Chapter I General Provisions
Article 1 To optimize the development environment of the digital economy industry and promote its high-quality development, these Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and in light of the actual needs of Shenzhen Special Economic Zone.
Article 2 These Regulations shall apply to relevant activities to promote the development of the digital economy industry within Shenzhen Special Economic Zone.
The digital economy industry as mentioned in these Regulations refers to all kinds of industries where digital technology are effectively utilized to significantly enhance efficiency and the economic structure based on the modern information network, with data resources as the key production element.
Article 3 To promote the digital economy industry, the innovation-driven, clustered development, application-oriented, open, cooperative, safe, controllable, inclusive and prudent principles shall be followed.
Article 4 Municipal and district people’s governments shall strengthen their leadership over the promotion of the digital economy industry, incorporate the digital economy industry into their national economic and social development plans and determine the priorities of the industry. A sound leadership and coordination mechanism of the digital economy industry shall be established to make overall arrangements for the development of the industry and timely solve major issues.
Article 5 The municipal authorities of industry and information technology shall promote, coordinate and supervise the development of the digital economy industry in Shenzhen Municipality.
The municipal authorities of cyberspace, development and reform, scientific and technological innovation, public security, finance, human resources and social security, planning and natural resources, market supervision, statistics, government service data administration, services for small and medium-sized enterprises (SMEs), and communication management shall promote the digital economy industry within their respective duties. The municipal authorities of various industries shall coordinate and promote the integrated development of the digital economy industry and their respective industries.
Article 6 The municipal authorities of industry and information technology shall, in conjunction with relevant authorities, formulate relevant plans for the development of the digital economy industry in Shenzhen Municipality according to national economic and social development plans and the overall plan for national land and space, issue them and organize their implementation after obtaining the approval of Shenzhen Municipal People’s Government.
Article 7 The municipal statistics authorities shall establish statistics monitoring mechanisms for the digital economy industry, strengthen the statistical investigation, monitoring and analysis of the digital economy industry, and try to establish systems for industrial digital evaluation indicators and for the statistical accounting of data elements.
Article 8 Shenzhen Municipality shall encourage and support enterprises, higher learning institutions, scientific research institutions, academic groups, industry associations, industry alliances, foundations, new think tanks and individuals to jointly promote the development of the digital economy industry.
Chapter II Infrastructure
Article 9 Shenzhen Municipal People’s Government shall make an overall plan to advance the construction of the following digital infrastructure:
1.Information infrastructure generated as new-generation information technologies evolve, such as communication network infrastructure, computing infrastructure and digital technology infrastructure;
2.Integrated infrastructure formed by the digital, networked and intelligent upgrading of traditional infrastructure such as manufacturing, transport, energy and municipal administration infrastructure;
3.Innovative infrastructure for people’s well-being that supports scientific research, technological development and product development.
Article 10 The municipal authorities of development and reform, industry and information technology, scientific and technological innovation, and communication management shall, together with relevant authorities, formulate plans for the construction of digital infrastructure in Shenzhen Municipality according to the development and application of local major industries. The principle of green development shall be upheld. The plans shall coordinate with other relevant infrastructure plans.
Article 11 The municipal authorities of industry and information technology and the municipal communication management authorities shall support the construction of new-generation high-speed information network and mobile communication network, build communication network infrastructure that covers communication networks such as moderately advanced communication networks, smart private networks and satellite Internet, and coordinate the intensive construction of communication network infrastructure and the upgrading of the public wireless local area network (LAN) in Shenzhen Municipality.
The municipal authorities of industry and information technology shall coordinate the construction and administration of comprehensive intelligent facilities such as multi-functional smart poles in Shenzhen Municipality and hand them over to the operation entity for unified operation and maintenance after completion.
Article 12 The municipal authorities of development and reform, industry and information technology, scientific and technological innovation, and communication management shall coordinate the planning and construction of computing infrastructure, encourage different entities to join this process and build a coordinated development pattern of cloud computing, edge computing, intelligent computing and supercomputing supported by data centers.
These authorities shall share computing resources and infrastructure dedicated for digital economy and strive to build computing power trading platforms to promote the efficient utilization and optimal allocation of computing resources.
The municipal development and reform authorities and the municipal authorities of industry and information technology shall formulate green development standards for data centers, and comprehensively guide data centers across Shenzhen Municipality in energy conservation assessment and upgrading. All district people’s governments shall promote the effective implementation of such standards.
Article 13 The municipal authorities of development and reform, industry and information technology, and scientific and technological innovation shall make overall plans to promote the application of new technologies such as artificial intelligence (AI), blockchain, cloud computing and edge computing, support the construction of basic platforms such as new-generation open and innovative AI platforms, underlying blockchain platforms and industry cloud platforms, and establish advanced supporting systems for digital technology infrastructure.
Article 14 The municipal authorities of industry and information technology and the municipal communication management authorities shall promote the construction of industrial Internet infrastructure, facilitate the in-depth integration and innovation of new-generation information technology and manufacturing, and create a sign analysis ecosystem. Industrial Internet platforms for electronic information, automobiles and intelligent equipment shall be open and upgraded to promote the construction of national industrial Internet platforms.
Article 15 The municipal authorities of industry and information technology, transport, public security and communication management shall formulate standards for intelligent transport cooperative communications that can be applied to automatic driving, promote the digital construction and renovation of road infrastructure and traffic signs, improve the integration and connection of roadside equipment with road infrastructure and intelligent control facilities, coordinate the construction of vehicle networking, expand vehicle networking and set up a low-altitude air perception system for unmanned aerial vehicles (UAV).
Article 16 The municipal development and reform authorities and the municipal authorities of industry and information technology shall strengthen the construction of comprehensive energy networks, promote the in-depth integration of energy and information infrastructure, and build safe, reliable, interconnected, open and shared smart energy ecosystems. Digital smart grids shall also be constructed to promote the integration of technologies such as the smart grid with distributed energy and energy storage, bolster the construction of charging, replacement and energy storage networks for new energy vehicles (NEVs), and realize the standardized, networked and intelligent administration of energy storage equipment and charging piles.
Article 17 Shenzhen Municipal People’s Government shall accelerate the digital transformation of public buildings, facilities and other infrastructure related to public security, public administration, public services and social governance, so as to realize data interconnection and data sharing.
The municipal authorities of government service data administration shall, together with the municipal planning and natural resources authorities and the municipal housing and construction authorities, build visual urban space digital platforms and unified intelligent perception platforms based on Internet of Things (IoT) in Shenzhen Municipality with digital technology, so as to collect, process and transmit perceived information from various fields in real time, jointly build a digital twin city with accurate mapping and virtual and real interaction, and improve intelligent urban governance.
Article 18 The municipal development and reform authorities and the municipal authorities of scientific and technological innovation shall build shared systems for innovative infrastructure, make overall plans to promote the construction of innovative infrastructure featuring in-depth industry-university-research integration, give play to the basic, public-benefit and leading role of innovative infrastructure platforms for the digital economy industry and provide infrastructure for innovation at source, technological breakthrough and key technology innovation.
Chapter III Data Elements
Article 19 Shenzhen Municipal People’s Government shall strengthen the integration and protection of data resources, advance the sharing of public data according to the law, promote the independent and orderly flow of data elements, build the data element market at a faster pace and improve the efficiency of data element allocation.
Article 20 Shenzhen Municipal People’s Government shall guide entities and individuals such as enterprises and social organizations to share their data resources by encouraging investment in emerging industries, introducing social capital, innovating application models and enhancing cooperation and exchanges.
Enterprises, social organizations and other organizations and individuals shall be encouraged to provide various data services and data products through public data opening platforms.
Article 21 The municipal authorities of government service data administration shall, together with relevant authorities, promote the in-depth integration of various types of data and facilitate the integration and application of public data and social data in health, social security, transport, science and technology, communications, enterprise investment and financing and inclusive finance.
Support will be given to all kinds of industrial enterprises, Internet platform enterprises, scientific research institutes, higher learning institutions and social organizations to cooperate with the municipal authorities of government service data administration in the construction of data convergence and integration platforms.
Article 22 Shenzhen Municipal People’s Government shall balance safety and the development of the digital economy. Systems for network security, data security and personal information protection shall be established and improved according to the law.
Data processors shall establish and improve data security management systems according to the law to fulfill their obligations of protecting data security. They shall not endanger national security or public interests, or harm the legitimate rights or interests of individuals or organizations.
Article 23 Market entities shall be encouraged to strengthen data opening and data circulation and promote the development of data elements as resources, assets and capital.
Data obtained by market entities in a lawful manner shall be protected by the law. Data products and services formed by lawful data processing by market entities may be traded in accordance with the law, except as otherwise provided by laws or regulations or agreed by relevant parties.
Article 24 Shenzhen Municipal People’s Government shall organize and carry out research on the basic theory and administration model of data assets, promote the establishment of a data asset evaluation mechanism, data asset pricing indicators and data value evaluation criteria.
Article 25 Shenzhen Municipal People’s Government shall promote the establishment of data trading platforms in accordance with the law, formulate trading systems and rules, cultivate products and scenarios for high-frequency and standardized trade, and promote the innovation of trading models such as cross-border data circulation and data asset securitization.
Article 26 The supplier and buyer of data products and services can negotiate for cooperation, sign a contract and settle payments through the data trading platform. Contracts signed through other means can be filed on the data trading platform.
Data trading platforms shall be encouraged to cooperate with various financial, intermediary and other service agencies to form a comprehensive data trading service system that includes rights and interests confirmation, information disclosure, asset evaluation, payment clearing and settlement, guarantee, dispute resolution and other services.
Article 27 The construction and development of third-party service agencies for data registration, data value evaluation, data compliance certification and credit evaluation of transaction entities shall be encouraged. A data element market service system shall also be established and improved. Specific measures shall be formulated by the municipal development and reform authorities in conjunction with relevant authorities.
Article 28 The municipal authorities of development and reform, market supervision and government service data administration shall strengthen the construction of a social credit system for the data element market, establish a mechanism for discovering abnormal transactions and warning risks, and ensure that the data circulation process can be traced and security risks can be prevented.
Article 29 The municipal financial authorities shall try to establish an accounting system for data production elements, clarify accounting processing and statement items such as the scope, type, initial measurement, subsequent measurement and asset disposal, accurately and comprehensively reflect the value of data elements, promote the capitalized accounting of data elements and incorporate them into the national economic accounting system.
Chapter IV Technological Innovation
Article 30 Shenzhen Municipal People’s Government shall strive to promote innovation-driven development and the basic and applied research on the fields related to the digital economy, build a digital technology innovation platform, improve the construction of rules, standards and evaluation systems, support enterprises in the independent innovation of key and core digital technology, and promote the deployment of digital scientific and technological outcomes.
Article 31 Municipal and district people’s governments, the municipal authorities of scientific and technological innovation and the municipal authorities of industry and information technology shall collaborate with higher learning institutions, scientific research institutions and enterprises to promote the application of key and core digital technology in high-end chips, basic and industrial software, AI, blockchain, big data, cloud computing and information security.
Shenzhen Municipal People’s Government can organize key and core digital technology research projects involving public interests through competitive selection and mandatory assignment.
Article 32 The municipal authorities of development and reform, scientific and technological innovation, and industry and information technology shall accelerate the construction of high-level scientific research and industrial conversion platforms for the digital economy and support the construction of key laboratories, engineering laboratories, manufacturing innovation centers, engineering technology research centers and enterprise technology research centers for future networks and high-end software.
The municipal authorities of development and reform, scientific and technological innovation, and industry and information technology shall promote industry-university-research cooperation in the digital economy industry, support scientific research institutes and universities in building technological innovation alliances, scientific and technological innovation bases, doctoral workstations and postdoctoral research stations with enterprises, strengthen the optimal allocation of scientific research personnel and resource sharing, and promote the R&D, systematic integration and engineering application of key generic technologies.
Scientific and technological innovation platforms and major scientific and technological infrastructure purchased or constructed with fiscal funds or state-owned capital shall form scientific, professional and efficient management modes and be open to the public in a safe and standardized manner.
Article 33 The municipal authorities of standardization, industry and information technology, and scientific and technological innovation shall work together to initiate related standards of the digital economy.
Scientific research institutions, industry associations, industry alliances and enterprises shall be encouraged to join the formulation of international rules, international standards, national standards, industry standards and local standards for the digital economy and independently formulate group or corporate standards for the digital economy.
Municipal and district people’s governments and the municipal market supervision authorities shall support the development of related inspection and testing certification agencies and standard testing and verification platforms, and strengthen their testing, verification, standard formulation, technical training and consulting for digital technology and equipment.
Chapter V Industrial Agglomeration
Article 34 The municipal authorities of development and reform, scientific and technological innovation, industry and information technology, culture, radio, television, tourism and sports shall promote the clustered development and upgrading of the digital economy industry in relevant fields and design the layout of industrial clusters for digital economy in their respective fields according to industrial characteristics and regional advantages, so as to avoid homogenized and disorderly competition and low-level redundant construction.
Article 35 Shenzhen Municipal People’s Government shall coordinate district people’s governments in planning and constructing characteristic industrial parks for digital economy, promote the construction of digital infrastructure and comprehensive industrial supporting services in various industrial parks, and encourage the parks to grant benefits such as rent reduction or exemption to digital enterprises settled in the parks.
Industrial parks shall be encouraged to build smart parks, promote data sharing based on urban big data centers and improve intelligent services such as public services, property management, industrial agglomeration, personnel services and collaborated innovation. Development service providers for smart park systems and industry associations shall be encouraged to formulate standards for smart park construction and management, build integrated management platforms for smart parks featuring whole-process perception and build smart demonstration parks.
Article 36 The municipal authorities of development and reform, scientific and technological innovation, industry and information technology, culture, radio, television, tourism and sports shall summarize the needs of relevant supplementary chains of the core industrial chain and supply chain in the digital economy industry and organize targeted investment promotion together with the municipal commercial authorities and district people’s governments.
Article 37 Shenzhen Municipal People’s Government shall formulate targeted policies and measures for different types of enterprises engaged in the digital economy industry, encourage ecology-oriented digital enterprises to share core technologies such as basic hardware and software and superior resources, build ecological incubation platforms, lead micro, small and medium-sized enterprises (MSMEs) to jointly build an ecosystem, and finally form a digital economy industry ecology in which MSMEs and large enterprises cooperate and co-exist.
Article 38 The municipal authorities of industry and information technology, scientific and technological innovation, and commerce shall work with industry alliances, industry associations and park operation and management agencies to establish service systems for SMEs’ digital transformation and provide services related to digital transformation such as consulting, training, scheme design, evaluation, inspection and financing matchmaking, so as to reduce the costs of SMEs’ digital transformation.
Chapter VI Application Scenarios
Article 39 Municipal and district people’s governments shall build digital urban governance platforms for urban operation monitoring and analysis, coordinated command and dispatch, and joint disposal, and innovate urban governance means, governance models and governance concepts with digital technology, so as to realize scientific, refined and intelligent urban operation and administration.
The municipal authorities of government service data administration shall coordinate other authorities of public administration and service to actively and steadily open application scenarios to market players under the premise of data security.
Social organizations, enterprises and the public shall be encouraged to join the design of application scenarios for urban governance and people’s well-being. The municipal authorities of government service data administration shall timely solicit designs of application scenarios to promote urban co-construction and co-governance.
Article 40 The municipal authorities of government service data administration shall promote the comprehensive application of digital technology in government services, build an integrated government service platform and a mobile government service platform, and promote coordinated handling of applications online and offline for public services and public services.
Article 41 The municipal authorities of industry and information technology shall promote the innovative development of the industrial Internet, support the construction and application of cross-industry, cross-field, industry-level and professional industrial Internet platforms, provide digital solutions to the application scenarios of the manufacturing industry, facilitate the integrated development of digital technology and manufacturing, and accelerate the digital and intelligent transformation and high-quality development of the manufacturing industry.
Article 42 The municipal authorities of transport and commerce shall promote the application of digital technology in logistics, convention, exhibition and other service industries, boost the development of new business forms and new models, innovate service items and models, improve service quality and efficiency, and tap new potential of the digital economy industry.
Article 43 The municipal authorities of transport and public security shall make overall plans for the construction of an intelligent transport system, promote the integrated development of intelligent transport infrastructure with transport services, energy and communication network, build traffic information infrastructure and comprehensive traffic information hub, and promote the digitalization of all elements of the urban road transport system.
Article 44 The municipal authorities of health and market supervision shall support the digital transformation of medical and health institutions and promote smart medical services for the convenience of the local community. They shall make efforts to facilitate the application of digital technology in the R&D of drugs, medical equipment and medical technology, medical inspection and testing, clinical diagnosis assisted decision-making, telemedicine, personal health management, public health event prevention, hospital management, health supervision and law enforcement, and disease prevention and intervention.
Article 45 The municipal authorities of culture, radio, television, tourism and sports shall develop digital cultural products based on the cultural resources collected by cultural relics organizations and improve the digital development of museums, libraries, art galleries, cultural centers and other cultural venues.
The municipal authorities of culture, radio, television, tourism and sports shall support the construction of smart tourism scenic spots, encourage the development of digital tourism products, provide smart tourism services, cultivate new models of network experience and consumption such as cloud tourism and promote the integrated development of tourism online and offline.
The municipal authorities of culture, radio, television, tourism and sports shall promote the construction of a digital system for national fitness, boost the digital transformation of sports venues and facilities, and improve the digital service system for training, competitions and citizen fitness.
The municipal authorities of culture, radio, television, tourism and sports shall make overall plans to promote the innovative development of the digital creative industry, support creative design, digital cultural equipment, film and television production, and animation game industries, as well as high-quality original digital works, build creative digital incubation and service platforms, and accelerate the integration of digital creativity with public services, such as cultural tourism products and education.
Article 46 The municipal authorities of commerce, market supervision, and industry and information technology shall promote the innovative application of digital technology in the catering industry, support the development of new technologies, new formats and new models for digital catering, support the construction of Internet platforms for the catering industry and promote data sharing services for the traceable food supply chain. Efforts shall also be made to promote the construction of intelligent information management systems and numerically controlled cooking facilities.
The municipal market supervision authorities shall strengthen the construction of digital supervision systems for food safety of catering entities and jointly monitor key places such as school canteens online with the education authorities.
Article 47 Municipal and district people’s governments and the authorities of local financial supervision shall promote the digital transformation and upgrading of the financial industry, the construction of scientific and technological innovation platforms for digital finance, and technological innovation for digital finance. A financial technology industry cluster shall be set up. Digital financial innovation that complies with laws and regulations shall be encouraged. Efforts shall be made to promote the application of digital RMB in accordance with national regulations, develop new financial business forms such as inclusive digital finance, supply chain finance and green finance, improve the digital financial system that accurately serves MSMEs, and explore innovative financial services such as data asset pledge financing, insurance, guarantee and securitization.
Article 48 The municipal education authorities shall, together with relevant authorities, integrate social resources such as digital libraries, digital museums, digital science and technology museums, and promote the co-construction, sharing, opening and circulation of educational data and digital teaching resources.
The municipal education authorities shall promote the construction of smart campus and smart classroom, explore mixed, cooperative, experiential and inquisition-style teaching with new technologies, innovate the demonstrative application of education scenarios according to the characteristics of different education patterns and promote digital education.
Article 49 The municipal commercial authorities shall incorporate high-quality digital products developed and produced by the enterprises in Shenzhen Municipality into the Catalog of Characteristic Products in Shenzhen Municipality, and support and promote qualified products.
The municipal commercial authorities shall promote the digital transformation of commerce, expand e-commerce functions and develop new business forms for e-commerce.
The municipal commercial authorities shall coordinate with the municipal market supervision to promote the development of cross-border e-commerce, encourage cross-border e-commerce operators to apply digital technology in the innovation of service models, promote the connection of the cross-border e-commerce system with the digital systems of customs, finance, taxation and port authorities and comprehensive bonded zones, and ensure a favorable environment for the development of cross-border e-commerce.
Article 50 Shenzhen Municipal People’s Government shall realize information accessibility at a faster pace. For frequent matters and service scenarios such as urban governance, government services, transport, medical care, culture, sports, catering, finance, education and product sales, digital technology shall be used to provide suitable accessible products and services, improve supporting services and promote the equal participation of the whole society in digital life.
Chapter VII Openness and Cooperation
Article 51 Shenzhen Municipal People’s Government shall deepen international cooperation in the digital economy industry, promote comprehensive cooperation in data governance and circulation, personnel exchange and training, technical cooperation, innovation and entrepreneurship, gather world-class innovation elements, explore policies and rules in line with international ones and ensure a favorable international business environment for the deployment of cross-border scientific and technological outcomes and the incubation of application forms.
Article 52 Shenzhen Municipal People’s Government shall fully utilize the advantages of the digital economy industry in gathering and stimulating the development of resources, strengthen cooperation with the digital economy industry in other regions, attract outstanding enterprises from other municipalities to set up international headquarters, headquarters in Guangdong-Hong Kong-Macao Greater Bay Area (GBA) and regional headquarters in Shenzhen Municipality, and encourage outstanding enterprises in Shenzhen Municipality to strengthen industrial layout and market development.
Article 53 Shenzhen Municipality shall promote the coordinated development of the digital economy in the GBA, collaborate with other cities in the GBA to build big data centers in the GBA, guide the intensive, large-scale and green development of data centers, promote the intensive and service-oriented innovation of computing, data and application resources, and fully support the circulation and convergence of data elements and industrial digital upgrading in the GBA.
Article 54 Shenzhen Municipality shall encourage GBA cities to strengthen the construction of data standardization systems in the GBA and jointly establish basic standards and norms such as the data resource catalog, basic database, subject database, theme database, data sharing, data quality and security management for regional data sharing, so as to promote data resources sharing and utilization.
Article 55 Shenzhen Municipality shall promote the construction of data sharing and exchange platforms in the GBA to support data sharing, business collaboration and scenario application in the GBA and promote effective data flow, development and utilization.
Article 56 Shenzhen Municipality shall promote cross-regional mutual recognition and interoperability of digital certification systems and electronic certificates in GBA cities and support cross-regional collaboration in government services and urban operation and administration.
Article 57 Shenzhen Municipal People’s Government shall encourage local enterprises to actively integrate into the global digital economy industry, set up overseas production and R&D bases, and establish global marketing networks and industrial chain systems.
The municipal commercial authorities shall, together with the municipal authorities of development and reform, scientific and technological innovation, and industry and information technology, build international risk warning platforms for the digital economy industry and provide early warning services for enterprises that are exploring overseas markets.
Article 58 Shenzhen Municipal People’s Government shall support ecology-oriented digital enterprises in initiating the establishment of international industry and standard organizations, attract international digital industry and standard organizations to relocate to or set up branches in Shenzhen Municipality, and encourage local enterprises and other organizations to join the formulation of international industry standards.
A comprehensive supervision system for international industry and standard organizations shall be established to simplify registration requirements and processes and administer digital organizations in a classified manner.
Article 59 The municipal commercial authorities shall, together with the municipal SME service authorities, encourage enterprises to join high-end digital exhibitions and forums at home and abroad and explore domestic and foreign markets.
The municipal authorities of development and reform, scientific and technological innovation, and industry and information technology shall support digital exhibitions, competitions and forums in Shenzhen Municipality and build platforms for digital demonstration, trading, exchange and cooperation.
Article 60 The municipal authorities of Internet information, industry and information technology, and communication management shall, under national and industrial systems for safe cross-border data transmission, work with relevant authorities in safe cross-border data transmission and cross-border communication, improve cross-border communication transmission and international data communication services, and build Shenzhen Municipality into an international data hub.
Chapter VIII Support and Guarantee
Article 61 Shenzhen Municipal People’s Government shall promote the integrated construction of the digital economy, digital government and digital society. Policies and measures shall be improved for government services, finance, taxation, finance, personnel, intellectual property, land supply, electricity access and facility protection so as to ensure the healthy development of the digital economy industry.
Article 62 Fiscal funds and state-owned capital may be used to establish investment funds for the digital economy industry at the municipal and district levels. Such funds can guide social capital to key enterprises and major projects in the digital economy industry.
Article 63 The municipal authorities of local financial supervision shall improve the investment and financing service system, broaden financing channels for market players engaged in digital economy, encourage financial institutions to meet the development needs of digital economy, innovate financial services, develop financing products and support the development of the digital economy industry.
Article 64 The municipal communication management authorities shall actively undertake the examination and approval tasks assigned by the provincial communication management authorities and optimize examination and approval services such as value-added telecommunications business license, filing of non-operational Internet information services, new telecommunications business, use and adjustment of telecommunications network code numbers, establishment of providers of the registration service for Internet domain names and foreign investment in telecommunications business.
Article 65 Shenzhen Municipal People’s Government or the party authorized by it may, in accordance with relevant provisions of the national catalogue of centralized procurement and the actual needs of Shenzhen Municipality, include digital products and services such as cloud computing, big data and AI in the catalogue of centralized procurement.
The municipal authorities of industry and information technology shall regularly release the guidance catalogue of first-edition software and the first unit (set) of major technical equipment under application promotion to support the promotion and application of digital products.
Article 66 The municipal authorities of talent affairs, human resources and social security shall strengthen the training of key and core technical personnel for the digital economy industry and establish an evaluation mechanism for selecting professionals who can support the development of the digital economy industry.
The municipal education authorities shall guide and urge local higher learning institutions and vocational schools to offer programs and courses and train research and applied professionals for the digital economy industry.
It shall be encouraged to set up training institutions for the digital economy industry with social capital, so as to train relevant personnel that meet the development needs of the digital economy industry.
Article 67 The municipal authorities of commerce, human resources and social security, and industry and information technology shall strengthen the guidance over employment services under new business forms of the digital economy industry and actively explore flexible and diverse employment modes, such as one worker to take up for multiple posts at the same time. Efforts shall also be made to formulate and improve regulations on working hours, remuneration and insurance for employees in new business forms of the digital economy industry, and protect the legitimate rights and interests of employees engaged in new business forms of the digital economy industry.
Article 68 Shenzhen Municipality shall promote the construction of a system for rapid intellectual property protection, improve regional and departmental cooperation mechanisms for intellectual property, strengthen the protection of digital intellectual property and crack down on intellectual property infringements according to the law.
Article 69 Shenzhen Municipal People’s Government shall improve the systems for market access and fair competition review and supervision, and shall establish a comprehensive, multi-level and three-dimensional supervision system that realizes the whole-chain and whole-field supervision before and after an incident.
Article 70 Municipal and district people’s governments shall exercise inclusive and prudent supervision over digital innovation, formulate specific supervision rules and standards for different fields and establish flexible supervision mechanisms.
Article 71 Professional service institutions shall be encouraged to provide entrepreneurship training and guidance, intellectual property, investment, financing, technical support, decision-making consultation, property right transaction and legal services for digital enterprises.
Article 72 Shenzhen Municipal People’s Government shall strengthen the publicity of knowledge about the digital economy, encourage the participation of private entities, popularize digital products, strengthen digital skills training, guide scientific cognition, cultivate innovation abilities, improve the digital skills of all citizens and comprehensively enhance the digital awareness of the whole society.
Article 73 Relevant municipal authorities, enterprises and other data processing entities shall guarantee the safe development of the digital economy industry, improve the security management system, strengthen security guarantee for data resources, important networks, information systems and hardware equipment in important fields, improve the security system of key information infrastructure and establish mechanisms for security risk assessment, monitoring, early warning and emergency response. Necessary security measures shall be taken to ensure the security of data, network and facilities.
Article 74 Where relevant authorities or their workers fail to perform their duties in accordance with these Regulations, the persons directly in charge and other persons directly responsible shall be punished according to the law. If a crime is constituted, criminal responsibilities shall be investigated according to the law.
Chapter IX Supplementary Provisions
Article 75 These Regulations shall enter into force on November 1, 2022.
