Regulations of Shenzhen Special Economic Zone on Social Progress
Chapter I General Provisions
Article 1 To promote social progress and ensure coordinated economic, political, cultural, social and ecological progress and comprehensive human development in Shenzhen Special Economic Zone while building Shenzhen Municipality a benchmark city of people’s well-being featuring collaboration, participation, benefit sharing and common prosperity, these Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and in light of the actual needs of Shenzhen Special Economic Zone.
Article 2 In advancing social progress, the leadership of the Communist Party of China (CPC) and the government shall be upheld based on public participation and legal, scientific and technological support as well as a people-centered philosophy of development. Core socialist values shall be implemented to achieve social equity and justice and ensure people’s access to childcare, quality education, favorable employment, accessible medical services, elderly care, suitable housing and assistance for the vulnerable.
Article 3 Every effort shall be made to improve people’s well-being, ensure inclusive public services that meet essential needs and basic living standards for people in difficulty and constantly meet people’s ever-growing needs for a better life.
To strengthen and innovate social governance, we shall foster a full-cycle administration philosophy, uphold collaboration, participation and benefit sharing, address issues at source through systematic, law-based and holistic approaches, and promote modernized social governance.
Article 4 Municipal and district people’s governments shall incorporate social progress into their economic and social development plans and clarify the overall objectives, tasks, policies and measures for promoting social progress.
Municipal and district people’s governments shall incorporate the annual objectives and tasks for social progress into their annual plans for national economic and social development and ensure the implementation of the plans.
Article 5 Shenzhen Municipal People’s Government shall implement a scientific, rational, positive and effective population policy to gradually realize equal basic public services for the permanent population.
Article 6 Municipal and district people’s governments shall formulate sound mechanisms for public participation in social progress. Enterprises, social organizations and individuals shall be encouraged to support social progress in an orderly manner.
Article 7 Municipal and district people’s governments shall enhance communication and collaboration with other cities in the Guangdong-Hong Kong-Macao Greater Bay Area (GBA) in advancing social progress and support the participation of Hong Kong, Macao, Taiwan and foreign residents who work and live in Shenzhen Municipality in social progress initiatives.
Chapter II People’s Well-being
Section 1 Public Education
Article 8 Municipal and district people’s governments shall fully implement the educational policy of the Communist Party of China, intensify the publicity of socialist core values and deepen the comprehensive education reform. Mechanisms and systems for allocating sufficient educational funds, developing education personnel, education and teaching research, monitoring, supervision, evaluation and high-quality educational development shall also be formulated.
Article 9 Municipal and district people’s governments shall prioritize education development and ensure education expenditure is covered by the general public budget. Public education resources shall be allocated in a balanced manner together with efforts to optimize the educational structure, deepen the educational reform and promote educational equality.
Municipal and district people’s governments shall formulate a multi-channel student assistance system to help students from economically disadvantaged families finish school.
Article 10 Municipal and district people’s governments shall increase inclusive kindergartens, expand their distribution and promote the high-quality development of inclusive preschool education.
Municipal and district people’s governments shall improve the financial input system for preschool education, control the total number of childcare and education workers of public kindergartens, improve the mechanisms and systems for ensuring the salary of public kindergarten teachers and allocating initial and daily operating expenses to public kindergartens according to the number of their students, and establish a coordination mechanism between financial subsidies and education quality of inclusive private kindergartens.
Municipal and district education authorities shall formulate sound systems for monitoring preschool education quality, strengthen the evaluation of preschool education quality and regulate the operation of preschool education institutions.
Article 11 Municipal and district people’s governments shall ensure sufficient quotas for compulsory education, improve the mechanism for guaranteeing sufficient funds for compulsory education, maintain standardized operation scale, facilities and equipment for compulsory education, and promote the high-quality and balanced development of compulsory education.
Municipal and district people’s governments shall promote the enrollment model based on big school districts, optimize the enrollment policy for compulsory education, improve school management in the form of conglomerates and formulate systems and mechanisms for regular exchanges, rotation, evaluation and incentives for principals and teachers of compulsory education schools.
Specific enrollment and management measures for big school districts shall be formulated by the municipal education authorities, while specific exchange and rotation measures for principals and teachers of compulsory education schools shall be formulated by the municipal authorities of education, finance, human resources and social security together.
Article 12 Municipal and district people’s governments shall set up high-quality education systems, ensure a good education atmosphere, follow the rule of education, improve the mechanism for coordinated education among families, schools and society, and enhance education services, so as to promote the all-round and healthy development of students.
Municipal and district education authorities shall, based on the principles of voluntariness, inclusiveness, standardization and safety, organize after-school services of compulsory schools in a coordinated manner, facilitate the development of holiday care programs for primary school students, rationally design such programs and expand service models.
Compulsory schools shall be encouraged to provide on-campus lunch and lunch break if possible. Those providing on-campus lunch shall set up sound supervision and complaint reporting mechanisms to ensure food safety.
Article 13 Municipal and district people’s governments shall step up efforts to establish ordinary public high schools, optimize the establishment and administration models of high schools, vigorously promote high school education and realize the characteristic and diversified development of high school education.
Article 14 Shenzhen Municipal People’s Government shall strengthen the overall planning for higher education, categorize colleges as research-oriented colleges, application-oriented colleges and vocational-skills-oriented colleges, and promote the high-level development of higher education.
Shenzhen Municipal People’s Government shall increase the autonomy of colleges and allow them to independently design their programs and specializations, and establish a mechanism for dynamic adjustments. High-quality educational resources shall also be introduced from overseas for high-level Chinese-foreign cooperative colleges.
Article 15 Municipal and district people’s governments shall establish modern vocational education systems, improve the mechanisms for enterprise-college vocational education equally valuing theories and practical skills, promote the modern apprenticeship systems and encourage enterprises to support vocational education and offer vocational training. Efforts shall also be made to train innovative, applied and skilled personnel, and promote production-education integrated development of high-end vocational education.
Municipal and district people’s governments shall encourage secondary vocational schools and regular high schools to cooperate in shared courses, credits and resources. Vocational schools shall be encouraged to develop undergraduate vocational education programs if possible.
Article 16 Municipal and district people’s governments shall, according to the law, support and regulate the establishment of private schools, promote the high quality and characteristic operation of private schools, protect the legitimate rights and interests of private schools, and facilitate the healthy development of private education.
Municipal and district people’s governments shall steadily reform their administration of for-profit and non-profit private schools in a classified manner and improve classified administration policies and differentiated support policies for private schools.
Article 17 Municipal and district people’s governments shall optimize the layout of special education schools, train more special education teachers, improve the mechanism for guaranteeing that their salaries are paid on time and in full, and promote the fair and integrated development of special education.
Municipal and district people’s governments shall vigorously develop preschool education for disabled children, expand compulsory education among disabled children and adolescents, improve supporting policies for disabled children and adolescents to learn in regular classrooms, and develop senior high school education for disabled people which focuses on vocational education.
Article 18 The municipal education authorities shall strengthen leadership over specialized education, establish a guidance mechanism for specialized education, and offer specialized correction education to minors with serious misconduct jointly with the public security and judicial authorities.
Section 2 Employment
Article 19 Municipal and district people’s governments shall adhere to the employment-driven economic development strategy by ensuring fair employment to promote full employment and improve employment quality. Efforts shall also be made to improve the support system for entrepreneurship-driven employment and multi-channel flexible employment, and support and standardize new employment patterns.
Article 20 The municipal and district authorities of human resources and social security and subdistrict offices shall improve the public employment service system, optimize service supply, and ensure equal, standardized, professional, intelligent, convenient and efficient public employment services for all people.
Article 21 Municipal and district people’s governments shall formulate supportive policies to promote the employment and entrepreneurship of graduate students and ex-servicemen, implement the system for proportionally arranging the employment of disabled people and public service posts, and help disabled people and people from families without a bread-earner with employment.
Article 22 The municipal and district authorities of human resources and social security shall strictly uphold the system for labor dispatch license, strengthen the administration and supervision of labor dispatch agencies, establish a credit system for labor dispatch, and punish illegal labor dispatch according to the law.
Labor dispatch agencies shall sign labor contracts with dispatched workers according to the law, fulfill their obligations such as paying remuneration and buying social insurance for dispatched workers according to the law, protect the legitimate rights and interests of dispatched workers, and provide necessary vocational training for dispatched workers.
Article 23 The municipal and district authorities of human resources and social security shall establish sound systems and mechanisms for vocational training and the training, use, evaluation and incentive of and for technological and technical workers, promote the craftsmanship spirit and ensure decent work for more workers.
Article 24 Shenzhen Municipal People’s Government shall ensure sound systems and mechanisms for guaranteeing that workers’ salaries are paid on time and in full, calculating the average social salary, adjusting minimum wage and releasing guide wages for different industries.
Article 25 The municipal and district authorities of human resources and social security shall improve the collective negotiation mechanism, expand the coverage of collective contracts, strengthen the systems and mechanisms for labor information reporting, credit investigation of labor relations, early warning and dispute mediation of labor relations, and build standardized, orderly, fair, reasonable, mutually beneficial, win-win, harmonious and stable labor relations.
Article 26 Municipal and district people’s governments shall improve substantive services and professional arbitration teams of labor dispute arbitration institutions and ensure sound mechanisms for the diversified resolution of labor and personnel conflicts and disputes.
Article 27 Municipal and district people’s governments and subdistrict offices shall improve the mechanisms for coordinating labor relations among the government, trade unions and enterprises, and for workers to express their demands and give feedback. Labor supervision and law enforcement shall also be strengthened so as to punish defaults on wage payment according to the law, resolve labor relations disputes and safeguard workers’ legitimate rights and interests.
Article 28 Municipal and district people’s governments shall improve the systems for fair employment, labor remuneration, labor safety and social insurance, and protect the rights and interests of workers in new employment patterns.
When formulating institutions and rules directly related to the rights and interests of workers in new employment patterns, enterprises shall fully refer to the opinions of trade unions and workers’ representatives. They shall promptly respond to and handle the opinions and suggestions proposed by the workers in new employment patterns, and consult with trade unions or workers’ representatives.
Section 3 Social Security
Article 29 Shenzhen Municipal People’s Government shall implement a social insurance system that covers all people at different levels, build an endowment insurance system based on basic endowment insurance, supplemented by enterprise annuity and connected with personal savings endowment insurance and commercial insurance, improve the insurance system covering medical treatment, occupational injury, unemployment, maternity and long-term care, and optimize service and administration modes based on the social insurance card.
The municipal medical security authorities shall improve the systems of basic medical insurance, supplementary medical insurance and medical assistance, and step up efforts to foster an innovative medical security system that aims at enhancing people’s health. Commercial health insurance may be used as a supplement to basic medical insurance.
Article 30 Municipal and district people’s governments shall improve the systems for the well-being of children, women and disabled people, strengthen the building of social welfare infrastructure, promote rehabilitation services for communities of people with mental disorders and build a friendly city for children, a development-oriented city for young people and a barrier-free city for all people.
Article 31 Municipal and district people’s governments shall, according to the principles of government assistance, social mutual assistance and individual coordination, formulate a multi-tiered and categorized social assistance system and improve assistance policies for people with special needs, such as severely disabled people, seriously ill patients, senior people and minors.
Article 32 Municipal and district people’s governments shall incorporate charity into their economic and social development plans and annual plans and encourage high-income groups and enterprises to give back to society. Efforts to promote charity shall be strengthened, so as to build Shenzhen Municipality into a city of charity.
The municipal civil affairs authorities shall improve the charity administration system at the city, district, subdistrict and community levels, build a smart charity service platform, and improve the system for internal administration and external supervision of charity organizations.
Article 33 Municipal and district people’s governments shall strengthen the overall planning, coordination, supervision and guidance for the protection of minors, improve the protection mechanism for minors, and build a child care, protection and service network at the municipal, district, subdistrict and community levels.
Article 34 Municipal and district people’s governments shall build high-level care and service systems for senior people based at their homes, supported by their communities and elderly care institutions, and combining medical treatment and rehabilitation. Efforts shall also be made to improve basic public services for senior people, guide social capital to elderly care services, encourage property service enterprises to develop home- and community-based elderly care services, and improve the competence of elderly care service teams. Long-term care services for widows, orphans, senior people with financial difficulties, and disabled and semi-disabled senior people shall also be enhanced.
Municipal and district people’s governments shall facilitate home-based elderly care, including elderly service facilities in communities, barrier-free facilities in public places and public transport systems, and ensure a friendly and livable environment for senior people.
Article 35 Municipal and district people’s governments shall build administration and service platforms for ex-servicemen, improve the administration and policy for ex-servicemen and strengthen support for the military and their families, as well as education, training, employment and entrepreneurship of the military. The mechanism for ex-servicemen to integrate into society shall be established, together with efforts to ensure a good social atmosphere in which the whole society respects and cares for ex-servicemen.
Article 36 The municipal civil affairs authorities shall, together with the municipal planning and natural resources authorities, prepare special plans for after-death facilities, improve the after-death administration and service system, ensure free basic after-death services, deepen the reform of funeral customs, advocate green funerals, and increase investment in public service funerals.
Section 4 Public Health
Article 37 Municipal and district people’s governments shall deepen the reform of the medical and health system, improve primary-level medical and health systems, ensure basic medical and health services for the people, and build Shenzhen Municipality into a healthy city.
Municipal and district people’s governments shall also design key medical disciplines and formulate efficient, high-quality and well-functioning medical and health service systems with reasonable layouts, clear responsibilities and complementary functions. Standard systems for medical worker training and hospital evaluation in line with international standards shall be formulated to introduce and develop international cutting-edge medical technologies.
Non-governmental organizations shall be encouraged to establish non-profit medical institutions so as to support the high-quality development of non-public medical institutions. Hong Kong and Macao service providers shall be encouraged to establish medical institutions.
Article 38 Municipal and district people’s governments shall formulate modern hospital administration systems featuring clear powers and responsibilities, reasonable administration, efficient operation and strict supervision. Efforts shall also be made to promote the reform of the salary systems of public hospitals and improve their comprehensive budget management, accounting of all costs and performance assessment.
Article 39 Municipal and district people’s governments shall improve the public health system, strengthen the training of public health workers, raise the standard of per capita public health funds, promote equal access to public health services, and improve residents’ health.
Efforts shall also be made to advocate the idea that everyone is primarily responsible for his own health and to guide people in establishing proper health concepts and adopting healthy lifestyles.
Article 40 Municipal and district people’s governments shall formulate public health emergency command systems, improve joint prevention and control in the whole process, set up sound systems for monitoring, early warning and disclosure of public health incidents, and strengthen emergency plans and emergency teams. Emergency drills shall be held to improve the response to and administration of public health emergencies.
Article 41 Municipal and district people’s governments shall optimize the layout of health service institutions in communities, allocate better medical rooms, facilities, equipment and general medical practitioners, and build health service institutions in communities into basic platforms for administering residents’ health services.
Article 42 Municipal and district people’s governments shall establish sound maternal and child health administration systems to actively prevent birth defects and strengthen premarital health care, pre-pregnancy health examinations, prenatal screening and diagnosis, and newborn disease screening. The basic medical treatment and rehabilitation of children with birth defects shall be improved.
Article 43 Municipal and district people’s governments shall incorporate childcare services into their economic and social development plans and promote interdepartmental coordination and social participation to ensure the healthy development of childcare services.
Municipal and district people’s governments shall develop childcare service standards, multi-tiered childcare service models and inclusive childcare service institutions with reasonable rates for the convenience and benefit of the people.
The municipal health authorities and relevant authorities shall, in accordance with their respective duties, strengthen the supervision and administration of childcare service institutions, while district people’s governments shall urge local childcare service institutions to assume their primary responsibilities for children’s safety and health.
Article 44 Municipal and district people’s governments shall formulate preferential policies for elderly medical services and ensure the direct settlement of medical expenses in places away from patients’ hometowns with medical insurance. More geriatric medical institutions shall be established, together with efforts to optimize institution building standards and the evaluation system and improve health services for senior people.
Article 45 Municipal and district people’s governments shall formulate a social psychological service system at the city, district, subdistrict and community levels, upgrade the service network, increase primary-level service sites and workers, and standardize the operation of social psychological service institutions.
Article 46 The municipal health authorities shall promote the development and innovation of traditional Chinese medicine (TCM), and build TCM preventive treatment service systems and demonstration bases for standardized and international TCM.
Section 5 Housing
Article 47 Shenzhen Municipal People’s Government shall build a housing system that is supported by multiple suppliers and various channels and encourages both housing rentals and purchases, keep land prices, housing prices and market expectations stable, strengthen the macro-control of the real estate market and effectively prevent and resolve risks in the real estate market so as to promote its steady and healthy development.
Article 48 The municipal housing and construction authorities shall, in conjunction with relevant authorities, formulate housing development plans and annual plans to specify the total amount of housing land and buildings to be constructed in Shenzhen Municipality.
The municipal housing and construction authorities shall improve the online signing system for commercial housing contracts, strengthen the administration and supervision of the real estate industry, and effectively protect the housing rights and interests of the people.
Article 49 The municipal planning and natural resources authorities shall optimize land use planning, ensure a reasonable ratio between the land for residential areas and that for public facilities, and prioritize land for public housing.
Efforts shall also be made to increase public supporting facilities and promote the synchronous planning, construction, inspection for acceptance and delivery of new communities and public supporting facilities. For projects constructed in several phases within the same plot, public supporting facilities shall be constructed and inspected for acceptance in the first phase.
Article 50 Municipal and district people’s governments shall raise more construction funds for public housing and improve the distribution, administration, closed circulation and pricing mechanisms for public housing and the public housing supervision system after delivery.
Article 51 Shenzhen Municipal People’s Government shall formulate a sound housing rental system led by market-oriented resource allocation and supplemented by basic guarantee and policy support from the government, promote the steady and healthy development of the housing rental market, and ensure that tenants enjoy the same basic public services as residents who buy houses.
Municipal and district people’s governments shall improve the supply mode of public rental housing, increase public rental housing and optimize the rules on waiting for public rental housing. Priority shall be given to disabled people, key entitled groups, families without children and individuals who rise to the occasion during emergencies, and enhance housing guarantee for extremely poor families and those receiving subsistence allowances and on the edge of receiving subsistence allowances.
Shenzhen Municipal People’s Government shall establish a sound and comprehensive housing rental administration and service platform to enhance the regulation of market entities’ operation and information release, and strengthen the supervision over the housing rental market.
Article 52 Efforts shall be put into formulating sound quality standards of affordable, high-quality and environment-friendly housing, adding supporting facilities around residential areas, modernizing property management, building comprehensive community and neighborhood centers, eliminating safety hazards in urban villages and improving the living environment and supporting services in urban villages.
The municipal housing and construction authorities shall establish dynamic platforms for administering the safe use of houses in Shenzhen Municipality and coordinate the district housing and construction authorities and subdistrict offices in regular inspections of safety hazards in the use of houses. House owners and managers shall be responsible for the use of houses and shall bear the primary responsibility for ensuring their safe use.
Chapter III Social Governance
Section 1 Resolving Conflicts and Disputes
Article 53 Municipal and district people’s governments shall resolve conflicts and disputes at source and build platforms to meet people’s demands based on primary-level resources and the close ties with the people of trade unions, the Communist Youth League (CYL) and women’s federations, to prevent conflicts and disputes, timely discover and immediately resolve them.
Article 54 Municipal and district people’s governments shall implement systems and mechanisms for assessing the risks of damaging social stability of major decisions and the early warning and investigation for social conflicts, and strengthen the resolution of social conflicts.
Article 55 Municipal and district people’s governments shall formulate sound coordination systems for people’s mediation, administrative mediation and judicial mediation, vigorously boost commercial mediation and support industrial and professional mediation agencies.
Article 56 Municipal and district people’s governments shall incorporate the diversified resolution of conflicts and disputes in their plans for building law-based governments, train conflict and dispute resolution professionals and boost social participation in conflict and dispute resolution so as to promptly address people’s reasonable demands.
Section 2 Maintaining Social Stability and Order
Article 57 Municipal and district people’s governments shall play leading roles, encourage relevant authorities’ and social participation in building social security control systems and improve the mechanism for social security control so as to ensure social stability and order and enhance people’s sense of security and satisfaction.
Article 58 The municipal and district public security authorities shall formulate multifaceted and information-based social security control systems, enhance the ability to predict and warn against risks and build comprehensive patrol, control and service systems to better maintain social security.
Article 59 Municipal and district people’s governments shall formulate sound mechanisms for mass prevention and governance of social security, improve the mass prevention and governance mode, strengthen the training of mass prevention and governance professionals and standardize the security guard industry. The role of security guards in mass prevention and governance shall be fully played with efforts put into supporting public participation.
Article 60 Municipal and district people’s governments shall strengthen the regulation of special groups, such as released prisoners, people under community-based corrections, vagrants and homeless patients with mental disorders. A sound social care and assistance system for special groups shall be established.
Section 3 Maintaining Public Security
Article 61 Municipal and district people’s governments shall adhere to the people-first, life-first and safety-first principles, balance safety and development and formulate sound systems for the investigation of public safety hazards, precaution, safety supervision, publicity and education, and accountability and administration for production safety, so as to ensure people’s safety.
Municipal and district people’s governments shall work harder to control safety risks, formulate comprehensive risk monitoring and control systems covering the entire cycle of urban planning, construction and operation, and strengthen risk early warning and joint prevention and control.
Article 62 Business entities shall fulfill their primary responsibility for production safety by strengthening production safety management, improving the accountability system for the safety of all employees, strengthening the training of employees and establishing mechanisms for multi-tiered safety risk control and hidden hazard investigation and management. More efforts shall be made to strengthen standardized and information-based production safety and improve production conditions so as to ensure production safety.
Article 63 Municipal and district people’s governments shall establish sound risk assessment mechanisms for natural disasters, strengthen disaster prevention and relief, improve the catastrophe insurance system and build communities for disaster prevention and reduction. They shall also strive to strengthen the comprehensive administration of major disasters such as typhoons, earthquakes, floods, geological disasters and forest fires, optimize the layout of disaster prevention and reduction facilities, and enhance the construction and administration of emergency shelters.
Municipal and district people’s governments shall train emergency rescue teams led by comprehensive emergency rescue professions and supported by emergency rescue professions, experts and social emergency professions.
People shall enhance their awareness of safety, master the necessary knowledge and skills of disaster prevention and enhance their self-rescue abilities.
Article 64 Municipal and district people’s governments shall strengthen the leadership over emergency administration and improve the systems and mechanisms for emergency administration, command and supervision. Efforts shall also be made to improve risk prevention and control, emergency response, social mobilization and technology-based emergency administration. Modern emergency administration systems and abilities shall be fostered.
Article 65 Municipal and district people’s governments shall implement the systems and mechanisms for fire control accountability, innovative fire control supervision and administration, and regular investigation and elimination of fire hazards. They shall also work hard to increase fire control infrastructure and equipment, strengthen fire control publicity and training, and improve fire control administration.
Article 66 The municipal market supervision and regulation authorities shall formulate sound systems and mechanisms for food and drug safety supervision, food and drug information traceability and accountability for food and drug safety accidents, and build Shenzhen Municipality into a demonstration city of food and drug safety.
Food and drug producers and dealers shall engage in actual production and business according to laws, regulations and food and drug safety standards. They shall be responsible for the safety of the food and drugs they produce and sell, ensure food and drug safety, accept social supervision and assume social responsibilities.
Article 67 Municipal and district people’s governments shall formulate sound traffic safety administration and risk prevention mechanisms and strengthen the comprehensive safety administration of key sections of urban roads, technical support for traffic safety facilities, construction and administration of intelligent safety facilities, and publicity of traffic safety so as to raise people’s awareness of safe travels.
Article 68 Shenzhen Municipal People’s Government shall build a sound data governance system and standard system, and coordinate the supervision and administration of personal data, public data sharing and data security.
Section 4 Primary-level Social Governance
Article 69 Municipal and district people’s governments shall deepen the reform of the subdistrict administration system, optimize the organizational structure and functions, implement the community affairs access system, strengthen the regulation of residential communities and urban villages, and build new patterns of primary-level governance featuring collaboration, participation and benefit sharing.
Article 70 Municipal and district people’s governments shall enhance subdistrict administrative execution, public services, deliberation, consultation, emergency administration, and the ability to build a safe society, and shall, according to the law, grant such powers as comprehensive administration, overall coordination, emergency response and administrative execution to subdistrict offices.
Article 71 Municipal and district people’s governments and relevant authorities shall, in accordance with the principles of scientific administration and efficient services and reasonably determine the community size and the comprehensive community-based grid. Efforts shall also be made to improve the administration mechanism, integrate matters and human resources delegated by administrative departments to community committees, train professional grid inspectors, improve information-based administration platforms and enhance the efficiency of comprehensive grid governance.
Article 72 Municipal and district people’s governments and relevant authorities shall strengthen the administration of rental housing and migrant population, establish administration offices and improve the working mechanisms for independent registration of rental housing, information verification and collection, and hidden hazard handling. They shall also work hard to improve the coding and classified and multi-tiered administration of rental housing and innovate the administration of rental housing so as to ensure livable and safe rental housing.
Article 73 Municipal and district people’s governments shall standardize the operation of residents’ committees, implement self-management, self-service, self-education and self-supervision by the people and allow residents’ committees to play their roles in dispute mediation, public health, environment and property management.
Article 74 Municipal and district people’s governments shall incorporate comprehensive community-based service facilities into their national land and space plans, optimize the layout of comprehensive community-based service facilities, and regulate public services, comprehensive services and essential services offered by communities.
Article 75 Municipal and district people’s governments shall formulate sound primary-level consultation systems and implementation mechanisms for consultation before, during and after major decisions, expand the channels for residents’ participation in primary-level consultation, and guide residents to improve their consultation awareness and consultation ability.
Article 76 Relevant municipal and district authorities shall build categorized and graded post-administration systems for community workers, clarify entry and withdrawal requirements, improve the salary system, guarantee social insurance for community workers, and include community grid inspectors in community workers.
Relevant municipal and district authorities shall train professional community workers, allow college students to practice in communities, and guide college graduates to engage in community services.
Article 77 Municipal and district people’s governments shall build the following systems and mechanisms: a system of modern social organizations in which functions of the government are separated from those of social organizations, rights and responsibilities are clearly established, and social organizations exercise autonomy in accordance with the law; a comprehensive supervision system featuring unified registration, graded responsibilities and legal supervision; and a withdrawal mechanism for social organizations.
Social organizations shall formulate internal management systems centered on the articles of association and corporate governance structures so as to promote integrity in the industry and strengthen self-discipline management.
Article 78 The proprietors’ committee shall assist in and cooperate with community governance. Proprietors shall be encouraged to help promote community development in an orderly manner. The proprietors’ committee shall play its role in maintaining the community environment and promoting community harmony.
Article 79 The municipal and district housing and construction authorities shall cooperate with relevant authorities to determine a list of property service enterprises to participate in primary-level governance so as to give play to the role of property service enterprises in primary-level governance.
Where relevant municipal and district authorities, subdistrict offices and dedicated authorities for certain industries entrust primary-level governance and public service matters to property service enterprises, they shall entrust by means of purchasing services according to the law.
Article 80 Municipal and district judicial authorities shall formulate sound primary-level public legal service systems, strengthen the construction of service platforms and teams, and give full play to the role of primary-level legal service workers in promoting the rule of law, protecting rights and interests and resolving disputes.
Chapter IV Promotion and Guarantee
Article 81 Municipal and district people’s governments shall formulate policies for advancing social progress, guarantee sufficient funds, help to resolve major problems in social progress, implement the supervision and inspection system for social progress, and improve the assessment mechanisms for social progress.
Article 82 The municipal authorities of government service data administration shall step up efforts to build a smart city and a digital government, improve public data resources, infrastructure, public data sharing and service functions, and provide technical support for social progress.
Article 83 People’s organizations shall maintain close ties with people and support and promote social progress.
Trade unions shall strive to build collective negotiation mechanisms, promote democratic management of enterprises, and safeguard the legitimate rights and interests of employees and workers. The CYL shall guide young people to vigorously promote social morality and professional ethics, thus promoting their healthy development. Women’s federations shall build sound anti-domestic-violence mechanisms and promote good family manners, gender equality and good social practices.
Article 84 Enterprises shall fulfill their social responsibilities such as ensuring product quality, production safety and employees’ rights and interests, protecting the ecological environment, advocating ethics, and supporting public welfare and charity.
Article 85 Efforts shall be encouraged to support community-based social organizations by means of the government’s purchasing services and public interest venture capital, and give play to the role of community-based social organizations in primary-level governance.
Article 86 Efforts shall be made to build social work service systems at the city, district, subdistrict and community levels, improve the systems and mechanisms for the administration and incentive of social workers and collaborative services offered by social workers and volunteers, give full play to the role of social workers in social service and social governance, and enhance social services.
Article 87 Voluntary service organizations and volunteers shall be encouraged and supported in offering voluntary services for improving people’s well-being and social governance. Efforts shall also be made to build a bonus system based on accumulative voluntary service time so as to promote volunteer services.
Article 88 Municipal and district people’s governments shall promote the formulation of a social credit system, a punishment system for dishonesty, a credit repair mechanism and an objection reporting system, so as to encourage and guide dishonest parties to proactively make corrections.
Article 89 Shenzhen Municipal People’s Government shall establish a social evaluation mechanism for social progress. The formulation, implementation and evaluation of major public policies shall be made based on people’s opinions and suggestions, so as to ensure people’s rights to know, participate, express and supervise.
Article 90 Municipal and district people’s governments shall promote social progress on a regular basis to disseminate the ideas and knowledge of social progress to the public.
Radio stations, television stations, newspapers, periodicals, and WeMedia outlets shall be encouraged to promote news about social progress.
Media practitioners shall abide by professional ethics, eliminate false reports and fulfill their social responsibilities.
Chapter V Supplementary Provisions
Article 91 These Regulations shall enter into force as of August 1, 2022.
