397 Regulations of the Shenzhen Special Economic Zone on the Promotion of the Accelerating of the Transformation of the Economic Development Model[深圳经济特区加快经济发展方式转变促进条例2010]

  (Adopted at the Fifth Meeting of the Standing Committee of the Fifth Shenzhen Municipal People’s Congress on December 24, 2010) 

  Chapter I General Provisions 

   Article 1 In order to accelerate the transformation of the economic development model of the Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone), promote the innovative drive, endogenic growth, scientific development, and social harmony, these regulations are hereby formulated. 

   Article 2 These regulations shall apply to the activities of the Special Zone to accelerate the transformation of the economic development model. 

   Article 3 The following basic principles shall be observed in the transformation of the economic development model: 

  (1) to combine reform and opening-up with the promotion of development, to make reform and opening-up the essential motive power for the accelerating of the transformation of the economic development model, to enhance the comprehensiveness, harmony, and sustainability of the development, and to bring about the economic and social development with quality and speed;

  (2) to combine the stable growth with the model transformation, to appropriately deal with the relationship between development and transformation, and between the total amount and quality, and to achieve the organic unity of speed, structure, quality, and effectiveness;

  (3) to combine independent innovation with structural optimization, to make the capacity of independent innovation and the building of a innovation-oriented city the essential driving force for the economic development, and to take the acceleration of the adjustments of economic structure as an strategic priority;

  (4) to combine low-carbon development with ecological construction, to have the overall lifting of the level of urban planning, construction, and management;

  (5) to combine economic development with the people’s livelihood and happiness, to take inclusive growth as a goal, to promote social harmony in an all-round way;

  (6) to give impetus to combining the urbanization with the integration of the Special Zone, to take the transformation of economic development model as a main thread, to achieve the integration of regulations and policies, planning and overall arrangements, infrastructure, urban management, environmental protection, and public service.

  Article 4 The municipal, district people’s governments (hereinafter referred to as 

  the municipal, district governments) shall establish the leadership and coordination mechanism to accelerate the transformation of the economic development model.

  The municipal department of development and reform shall be specifically responsible for the overall administration of the accelerating of the transformation of the economic development model. The municipal department of development and reform shall organize the formulation of an action plan to accelerate the transformation of the economic development model, report it to the municipal government and implement it after approval. The action plan shall make clear the goals, tasks, responsible departments, advancing measures, assessment, punishments and awards, investigation of the responsibility, and other main contents of the transformation of the economic development model.

  The other departments of the municipal, district governments shall be responsible for the related work of the accelerating of the transformation of the economic development model within the limits of their respective duties.

   Article 5 The municipal, district governments shall make innovations in their administration modes, change their functions, carry out the governmental performance management in an all-round way, strictly practice the administrative accountability, build the service-oriented government, and enhance the government capacity to promote the transformation of the economic development model. 

   Article 6 The municipal, district governments shall establish the decision-making information system and the assessment and evaluation system to accelerate the transformation of the economic development model. 

   Article 7 It shall be encouraged for the whole society to actively participate in the education, propagation, popularization, implementation, and supervision of the accelerating of the transformation of the economic development model. 

  Awards shall be granted to state organs, enterprises and public institutions, social organizations, and individuals who have made outstanding contributions to the accelerating of the transformation of the economic development model.

  The measures on granting awards shall be worked out separately by the municipal government.

  Chapter II Innovative Drive 

   Article 8 Efforts shall be made to put guiding strategy of independent innovation into practice, to take the enhancement of the capacity of independent innovation as a key link in the transformation of the economic development model, and to give impetus to the change of the economic development from being driven by essential factors to being driven by innovation. The building of a national innovation-oriented city shall be pushed forward by taking scientific innovation as a central task, taking the enhancement of international competitiveness as a goal, taking talent accumulation as a key, and taking industrial innovation as a priority.  

   Article 9 Efforts shall be made to establish a connection with the national innovation system, to strive to have national innovation resources, to guide and support the agglomeration of the essential factors of innovation in enterprises, to improve the technological innovation system which takes enterprises as main agents, market as a guide, and combines production, study, and research together, to form the echelons of independent innovative enterprises, and to optimize the ecology for innovation. 

   Article 10 Efforts shall be made to strengthen the capacity of independent innovation in core technologies, to give impetus to the extension of scientific and technological innovation from technological development and applied technology research to applied basic research, from integrated innovation and re-innovation based on introduction, digestion, and absorption to original innovation. 

  Efforts shall be made to concentrate superior resources, to accelerate the promotion and implementation of major scientific and technological special projects as well as brainstorms about key technologies, and to acquire a bundle of independent intellectual property rights in the areas such as the information technology of a new generation, internet, biopharmaceutics, new energy, new materials, new-energy automobiles, energy conservation and environmental protection, and advanced equipment manufacturing, etc.  

   Article 11 The proportion of international patents, invention patents in patent licensing shall be increased. 

  The structure of the export of products of high and new technologies shall be optimized, and impetus shall be given to the extension of the export from that of products to that of technologies and services of research and development.

   Article 12 The municipal government shall formulate policies and measures on the promotion of the transformation of scientific and technological achievements, raise the rate of the transformation of scientific and technological achievements. 

  Efforts shall be made to encourage government-sponsored scientific research institutes to set up their project corporations in the Special Zone, to establish technology transfer institutions and strategic alliances in which governments, industries, academia, research institutes, capital, and intermediaries jointly take their part, and the project corporations, technology transfer institutions, and strategic alliances may share the benefits of the transformation of scientific and technological achievements according to contracts.

  The municipal government shall use China High-Tech Fair as a platform to encourage the enterprises, scientific research units of Shenzhen to participate in exhibitions and conferences, and give them financial support for their participation, and bring about the transformation led by science and technology as well as the development driven by innovations.

   Article 13 The municipal, district governments shall play a leading role in the building of public technology platforms and original innovative institutions, accelerate the construction of the major infrastructure of science and technology, key laboratories, engineering laboratories, engineering centers and technology centers. It shall be encouraged for enterprises and public institutions to undertake and participate in national major special projects and major brainstorms in science and technology, and it shall be promoted to have the transformation of innovation resources from the state of dispersion to the state of comprehensive utilization and aggregation on a scale. 

  Efforts shall be made to strengthen the regional and international cooperation in innovation, to deepen the cooperation in the Shenzhen/Hong Kong Innovation Circle, to support enterprises in setting up transnational institutions of research and development, and to push on bilateral and multilateral cooperation in science and technology.

   Article 14 The municipal government shall optimize the environment for the protection of intellectual property rights, implement the strategy of intellectual property rights and the strategy of standardization, and guide enterprises in taking part in the establishing of the international standards, national standards, and industrial standards. 

  The municipal government shall establish and improve the index system of intellectual property rights, and related departments shall strengthen and push on the work of intellectual property rights according to the requirements of the index system.

  The construction of the public platforms of technological consultation, guidance, assessments, incubator, etc shall be encouraged, and industrialization of technological achievements shall be promoted.

   Article 15 To develop the venture capital investment and to explore the mechanism of capitalization of intellectual property rights shall be encouraged. The trading market of technological property rights shall be established and improved, and the technology transfer mechanism shall be improved. 

  Chapter III Structural Adjustments 

   Article 16 The motive force structure of the economic development shall be reasonably adjusted to push on the transformation and upgrading of the economic structure, and to improve the quality and benefits of the economic development. 

  (1) The industrial structure shall be adjusted to give impetus to the extension of manufacturing to research, development and design as well as to brand marketing, and to bring about the coordinated development of the second and tertiary industries on a high level. The municipal government shall put forward corresponding goals and measures to achieve these goals in the plan for national economic and social development and the annual plans.

  (2) The demand structure shall be adjusted to promote the transformation of the economic development of the Special Zone from being largely based on external demand  to that pulled by internal demand and external demand in a harmonious way, and to make overall planning for domestic cooperation and opening-up to the outside world.

  (3) The consumption structure shall be adjusted to raise the income of residents, to increase the consumption capacity, to develop the newly-emerging types of consumption, to cultivate the hot spots of consumption, and to push on the upgrading of the consumption structure. The municipal government shall formulate the guiding measures on the increasing of consumption demands and organize their implementation.

  (4) The investment structure shall be adjusted to expand the areas of investment, to bring about the diversification of main investors and sources of investment, to increase the guiding and controlling power of the government investment guidance, and to push on the institutional reform of investment and financing with steady steps. The municipal government shall formulate the social investment guidebook and make timely adjustments of the guidebook in order to direct and expand the social investment.

  (5) The regional economic structure shall be adjusted to optimize and improve urban function planning, to construct the functional zones for economic development, to push forward the highly efficient agglomeration of essential factors such as industries, capital, and labor, etc., to strengthen the economic cooperation and functional complementation with surrounding areas, and to promote the coordinated development of the regional economy.

  Article 17 It shall be carried out to build a modern industrial system and to 

  promote the optimization and upgrading of industrial structure.

  (1) The development of newly-emerging strategic industries such as energy conservation and environmental protection, information technology of a new generation, biopharmaceutics, new energy, new materials, new energy automobiles, manufacturing of advanced equipments, etc. shall be supported and encouraged. The municipal government shall make a plan for the development of newly-emerging strategic industries and organize its implementation.

  (2) The innovative transformation of basic core industries and competitive traditional industries shall be supported and encouraged, and high and new technologies shall be used to increase the capacity of independent research and development and to raise the value added of products, and to build modernized, specialized bases of advanced manufacturing with their own brands of products. The municipal government shall formulate the implementation measures on the promotion of the strategic transformation and upgrading of basic core industries and competitive traditional industries.

  (3) The development of the marine industry and modern ecological agriculture shall be supported and encouraged.

  (4) The development of pillar industries such as high and new technology, modern finance, modern logistics, cultural and creative industry, etc. shall be supported and encouraged, and impetus shall be given to the development of the modern service industries.

  (5) The strategy of driving by major projects, agglomeration in parks, and industrial clusters shall be put into practice to optimize the regional distribution of industries, and to push on the development of industrial intensification.

  Article 18 Efforts shall be made to support and encourage enterprises in their 

  transformation and upgrading, to promote the development of headquarters economy, to encourage the merger and reorganization, to foster innovating and growing enterprises,  to make policies and measures to support enterprises in creating their brands and establishing their marketing and logistics systems, to provide highly efficient, convenient services for enterprises, and to enhance the international competitiveness of enterprises.

  The municipal government shall improve the business environment for innovative enterprises and middle- and small-sized enterprises, and improve the road map for them to grow and go public.

  

  Article 19 The municipal government shall support the underdeveloped areas of the Special Zone in terms of finance, administrative powers, public service, and infrastructure construction, narrow the gap between areas, and promote a balanced development of areas.

  The municipal government shall, in compliance with the requirement for the integration of the Special Zone, push on the equalization of basic public services, establish and improve the public finance system and performance assessment mechanism corresponding with the integration of the Special Zone and the equalization of basic public services, and provide for all city residents the basic services concerning the people’s livelihood, public utilities services, basic services of public welfare, and public security services.

   Article 20 Efforts shall be made to build an open economy of all dimensions, multiple tiers, broad domain, and high level. 

  (1) To encourage and support enterprises in realizing the strategy of the overall promotion of the open economy, optimizing commodity structures, and consolidating and exploiting the international and domestic markets.

  (2) To encourage and support the expansion of the export of the products that have independent intellectual property rights, independent brands, independent marketing, high technology contents, high value added, and great benefits. To support qualified enterprises to make investments abroad, to foster native transnational corporations and internationally well-known brands.

  (3) To strengthen the construction of the bases for foreign services contracting. To encourage and support the transformation of the foreign trade from one largely relying on goods to one laying equal stress on both goods and services. The municipal government shall formulate a work manual for foreign services contracting, and guide enterprises in their transformation and upgrading.

  (4) To encourage and support transnational corporations in establishing regional headquarters, centers for research and development, purchase centers, and production bases in the Special zone.

  (5) To direct and support the foreign capital in going to the government-encouraged industries such as energy, transportation, environmental protection, logistics, commercial services and other industries enjoying priority in its development.

  Chapter IV Low Carbon Circulation 

   Article 21 Efforts shall be made to put a system of the environmental impact assessment concerning plans and policies into practice, to establish the mechanism of the strategic assessment of environmental impacts; to innovate in the system of projects’ environmental impact assessment, and to improve the environmental impact assessment system. 

   Article 22 Efforts shall be made to put a clean energy plan into practice, to develop new energies such as solar energy, nuclear energy, wind energy, biomass energy, etc., to popularize the use of renewable energies, to raise the proportion of the use of traditional low-carbon energies such as natural gas, etc., and to improve the structure of energy use. 

   Article 23 Efforts shall be made to use land in a highly efficient and intensive way, to develop, popularize, and use the resource-saving technologies and techniques, to popularize the contracted energy management, and to raise the level of the highly efficient and intensive use of energy resources. 

   Article 24 The municipal government shall strictly implement the national, provincial, and this municipality’s access permission systems based on industrial energy consumption, carbon emission, and environmental impact, control the development of the industries of high energy consumption, high pollution, eliminate backward technologies, techniques, and equipments, enhance the productivity and the efficiency of the energy use, and promote low-carbonization in industries. 

  Efforts shall be made to develop the carbon trading market, to promote the mechanisms for low carbon and emission, which are result-oriented and centered on market driving, such as substituting awards for subsidies, contracting energy management, etc., and to accelerate building the national low-carbon experiment city.

   Article 25 The strategy to give priority to public transportation shall be put into practice, the green way of going out shall be advocated, the construction and use of green buildings shall be popularized, the energy consumption of public buildings and public places shall be reduced; the urban capacity of carbon sequestration shall be increased; the propagation of the low carbon idea shall be launched in order to guide the low carbon consumption and to advocate the low carbon way of life. 

   Article 26 The research, development, and use of carbon-reduction technologies shall be carried forward, the brainstorms about and industrialization of carbonless technologies shall be promoted, the exploration of de-carbonization technologies shall be encouraged, the use of waste carbon as resources shall be promoted; the low-carbon verification shall be carried out for key industries, typical products, and major emission-reducing projects. 

   Article 27 Efforts shall be made to develop the cyclic economy, to realize clean production, to push on the reduction of emission at its source, comprehensive use, and neutralization treatment, to reduce energy consumption, to decrease waste generating, to bring about the cyclic use of resources, and to accelerate building the national experiment city of the cyclic economy.  

  Chapter V Planning and Direction 

   Article 28 The municipal government shall accelerate the reform in its planning system, promote the mutual coordination and unification of the plan for national social and economic development, overall urban plan, and overall land use plan (hereinafter referred to as three plans) on the basis of the plan for national social and economic development. 

   Article 29 The goals and orientation of the transformation of the economic development model shall be embodied in making the Shenzhen Municipality’s plan for national social and economic development. 

  

  Article 30 The municipal government shall scientifically work out the overall urban plan and overall land use plan to promote the connotative development of the urban space according to the reform requirement for the coordination of three plans, on the basis of the Shenzhen Municipality’s plan for national social and economic development, and in compliance with the principle of the rationality of urban regional functions.

   Article 31 The municipal government shall make an industrial plan in accordance with the national, Guangdong provincial industrial plans and the Guangdong provincial plan for national social and economic development, and in the light of the actual conditions of this city. The industrial plan shall make clear the priorities, orientation, and strategy of the industrial development, and provide the basis for the formulation of industrial development policies and the construction of major industrial projects. 

   Article 32 The municipal, district governments and their functional departments shall work out various special development plans according to the plan for national social and economic development. 

  The special development plans shall be the guiding standards for the development of related areas, industries or trades, their contents shall mainly include guiding ideas, development goals, main tasks, key projects, and guarantee measures for development.

   Article 33 Efforts shall be made to accelerate the advancing of new functional areas’ planning, development, and construction, to make clear the new areas’ positioning, administrative system, and industrial development plans, to promote both the integral development and group development of the region, and to form new growth poles with a variety of their respective features. 

   Article 34 The municipal department of development and reform shall draw up and improve the Shenzhen industrial guidance catalogue (hereinafter referred to as the guidance catalogue), report it to the municipal government and release it after approval. The guidance catalogue shall be drawn up every two years and it shall play a role in the classified policy guiding for the industrial development according to the state’s Guidance Catalogue for Industrial Structure Adjustments, the municipal industrial plan, and the requirements for the transformation of the economic development model, with emphasis on enhancing the innovation capacity, fostering and expanding newly emerging strategic industries, and accelerating the development of modern service industries. 

  The municipal government shall, according to the preferential policies of Chapter VI of these regulations, give its encouragement and support to the industries, products and technologies which fall into the categories to be encouraged in the guidance catalogues.

  The municipal, district governments shall adopt the policy on stock direction and increment control to deal with the industries and projects which fall into the category to be restricted. It shall be prohibited for the industries under restrictions to make investment in new construction projects, and the department of investment administration shall not examine, approve or put on record such new projects.

  It shall be prohibited for the industries which fall into the category under restrictions to invest in new construction projects; as for the existing capacity of production which is within the prescribed period to be eliminated because of becoming obsolete, the related administrative departments of the municipal government shall order either stopping production or closing down.

   Article 35 The municipal government shall establish and improve the system of examination and approval of the use of the resources for fixed asset investment, organize its implementation, and set the consumption quota standards for energy, water resources, and land resources, the projects of fixed asset investment whose annual comprehensive energy consumption, water consumption, and land use exceed the quota standards shall not be examined, approved, or put on record unless laws, regulations provide otherwise. 

  The opinion of the examination and approval of the use of the resources shall be taken as the basis for the examination and approval of projects, construction, check and acceptance after completing construction, and audit.

  If a project of fixed asset investment fails to meet the quota standards for energy consumption, water consumption and land resources consumption in the process of the check and acceptance after its completion, the related administrative departments of the municipal government shall order making corrections by a deadline, if corrections are not made after the deadline or the project still fails to meet the standards after making corrections, the project shall not be put into use. If the project is put into use without authorization, it shall be dealt with according to law.

   Article 36 The municipal, district governments shall take the inclusive growth as a goal, establish and improve the index system of social construction which takes the index system of the people’s livelihood and happiness as its main item, and accelerate building a city of the peoples’ livelihood and happiness. 

  The index system of the people’s livelihood and happiness and the goal to build a city of the people’s livelihood and happiness shall be brought into the annual plan for national social and economic development and 5-year plan.

  The index system of the people’s livelihood and happiness and the goal to build a city of the people’s livelihood and happiness shall include the income level, consumption structure, science, education, culture, health, and sports, living conditions, energy conservation and emission reduction, and sustainable development.

  Chapter VI Policy Promotion 

   Article 37 Efforts shall be made to insist on the preferential, accelerated, and coordinated development of education; to bring about comprehensive quality education, to enhance the quality of education, to optimize the structure of education, to reform and innovate on the model of education development, to construct a plural, open, interconnecting, lifelong education system, and to train innovative talents. 

  More efforts shall be made to introduce innovative talents, and the international fairs of talent exchange, the talent platform of China Hi-Tech Fair shall be used to accelerate the introduction of top talents to make breakthroughs in key technologies and to lead the development of newly emerging academic disciplines.

  Efforts shall be made to optimize the environment for the talent development, to carry out the comfortable housing projects for talents, to provide convenience for talents in residence registration, medical care, insurance, entry and exit, housing, spouse’s employment, and children’s attending school, etc., to give financial support for scientific research, academic exchange, and skill training, etc., and to give special policy preferences to key talents in shortage.

   Article 38 The municipal, district governments shall improve the incentive-oriented financial mechanism, make overall arrangements for special financial funds, and increase their support to the transformation of the economic development model in terms of funding. Every year, an overall arrangement shall be made to transfer a certain proportion of funds from their respective financial income to various special development funds for high and new technologies, finance, logistics, cultural and cyclic economy, headquarters economy, and newly emerging strategic industries, etc. to give major support to the projects which fall into the category to be encouraged in the guidance catalogue. The specific scope and measures to use these funds shall be in compliance with the related rules. 

  The extent of the increase in the funds provided by the municipal finance for science and technology shall be higher than that of the increase in the regular income of the municipal finance, and all circles of the society shall be directed and encouraged in their investment in science and technology.

  The municipal government shall formulate the measures on the verification of the first major product, first major facility, and first major equipment, and establish the compensation mechanism for the risks of their use.

  According to Article 12 of these regulations, the municipal, district finance shall arrange a certain proportion of the special fund for scientific and technological development to be used in the support of the technology transfer and transformation of scientific and technological achievements.

  According to Article 13 of these regulations, the municipal, district finance shall arrange enough funds for the construction and operation of the public technology platforms, these platforms shall be brought into the municipal, district special plans for scientific and technological development. The municipal, district finance shall give financial support and awards to the institutions of original innovations.

  The municipal government shall improve the administration system of special financial funds. The related departments of the government shall formulate and publish the catalogue of the enterprises and projects supported and helped by special financial funds, work out and improve the measures on funding, and set the standards according to law for the support and funding provided by special financial funds.

   Article 39 The taxpayers who are affiliated with enterprises of high and new technologies needing major support, or engaged in the industries and projects which have major support and encouragement from the state for their development, develop new technologies, new products, and new techniques, and undertake the projects of technology transfer, environmental protection, energy and water conservation, which meet the requirements, and the other activities of the transformation of the economic development model shall enjoy preferential tax policies such as tax cut, tax exemption, etc. according to laws, regulations. 

  The departments of taxation shall strengthen the propagation and direction on preferential tax policies, provide convenience for taxpayers to apply for tax preferences, and implement various preferential tax policies according to law.

  The departments of taxation shall promptly accept, examine taxpayers’ applications for tax cut and tax exemption, and deal with them according to the requirements and procedures stipulated by laws, regulations.

   Article 40 Efforts shall be made to improve and innovate on the government purchase system. The products and services of independent innovation or those falling into the category to be encouraged in the guidance catalogue shall be given priority in purchasing if the other conditions are equal. 

   Article 41 The municipal government shall, according to the goals of the transformation of the economic development model and the way of the transformation stipulated by these regulations, intesify the reform of the land administration system, explore the comprehensive administration of land resources, assets, capital, and the model of farmland protection in a highly urbanized region, deepen the allocation of land marketization , bring about the conservation and intensive use of land resources, and increase the benefits of land use. 

  The municipal government shall give priority to arranging the quotas of construction land use for the projects falling into the category to be encouraged in the guidance catalogue, major projects, or enterprises acting to transform the growth model.

  The municipal government may use differentiated policies on land price management to support the industrial projects which meet the industrial development plan and fall into the category to be encouraged in the guidance catalogue.

  The municipal government shall improve the policies on land acquisition and rearrangement, and establish and improve the institutional mechanism of land acquisition and rearrangement.

   Article 42 The municipal government shall deepen the reform in the prices of resources, energy, labor, products, environment, public utilities and other key areas, bring into play the price as a lever, and improve the mechanism of price adjustments. 

   Article 43 The financial reform and the financial innovation shall be accelerated to provide high-quality and highly efficient financial services for newly emerging strategic industries and industries of high and new technologies, and to enhance the capacity of finance to promote the transformation of the economic development model. 

  The guarantee system for financing middle- and small-sized enterprises shall be improved, the private capital shall be encouraged to be put in the establishment of small-loan companies, and middle- and small-sized enterprises and innovative enterprises shall be encouraged and supported in going public. The related policies on the guidance, support, and standards shall be worked out by the municipal government.

   Article 44 Efforts shall be made to improve the policy on guiding social investment, to broaden the areas for private investment, and to guide social capital in participating in the construction and operation of public facilities of infrastructure on the premise that public interests are secure. 

  The social security funds shall be managed and operated according to law, and efforts shall be made to explore and innovate on the way to increase the value of the social security funds.

   Article 45 The administrative departments of special financial funds shall, in compliance with the stipulated procedures and requirements and within the stipulated time limit, process the applications which accord with the policies of the municipal government on the support by special financial funds. If the related policy does not stipulate a specific time limit, a decision on the application shall be made within 30 days from the date of accepting the application; if an application does not meet the requirements for the support by special financial funds, the administrative department of special financial funds shall reply in writing and give an explanation. 

  The administrative departments of special financial funds shall draw up the implementation measures on the support of projects by special funds, report them to the municipal government, and implement them after approval.

   Article 46 The related departments of the municipal, district governments shall make assessments of the implementation of the policies on the promotion of the accelerating of the transformation of the economic development model on a regular basis. Suggestions on the revision of the policies which do not meet the requirements for the transformation of the economic development model shall be put forward promptly. If a policy is made within the limits of the authority of a municipal, district department, it shall be revised by the related department promptly; if a policy is made by another department, a suggestion on the revision shall be promptly put forward to the department making the policy, and the department receiving the suggestion shall promptly study it and give feedback. 

  The related departments of the municipal, district governments shall make self-evaluations of their own implementation of these regulations and the related policies on the transformation of the economic development model, and the reports of self-evaluations shall be made public to the society.

  Chapter VII Assessment and Supervision 

  Article 47 The municipal government shall work out a goal responsibility system according to the actual state of the accelerating of the transformation of the economic development model and the statutory duties of departments, sign the letters for the responsibility for the transformation of the economic development model with related departments, make clear the tasks and responsibility of the related departments in the transformation of the economic development model. The goal responsibility system shall set up the weight according to the duties of the related departments and manage it respectively. 

  The municipal government shall release White Paper of the Shenzhen Municipality on the Transformation of the Economic Development Model every year, make public to the whole society the main items and tasks, achievements and experiences, existing problems and causes, countermeasures and measures, etc. of the transformation of the economic development model, and direct the market subjects to transform the economic development model and to accept the social supervision.

  Article 48 The municipal government shall explore the establishment of a comprehensive assessment index system taking scientific development as a goal, and innovation driving, structural adjustments, green development, and people’s livelihood and happiness as major contents, form an assessment system of the achievements in public offices in terms of the accelerating of the transformation of the economic development model, and designate the related departments to be responsible specifically for the implementation. 

  The comprehensive assessment indexes shall be brought into the index system of the evaluation and management of the municipal government’s performance, the performance evaluation shall be carried out for various district governments and the related departments of the municipal government.

  Article 49 The municipal government shall make annual assessments of district governments and the related departments of the municipal government according to the requirements of the goal responsibility system to accelerate the transformation of the economic development model and the comprehensive assessment index system; increase the weight of the management and use of government funds and special financial funds by the administrative departments, and place stress on the assessment in this respect. The results of the assessments shall be taken as an important basis for the examination and evaluation at the end of a year. Specific measures shall be worked out by the municipal government separately. 

  Article 50 If district governments and related departments fail to perform the responsibilities stipulated in the letters for the responsibility for the transformation of the economic development model signed with the municipal government, fail to complete the tasks stipulated by the letters, or fail to reach the standards in the annual assessments, the administrative responsibility shall be investigated and ascertained according to the related rules. 

  Article 51 The standing committee of the municipal people’s congress shall bring the accelerating of the transformation of the economic development model into the annual working plan, carry out the related legislation and supervision step by step and with emphases. 

  The municipal government shall make a special work report on the accelerating of the transformation of the economic development model to the standing committee of the municipal people’s congress in the fourth quarter of every year.

  Article 52 The departments of audit, finance shall carry out according to law the supervision and inspection of the management and use of the various special financial funds for the promotion of the accelerating of the transformation of the economic development model. 

  The departments of audit shall audit the management and use of the various special financial funds and make reports to the municipal government, the audit results shall be made public to the society.

  Article 53 Social evaluation institutions shall be encouraged to engage in the analysis, research, and evaluation of the transformation of the economic development model. Governments may entrust social evaluation institutions, by purchasing their services, with the special research in the related matters of the promotion of the accelerating of the transformation of the economic development model. 

  Various media such as radio stations, TV stations, newspapers and magazines, and internet, etc. shall be encouraged to strengthen the public-interest oriented propagation on the accelerating of the transformation of the economic development model, and to create an atmosphere for the whole society to supervise and support the transformation of the economic development model.

  Chapter VIII Supplementary Provisions 

   Article 54 If these measures stipulate that the municipal government should draw up specific measures separately, the municipal government shall work them out within one year from the date when these measures take effect, and report the measures to the standing committee of the municipal people’s congress for being put on record. 

   Article 55 These measures shall take effect as of January 1, 2011.
