552 Regulations of the Shenzhen Special Economic Zone on Administrating the Prices of Household Water, Electricity and Gas for Residents深圳经济特区居民生活用水电燃气价格管理若干规定

Adopted at the 20th Meeting of the Standing Committee of the Seventh Shenzhen Municipal People's Congress on September 1, 2023.

  Article 1 To administer the prices of household water, electricity and gas for residents in a standardized manner, protect the legitimate rights and interests of water, electricity and gas users, maintain the order of the water, electricity and gas markets, and ensure residents enjoy peace and contentment in work and life, these Regulations are formulated in accordance with the foundational principles specified in the Price Law of the Peoples Republic of China and other relevant laws and administrative regulations, and in light of the actual circumstances in Shenzhen Special Economic Zone.

  Article 2 These Regulations shall apply to the supervision, inspection and administration of prices of household water, electricity and gas for residents in Shenzhen Special Economic Zone.

  Prices of household water, electricity and gas for residents as mentioned in these Regulations refer to the prices of household water, electricity and pipeline gas for residents that are formulated and publicly announced by the competent pricing authority in accordance with the law.

  Article 3 The prices of household water, electricity and gas for residents in Shenzhen Special Economic Zone shall be determined by Shenzhen Municipal People’s Government, and the administration of prices shall adhere to the principles of equality, applicability, openness, and transparency.

  Article 4 The municipal and district people’s governments shall make holistic plans for the construction of water, electricity and gas infrastructure, facilitate the modernization of water, electricity and gas supply by water, electricity and gas enterprises (hereinafter referred to as suppliers) in accordance with urban renewal plans, and ensure that the living needs of residents are met.

  The municipal and district people’s governments shall promote the use of standardized templates for property service and house lease contracts that include relevant clauses regarding water, electricity and gas fees. They shall also support and guide resident users of household water, electricity and gas (hereinafter referred to as users) in directly concluding water, electricity and gas supply contracts with suppliers in accordance with the law.

  The municipal and district people’s governments shall publicize laws, regulations and policies related to the prices of household water, electricity and gas.

  Article 5 The municipal development and reform authority shall formulate and adjust pricing policies regarding household water, electricity and gas for residents, and promptly announce them to the public.

  The municipal market regulation authority shall investigate and penalize suppliers for violating the pricing law in accordance with the law.

  Subdistrict offices shall investigate and penalize community joint stock cooperative companies, property service providers and lessors or managers of rental housing (hereinafter referred to as fee collectors) for unlawfully collecting household water, electricity and gas fees from residents.

  The municipal market regulation authority shall establish a well-functioning joint law enforcement mechanism, organize joint law enforcement by the municipal authorities of development and reform, housing and construction, and water as well as subdistrict offices as needed, and provide guidance and training for subdistrict offices in law enforcement.

  The municipal authorities of development and reform, housing and construction, and water shall provide assistance and cooperate in relevant tasks.

  Article 6 Suppliers shall strictly adhere to government-set prices and related pricing policies for household water, electricity and gas for residents and promptly publicize the prices. They shall not increase prices without authorization or impose additional fees beyond government-set prices.

  It is encouraged that suppliers use intelligent measuring instruments and help users inquire and pay related fees by utilizing technologies such as the Internet and big data.

  Article 7 Fee collectors shall collect fees in accordance with government-set prices for household water, electricity and gas for residents and the actual quantity used by users. They shall not impose additional fees.

  Article 8 When collecting water, electricity or gas fees, fee collectors shall provide invoices or receipts. Such invoices or receipts shall state the prices of water, electricity or gas and the actual quantity used.

  Article 9 Whoever discovers a violation of these Regulations or evidence thereof may file a complaint with or report to the municipal market regulation authority or the relevant subdistrict office. Whoever receives the complaint or report shall respond to it promptly in accordance with the law and inform the complainant or the informant of the outcome.

  Article 10 Subdistrict offices shall strengthen oversight of fee collectors in collecting household water, electricity and gas fees within their jurisdiction. If they identify potentially illegal activities, they shall promptly meet with and caution the perpetrators or persons in charge.

  When subdistrict offices identify disputes related to the prices of household water, electricity or gas for residents within their jurisdiction, they shall proactively mediate between the parties involved, promote reconciliation, and promptly resolve the conflict.

  Article 11 In violation of Article 6 of these Regulations, whoever charges above government-set prices or imposes additional fees shall be punished by the municipal market regulation authority in accordance with the Price Law of the Peoples Republic of China and other relevant laws and regulations.

  Article 12 In violation of Article 7 of these Regulations, whoever fails to collect fees in accordance with government-set prices of household water, electricity or gas for residents and the actual quantity used by the user or by imposing additional fees shall be orally warned or ordered by the subdistrict office to make corrections within a time limit. Whoever fails to make corrections within the time limit shall be fined not less than 50,000 yuan but not more than 200,000 yuan (for organizations) or not less than 2,000 yuan but not more than 20,000 yuan (for individuals).

  Article 13 In violation of Article 8 of these Regulations, whoever fails to provide an invoice or receipt or the invoice or receipt provided does not indicate the water, electricity or gas price and the actual quantity used shall be orally warned or ordered by the subdistrict office to make corrections within a time limit. Whoever fails to make corrections within the time limit shall be fined not less than 10,000 yuan but not more than 50,000 yuan (for organizations) or not less than 1,000 yuan but not more than 10,000 yuan (for individuals).

  Article 14 For those who have been granted administrative punishment for violating these Regulations, the municipal market regulation authority and the subdistrict office shall publicize relevant information about the administrative punishment in accordance with relevant regulations.

  For those who have received administrative punishment for violating these Regulations but fail to comply with the effective administrative punishment decision, relevant authorities shall, in accordance with the law, include relevant information in their credit records and impose sanctions for breach of trust.

  Article 15 The supervision, inspection and administration of prices of water, electricity and gas not for household consumption within the scope of government pricing may refer to these Regulations, unless otherwise stipulated by laws and regulations.

  Article 16 These Regulations shall come into force on October 1, 2023.
