Measures of the Shenzhen Municipality on the Administration of the Water Using and Water Saving of Construction Projects deliberated and adopted at the Eighty-Sixth Executive Meeting of the Fourth Shenzhen Municipal People’s Government is now promulgated and will take effect as of May 1, 2008.

Measures of the Shenzhen Municipality on the Administration of the Water Using and Water Saving of Construction Projects
Article 1 In order to strengthen the administration of the water-using and water-saving facilities of construction projects, reasonably use water resources, and save water, these measures are hereby formulated in accordance with Regulations of the Shenzhen Municipality on Water Saving and related laws, regulations.
Article 2 These measures shall apply to the construction and administration of the water-using and water-saving facilities of the various construction projects within the urban planning areas.
The water-using and water–saving facilities shall include water-using utensils, techniques, equipment, measuring facilities, facilities to use reclaimed water, facilities to collect and use rainwater, and seawater-using facilities, etc.
The reclaimed water referred to in these measures shall mean the non-drinking recycled water that is collected from various urban drains, treated to meet the stipulated standard of water quality, and may be used within the proper realm of life, municipal administration, etc.
Article 3 The water-using and water-saving facilities shall be designed, constructed, and put into use at the same time when the principal part of a project is designed, constructed, and put into use.
The unit undertaking a construction project shall entrust the design and construction of the water-using and water-saving facilities of the construction project to the units with corresponding qualifications. The design unit, construction unit shall conduct the design and construction according to the related standards, rules, and technical specifications of the state, province, and municipality, and design documents shall accord with the specialized plans for source of water, water supply, water saving, and water quality development, etc.
Article 4 The administrative department in charge of water affairs of the Shenzhen Municipality (hereinafter referred to as the municipal department of water affairs) shall be responsible for the administration of the water using, water saving of the whole city’s construction projects. Entrusted by the municipal department of water affairs, the municipal office of water-saving administration shall undertake the specific administration of the water using, water saving of the whole city’s construction projects.
The municipal department of water affairs shall be responsible for the administration of the construction projects whose designed annual water consumption is more than 30,000 cubic meters (including 30,000 cubic meters), and district departments of water affairs shall be responsible for the administration of the other construction projects.
Article 5 The related departments of the municipal government such as those of development and reform, land resources and realty administration, planning, construction, environmental protection, trade and industry, quality and technology supervision, etc. shall, within the limits of their respective duties, cooperate with the municipal department of water affairs to do their part in the administration of the water using and water saving of construction projects, and, in organizing the implementation of the plans for industrial development, fully consider and adopt advanced, scientific technologies and measures of water using and water saving.
Article 6 Awards shall be granted to the units and individuals who have made outstanding contributions to the construction of the water-using and water-saving facilities of construction projects.
The municipal department of water affairs shall work out the measures on the reward and propagation of the construction of the water-using and water-saving facilities of construction projects and be responsible for organizing their implementation.
Article 7 If the projects of new construction, reconstruction, and expanded construction use urban water supply, the piping system to use reclaimed water, seawater and rainwater (hereinafter referred to as untraditional water resources) shall be constructed as a complement according to the plan for water saving in addition to the construction of the piping system of city water supply. All the construction projects located within the areas having water supply from untraditional water resources whose quality satisfies the requirements of water using shall give precedence to the use of untraditional water resources.
Article 8 The following projects of new construction, reconstruction, and expanded construction out of the coverage of the plan for the water distribution pipes of untraditional water resources shall have the facilities of corresponding scale for reclaimed water using to be constructed as a complement:
(1) the hotels, restaurants whose gross floor area exceeds 20,000 square meters;
(2) the other buildings whose gross floor area exceeds 40,000 square meters.
The existing buildings, which meet the stipulations of the previous section
and have space available for construction, shall have the facilities of corresponding scale for reclaimed water using to be constructed. If the consumption of reclaimed water or recycled water is less than 100 cubic meters per day, the independent construction of the facilities to treat reclaimed water may not be needed, but the piping system to use untraditional water resources shall be constructed as a complement.
Article 9 Construction projects shall adopt the following measures of rainwater using in order to have the rainwater flood peak flow within the construction area at prescribed recurrence interval after development and construction lower than that before construction begins:
(1) the rainwater on the roof shall be drawn together to the pervious area of the ground or collected for use;
(2) it shall be designed for the paving of sidewalks, pedestrian streets, squares, yards, etc. in construction projects to have the pervious ground or to adopt measures to collect and use rainwater; when constructing the rainwater collection system, there shall be measures to treat rainwater, and non-point source pollution shall be dealt with on the spot;
(3) the facilities for rainwater retention shall be designed, constructed for green areas, the green area for rainwater retention shall be lower than its surrounding areas.
Article 10 Within the limits of the seawater-using areas determined by the
plan for water saving, the seawater-using facilities of corresponding scale shall be constructed as a complement in the projects of new construction, reconstruction, and expanded construction.
Article 11 The projects of new construction, reconstruction, and expanded construction shall include the items of the evaluation reports on water using and water saving in the documents of their feasibility study reports, make plans for water-saving measures; the construction projects which do not have to do a feasibility study according to law shall include the items of the evaluation report on water using and water saving in the design documents of their project plans.
The evaluation reports of water using and water saving of the construction projects whose designed annual water consumption is more than 30,000 cubic meters (including 30,000 cubic meters) shall be submitted by the units undertaking the projects to the municipal department of water affairs for examination and approval. The evaluation reports of water using and water saving of the construction projects whose designed annual water consumption is less than 30,000 cubic meters shall be submitted by the units undertaking the projects to district departments of water affairs to be put on record.
Article 12 The application materials for the examination and approval of the evaluation reports of water using and water saving of construction projects shall include:
(1) the applicant’s identity certificate and the form of the submitting of the evaluation report of water using and water saving of a construction project;
(2) the approval document of the construction project;
(3) the evaluation report of water using and water saving of the construction project and the appraisal opinion of the specialized consulting agency.
The departments of water affairs shall make a decision on the examination
and approval within 10 days from the date of receiving the evaluation reports of water using and water saving of construction projects, if the municipal government has other stipulations on the time limit of the examination and approval, they shall be honored.
Article 13 The main items of the evaluation report of water using and water saving of a construction project shall include:
(1) the brief account of the construction project and water users;
(2) the nature of the project and the relevant industrial policy;
(3) the quota, scale of water using and the source of water to be used and the feasibility analysis;
(4) the water-using techniques, water-using facilities, equipment, layout of water consumption measuring facilities;
(5) the plan for water-saving works and technological measures;
(6) the analysis of the economic gains and losses of water saving.
Article 14 The departments of water affairs shall approve the evaluation
report of water using and water saving of a construction project which meets the following requirements:
(1) the water using of the construction project meets the relevant industrial policy and related standards, rules, and technical specifications;
(2) there is a rational source of water to be used, the scale of water using meets the requirements of the plan;
(3) the techniques of water using and water saving are rational, the plan for engineering facilities and technological measures meets the requirements of the related specifications, rules;
(4) the targets of water using and water saving meet the requirements of the related stipulations on the water-saving city, enterprise (unit), etc.
If a construction project changes its water-using techniques, water-using
scale, and main facilities of water using and water saving, it shall submit a report for approval according to the original procedure of examination and approval.
Article 15 When drafting a project description of design guideline and specifications, the unit undertaking the project shall make clear in the description the related requirements of Articles 7, 8, 9, 10 of these measures. The design unit shall engage in planning, designing strictly according to what is made clear in the description and the related standards. When examining the design documents of working drawing, the unit conducting the examination of working drawing shall examine the design involving the water-using and water-saving facilities of the project strictly according to the related rules on water saving and the requirements of these measures.
Article 16 The unit undertaking a construction project shall report the design document of working drawing for the water-using and water-saving facilities of the project to the department of water affairs to be put on record, and the materials to be put on record shall include:
(1) the applicant’s identity certificate and the application form of putting on record the design document of working drawing for the water-using and water-saving facilities of the construction project;
(2) the opinion of the department of water affairs on the evaluation report of the water using and water saving of the construction project after the examination;
(3) the design document of working drawing for the water-using and water-saving facilities of the construction project and the appraisal opinion of the specialized consulting agency.
The department of water affairs shall check the related design documents,
and order the units undertaking the project to make corrections by a deadline if one of the following requirements is violated; if corrections have not been made after the deadline, the project’s plan for construction’s water using shall be cancelled:
(1) the requirements for according with the approved evaluation report of the water using and water saving of the construction project;
(2) the techniques, equipment, and utensils of the water-using and water-saving facilities shall be correct without any mistake;
(3) the contents of the design shall meet the related requirements of the standards, rules, and technical specifications on the design of working drawing.
Article 17 The construction unit, supervision unit of a construction project
shall carry out the construction and supervision of the water-using and water-saving facilities strictly according to the design document of working drawing approved after examination in the process of the construction of the project.
The department of water affairs shall post in its office the list of the materials needed to be examined and put on record and their model copies
The department of water affairs may organize the training on the related knowledge about water using and water saving for the personnel to design, construct, and supervise the water-using and water-saving facilities of the construction project and for the personnel who are engaged in the routine management after these facilities have been put into use.
Article 18 The unit undertaking a construction project shall conduct an acceptance check of water-using and water-saving facilities according to the related rules after their construction is completed, and report the result of the acceptance check to the department of water affairs to be put on record. The materials put on record shall include the as-built drawing related to the water-using and water-saving facilities, receipt of the design document of working drawing for the water-using and water-saving facilities to be put on record, on-the-spot photos, certificates of qualified product, construction and inspection records. The department of water affairs shall verify the completion of the construction of the water-using and water-saving facilities, and the unit undertaking the project shall cooperate.
Article 19 User units shall establish, improve the management system and directive rules of water-using and water-saving facilities, ensure the normal operation of the facilities, and shall not stop using the constructed water-using and water-saving facilities without authorization.
As for the construction projects that have been completed, the water-using and water-saving facilities shall be constructed and transformed gradually, water-saving utensils shall be used, and the facilities to develop and use untraditional water resources shall be constructed.
Article 20 To those who are engaged in the operation of untraditional water resources and supply water to users through special water supply pipelines, the department of water affairs may grant the chartered right to operate the business of untraditional water resources according to the related rules.
Article 21 The unit undertaking a construction project shall install water-consumption measuring facilities according to the requirement for water balance test, be able to assess unit water consumption, and satisfy the requirements of the management of day-to-day water using and water saving. For different kinds of water using, separate meters shall be installed to measure their different water consumption.
Article 22 If one of the following cases applies to the departments of water affairs and their staff members when they violate these measures, their superior administrative departments or supervision departments shall order corrections; disciplinary action shall be taken against the directly responsible person in charge and other directly responsible persons according to law; those suspected of committing a crime shall be handed over to a judicial office to be dealt with according to law:
(1) to refuse to approve the evaluation reports of water using and water saving of the units undertaking a construction project which meet the requirements;
(2) to approve the evaluation reports of water using and water saving of the units undertaking a construction project which do not meet the requirements;
(3) to fail to execute the duty of supervision over the construction of the water-using and water-saving facilities of construction projects according to law or to be ineffective to do so and to cause serious consequences.
Article 23 If the water-using and water-saving facilities of the projects of
new construction, reconstruction, and expanded construction, in violation of these measures, are not completed or fail to meet the requirements stipulated by the state and are put into use without authorization, the department of water affairs shall order corrections by a deadline, and impose a fine of more than 30,000 but less than 50,000 RMB.
If an acceptance check has not been conducted according to the rules after the completing of the construction of the water-using and water-saving facilities of a construction project, its plan for water using shall not be checked and ratified.
Article 24 These measures shall take effect as of May 1, 2008. Provisional Measures of the Shenzhen Special Economic Zone on the Construction and Administration of Reclaimed Water Facilities promulgated on December 31, 1992 by Shenzhen Municipal People’s Government Order No. 3 shall be abolished at the same time.
