条 鼓励市民以“平安卫士”“义警”“平安员”等名义志愿参与平安建设和社会基层治理,协助相关部门维护社会治安秩序。相关部门应当加强对志愿人员的组织、指导和培训。
第五十一条 鼓励社区居民委员会、业主大会以及其他自治组织通过居民守则、业主公约等形式,明确、细化有关平安建设权利义务以及行为守则。鼓励单位和个人在房屋租赁等经营活动中,将有关守则或者公约的相关内容在租赁合同中予以约定。
第五十二条 鼓励市民举报违法犯罪行为、对平安建设工作提出意见和建议。
支持市民勇于同违法犯罪行为做斗争,积极维护社会治安。
第五十三条 充分发挥社会组织积极有序参与平安建设的作用。市、区人民政府可以通过购买服务、提供补助等方式,引导社会组织参与社区禁毒、反邪教、社区矫正、社会帮教、精神障碍患者服务管理等平安建设工作。
第五十四条 新闻媒体应当加强对平安建设工作的宣传,积极报道平安建设工作中的先进事迹和制度措施,营造文明、和谐、安宁的社会氛围。
第八章 考核与奖惩
第五十五条 市组织协调机构应当对区人民政府、有关部门和相关单位平安建设目标责任制的落实情况进行监督、检查和考核。对区人民政府、有关部门的考核纳入市、区绩效考核范围。
区人民政府、有关部门、企业事业单位、人民团体和其他社会组织未达到平安建设目标要求的,不得评为精神文明先进单位,不得授予综合性荣誉称号;其单位主管负责人和直接责任人,不得评为先进个人。
市、区组织协调机构在实施平安建设目标责任制考核时,可以委托第三方机构进行群众安全感、治安满意度等平安建设指标民意调查。公安机关可以组织对相关责任单位防范工作进行技术评价,作为平安建设考核重要依据。
第五十六条 有关单位未依法履行平安建设责任,有下列情形之一的,由市、区组织协调机构根据情节轻重,分别采取通报、约谈、督办等形式进行督导,督促其限期整改:
(一)不重视平安建设,相关工作措施落实不力,基层基础工作薄弱,区域以及系统或者行业内重大安全隐患整改不力,社会矛盾纠纷比较突出的;
(二)在较短时间内连续发生重大刑事案件或者群体性事件、公共安全事件的;
(三)平安建设工作考核评价不合格、不达标的;
(四)对市民反映强烈的社会治安和公共安全问题没有及时采取有效应对措施的;
(五)其他需要督促整改的情形。
第五十七条 有本条例第五十六条所列情形且危害特别严重或者影响特别重大的单位,由市、区组织协调机构按照有关程序建议取消该单位一年内评选综合性荣誉称号的资格和该单位相关负责人评先受奖、晋职晋级的资格。
第五十八条 国家机关、企业事业单位、人民团体及其他社会组织工作人员拒不履行平安建设工作职责或者在平安建设工作中滥用职权、玩忽职守、徇私舞弊的,由其所在单位依法给予处分或者由监察机关依法给予政务处分;涉嫌犯罪的,依法追究刑事责任。
第九章附则
第五十九条 本条例自2020年10月1日起施行,《深圳经济特区社会治安综合治理条例》同时废止。
