Decision of the Standing Committee of the People's Congress of Shenzhen on Fully Prevention and Control of COVID-19 Pandemic in Accordance with the Law to Protect People's Lives and Health深圳市人民代表大会常务委员会关于依法全力做好当前新型冠状病毒肺炎疫情防控工作切实保障人民群众生命健康安全的决定

  For the purpose of thoroughly carrying out the spirit of General Secretary Xi Jinping's important instructions on resolutely winning the battle of COVID-19 pandemic prevention and control, and to fully implement the decisions and arrangements of the CPC Central Committee, provincial-level CPC Committee and municipal-level CPC  Committee, pandemic prevention and control has been taken as the top priority at present and the strictest measures of prevention and control have been taken within Shenzhen Municipality. While every effort has been made to prevent and control COVID-19 pandemic, safety and health of citizens has been effectively guaranteed, and the ability to control and govern the pandemic on all fronts has been enhanced according to the law, with the aim of providing legal guarantees for pandemic prevention and control. In accordance with Law of the People's Republic of China on Prevention and Treatment of Infectious Diseases, Emergency Response Law of the People's Republic of China, Law of the People's Republic of China on the Protection of Wildlife, Law of the People's Republic of China on Animal Epidemic Prevention, Regulations on Response to Public Health Emergencies, and the Level-1 response to the major public health emergencies in Guangdong Province and in light of Shenzhen's actual circumstances, this Decision is hereby made:

  1. The leadership of the CPC shall be upheld, prevention and control of COVID-19 in a law-based, scientific, precise, orderly and transparent manner shall be conducted, every effort to organize the most qualified team and mobilize all citizens and effective measures shall be made to build the most stringent lines of defense across society in line with strict requirements.

  2. Municipal, district and street command institutions of pandemic prevention and control shall be established during the period. Municipal and district command institutions of pandemic prevention and control shall issue and implement decisions and orders regarding pandemic prevention and control on behalf of the government at the same level. Municipal command institutions shall uniformly lead, organize, coordinate and command the work throughout the municipality. District and street command institutions shall organize and implement pandemic prevention and control within their jurisdictions.

  Administrative departments of health, development and reform, emergency response management, education, science and technology, industry and information technology, public security, civil affairs, finance, human resources and social security, transportation, commerce, ports, culture, radio, television, tourism and sports, market regulation, customs and other administrative departments shall step up efforts to effectively prevent and control the pandemic under the leadership and command of the command institutions at the same level and above.

  3. Municipal and district command institutions of pandemic prevention and control may take contingency measures as per laws, issue relevant decisions and orders, and formulate and release work requirements with regard to medical treatment, health prevention, quarantine and observation, material security, transportation, community management, market management, place management, production and operation, labor security, urban environment, etc.

  Street command institutions shall conscientiously implement contingency measures, decisions and orders within their jurisdictions, and organize community service centers, community healthcare centers, community police offices and others to carry out pandemic prevention and control.

  4. Municipal and district command institutions of pandemic prevention and control shall formulate prevention and control policies as the case may be, and have patients with suspected or confirmed COVID-19 infection and their close contacts, asymptomatic carriers, those coming from any area where the outbreak occurs and other related personnel receive treatment in isolation, undergo centralized quarantine or home quarantine. Residential areas, workplaces, residential buildings and quarters of COVID-19 patients shall be managed in isolation, and communities, urban villages and parking lots in the jurisdiction shall be subject to closed-off management.

  Relevant departments and primary-level community organizations shall provide necessary life support and health management for patients receiving treatment in isolation and those under centralized quarantine or home quarantine, as well as persons living together with them and residents in isolation management areas. Property management enterprises or institutions concerned shall provide cooperation.

  Relevant medical institutions, disease prevention and control agencies or street command institutions of pandemic prevention and control shall issue documents of proof to the patients who have been cured and are discharged from designated medical institutions, and their close contacts, as well as those coming from somewhere the outbreak occurs and other related personnel after termination of quarantine. With the documents, they may return to school or work, get employed, go to the public places, use public transport, etc.

  No entity or individual shall refuse and discriminate against personnel involved in pandemic on the grounds of pandemic prevention and control.

  5. During the pandemic prevention and control, municipal and district command institutions of pandemic prevention and control may take prevention and control measures as necessary, including but not limited to suspending work, business, classes, closing or limiting the use of places vulnerable to the pandemic, stopping gathering activities or production and business activities that can spread the virus. Administrative departments of public security, health, transportation, emergency management and other administrative departments shall be encouraged to set up pandemic checkpoints, to screen, monitor, keep track of and govern the personnel and vehicles passing by.

  6. Municipal and district command institutions of pandemic prevention and control may requisition from entities or individuals within their jurisdiction the equipment, facilities, sites, transportation facilities and other materials required for pandemic prevention and control, and require relevant enterprises to produce and supply preventative materials and daily necessities. Municipal and district command institutions shall issue emergency requisition certificates to the relevant entities or individuals and return the requisitioned supplies to them or compensate them in accordance with law. Municipal and district command institutions shall intensify efforts to provide preventative materials for front-line medical staff and patients under treatment.

  7. Organs, enterprises, public institutions, social organizations and other employers at all levels throughout the municipality shall fulfill their due responsibilities for prevention and control of the pandemic. Standard working environment and conditions shall be established and provided to employees, key personnel, groups, places and facilities shall be strictly controlled, and employees shall be trained to better protect themselves and others.

  Administrative institutions of all kinds of industrial parks and development zones shall effectively carry out all the work related to pandemic prevention and control. Agencies of public service including aviation, railroads, rail transport, long-distance passenger land transport, water transport, urban public transport shall take effective measures including but not limited to disinfection, ventilation, temperature monitoring and population flow blocking measures to prevent and control the spread of the COVID-19 in airports, bus stations, docks, service areas, etc.

  8. After the suspension period ends, all employers shall clarify the roles and responsibilities for pandemic prevention and control internally before resuming work and production, establish a corresponding management system as per rules, formulate emergency plans and work measures, and strength cleaning and disinfection of office premises and supply of protective materials, etc. Besides, they shall effectively implement prevention mechanisms, properly identify employees, ensure sufficient facilities and materials, effectively exercise internal management, and report to the pandemic prevention and control command institution within the jurisdiction as required before resuming work and production.

  9. The timing and conditions for reopening of schools at all levels shall be determined by the municipal pandemic prevention and control command institution. Municipal and district command institutions of pandemic prevention and control shall strengthen the guidance, coordination and inspection of the prevention and control work at various schools.

  10. People who live, work, study, travel and engage in other activities in Shenzhen should raise their awareness of law compliance, consciously comply with laws, regulations and relevant provisions on pandemic prevention and control, and fulfill the following obligations:

  (1) Strictly complying with the requirements of wearing masks and other protective outfits when going to the public places and using public transport (including taxi);

  (2) Cooperating with relevant government departments, disease prevention and control agencies, and medical institutions to carry out epidemiological investigation, testing, sample collection, centralized isolation and treatment, centralized quarantine or home quarantine, etc.;

  (3) Reporting personal health conditions, travel history, close contact history and other information as per rules;

  (4) Complying with laws, regulations and other provisions on pandemic prevention and control.

  11. Municipal command institution of pandemic prevention and control shall establish joint prevention and control mechanisms with the Guangdong-Hong Kong-Macao Greater Bay Area and related cities to enhance information exchange and collaboration, and make concerted anti-pandemic efforts.

  Command institutions of pandemic prevention and control at all levels shall establish an information exchange and reporting system to promote information sharing.

  The municipal health department shall promptly make public pandemic-related information as well as early warning information, etc.

  12. Municipal and district people's governments and their relevant departments shall abide by the principle of "Anyone who acquired information shall be responsible for information management, and anyone who is responsible for the act causing the information leakage shall undertake responsibilities", to strengthen the management of information on related personnel involved in the pandemic. In the case of disclosure of personal information for pandemic prevention and control purpose, the name, address, contact number, company and other personal privacy information shall be encrypted.

  No entity or individual shall ask for, disseminate, or release personal information unrelated to pandemic prevention and control, disclose private information of related personnel, or use such information for any purpose unrelated to pandemic prevention and control.

  13. During pandemic prevention and control, disease prevention and control agencies shall carry out epidemiological investigations of patients with confirmed and suspected COVID-19 infection, asymptomatic carriers, and their close contacts, as well as other relevant personnel; in case of a need for collaborative investigation, public security organs and other authorities shall cooperate to provide relevant personnel information by means including but not limited to big data comparison.

  If a patient with confirmed COVID-19 infection, an asymptomatic carrier, a patient with suspected COVID-19 infection, a close contact of the person mentioned before, a person coming from any area where the outbreak occurs or any other related personnel refuses to accept treatment in isolation, centralized quarantine or home quarantine, public security organs may take compulsory measures in respect of isolation and quarantine.

  14. The market regulation department shall strengthen guarantee, regulation and administrative enforcement for market supply, ban live poultry trading and wild animal trading activities, fully promote cold chain sales, resolutely combat counterfeit and shoddy products, and take firm actions in investigation and punishment on price gouging, hoarding and other illegal acts in accordance with the law.

  15. Public security organs shall strictly crack down on those who refuse to comply with relevant decisions or orders, or engage in production and sales of counterfeit masks, protective clothing, goggles, medical care materials and other medical supplies, endanger public safety by dangerous means, endanger the personal safety of medical personnel, interference with the work of medical institutions or commit other types of illegal and criminal acts, to secure the smooth operation of pandemic prevention and control measures.

  16. The peoples courts and peoples procuratorates shall actively perform their duties to deal with civil and commercial disputes related to pandemic prevention and control, strictly punish the criminal acts that hinder the prevention and control work, and provide judicial safeguards in a timely manner.

  17. Municipal pandemic prevention and control command institution may designate departments of health, market regulation and other departments to take charge of donations regarding pandemic prevention and control, and set forth quality requirements and distribution mechanism for donations, to guarantee timely delivery and utilization of donations. In case that entities or individuals make donations directly to relevant departments, medical and health institutions or other pandemic prevention and control entities, the recipients shall report to the government designated agencies for record. The Red Cross Society and other charitable organizations shall carry out donation work pursuant to the law.

  Donation recipients shall make public the receipt and distribution of donations, to ensure that the whole process of receipt of funds, expenditure, contribution and supervision of the donation is open, transparent, efficient and orderly.

  18. Municipal and district people's governments shall make full use of the digital government service network to strengthen coordination of government service, optimize government service process, and provide government services online.

  During the period of pandemic prevention and control, the municipal and district peoples governments and relevant departments may streamline government procurement procedures for emergency prevention and control materials as appropriate to improve procurement efficiency and guarantee the supply.

  19. Municipal and district peoples governments shall formulate and implement effective measures to advance reform, pursue development and ensure stability in a coordinated way, and provide policy support for enterprises suffering production and operation hardship due to the pandemic to help such enterprises to get through the hard time, thus maintaining social stability and orderly production as well as stable economic development.

  Municipal and district peoples governments shall provide appropriate subsidies to the staff of organs, enterprises, institutions, peoples organizations, and social organizations at the front line of the battle against COVID-19. Subsidy standards shall be determined by the municipal finance department jointly with the municipal department of human resources and social security.

  20. Command institutions of pandemic prevention and control at all levels and relevant entities shall make full use of media platforms to vigorously publicize the Law of the People's Republic of China on Prevention and Treatment of Infectious Diseases, Regulations on Response to Public Health Emergencies, relevant provisions on pandemic prevention and control and knowledge of pandemic prevention and control in flexible and diverse ways, so as to raise citizens awareness of understanding and cooperation, create a strong atmosphere of universal participation, society-wide efforts to prevent and control the pandemic, co-construction and sharing, gather strong forces to fight against COVID-19 pandemic with everyones efforts directed to one goal, and maintain social stability together.

  21. Municipal and district peoples governments shall commend and award  entities and individuals making outstanding contributions to pandemic prevention and control; hold accountable to anyone who fails to implement the decisions and arrangements of the CPC Central Committee, and CPC committees at provincial and municipal level, disobeys unified command and dispatch, upholds a silo mentality, shirks responsibility and has superficial conducts; and punish those with dereliction of duty according to the discipline and law.

  22. Any entity or individual who violates relevant laws and regulations, refuses to implement the decisions and orders of municipal and district command institutions of pandemic prevention and control, does not cooperate with competent agencies in investigation, testing, isolation, quarantine, etc. according to law, intentionally conceals, fabricates or leaks relevant information, or commits other illegal acts that hinder the prevention and control work, shall be punished pursuant to the Law of the People's Republic of China on Prevention and Treatment of Infectious Diseases, Emergency Response Law of the People's Republic of China, Law of the People's Republic of China on Penalties for Administration of Public Security, and Regulations on Response to Public Health Emergencies, etc.; anyone who commits a crime shall be held criminally liable and his or her record of illegal act shall be included in the public credit information system, alongside punishment according to law.

  The standing committees of municipal and district peoples congresses shall strengthen supervision over the pandemic prevention and control work in accordance with the law, and urge related parties to implement prevention and control measures; deputies at all levels shall actively and jointly make efforts in pandemic prevention and control, and take the lead to win the battle against COVID-19.

  This Decision shall come into force as of the date of promulgation, and shall be terminated on the date to be announced by the Standing Committee of the Peoples Congress of Shenzhen Municipality.
