336 Administrative Rules of Shenzhen on the Advertisements for the 26th Summer Universiade Held in Shenzhen[深圳第26届世界大学生夏季运动会广告管理规定2007]

(deliberated and adopted at the 59th meeting of the Standing Committee of the Fourth Municipal People’s Government, promulgated by Decree No. 165 of Shenzhen Municipal People’s Government on May 11, 2007)
 
Article 1 For the purpose of strengthening management to the advertisements for the 26th Summer Universiade held in Shenzhen (hereinafter referred to as the Shenzhen Universiade), these rules are formulated according to the Advertising Law of the People’s Republic of China.
Article 2 The Organizing Committee, advertisers, advertisement agents and advertisement publishers of Shenzhen Universiade shall follow these rules when dealing with the advertisements of Shenzhen Universiade.  
Article 3 The Market Developing Institution of the Organizing Committee of Shenzhen Universiade shall be the host unit of advertising businesses, take charge of the operation and management of advertising businesses, and undertake the following functions and responsibilities:
1. operating and managing all advertising businesses of Shenzhen Universiade as a whole;
2. making coordination in the advertising affairs related to Shenzhen Universiade;
3. examining and approving the units on their qualifications of being advertisement agents;
4. verifying, supervising and managing all the undertaking plans, charging standards, contracts, contents, designs, making and establishing of advertisements.  
Article 4 The following advertisements shall be undertaken by the Market Developing Institution of the Organizing Committee of Shenzhen Universiade, or be undertaken by a unit under its entrustment:  
1. the advertisements involving the exclusive rights of Shenzhen Universiade on the titles, cups, special products, selective products, emblems and mascots;   
2.  the special advertisements, such as the countdown board;
3. the advertisements in the main meeting places where the opening ceremony and closing ceremony of Shenzhen Universiade are held;
4.  the advertisements in the competing stadiums of Shenzhen Universiade;  
5.  the advertisements at the branches of the Organizing Committee of Shenzhen Universiade, the news center, and the places where officials, referees, athletes and reporters are stationed;
6. the advertisements issued by the Organizing Committee of Shenzhen Universiade and its branches on the presswork, such as the journals of the universiade, competition order handbooks, reporter’s handbooks, entertainment handbooks, stadium introduction brochures, posters, autograph albums, tickets and certificates, and on the products of Shenzhen Universiade, such as the uniforms of working staff and the bodies of working vehicles;
7. the advertisements related to Shenzhen Universiade which are issued on television, broadcasting, newspaper, internet and outdoor.
Article 5  No one may engage in any advertising activity stipulated in Article 4 until having been examined and approved by the Market Developing Institution of the Organizing Committee of Shenzhen Universiade, signed the Contract of Advertisement Operation and been approved by the Organizing Committee of Shenzhen Universiade. 
Article 6  The advertisement operation rights of Shenzhen Universiade shall be protected by law.   No organization or individual may infringe upon any operator’s legal rights or interests by any method, such as offering products for free and sales promotion.  
Article 7 The Market Developing Institution of the Organizing Committee of Shenzhen Universiade shall protect the rights and interests of advertisers, and manage the publication of advertisement pursuant to the contract.
Article 8  Anyone who wants to hold an activity of literature, gymnastics, exhibition or sales exhibition in the name of Shenzhen Universiade shall in advance be examined and approved by the Market Developing Institution of the Organizing Committee of Shenzhen Universiade and get approval from the Organizing Committee of Shenzhen Universiade.
Article 9 All the advertising activities of Shenzhen Universiade shall abide by law, regulations, rules and relevant stipulations made by the Organizing Committee of Shenzhen Universiade.
Article 10  Everyone who rebroadcasts the programs of Shenzhen Universiade video signals may not add any advertisement into the signals, which has no direct relationship with Shenzhen Universiade or is not approved by the Organizing Committee of Shenzhen Universiade beforehand.
Article 11  Anyone who wants to issue an advertisement shall submit its content to the administrative department for industry and commerce for examination before issuing if it is required by the provisions of law or regulations. No such advertisement may be issued without being examined.
Article 12  Anyone who wants to set an outdoor advertisement of Shenzhen Universiade shall submit it to the city administration authority for approval according to the Administrative Rules for Outdoor Advertisements of Shenzhen Special Economic Zone. Anyone who sets an outdoor advertisement of Shenzhen Universiade without approval shall be investigated and punished by the law-enforcement department of the city administration authority according to law. 
Article 13 Anyone who commits any one of the following activities when issuing an advertisement of Shenzhen Universiade shall be investigated for legal liabilities and punished by the administrative department for industry and commerce:
1. issuing an advertisement with illegal content;
2. issuing a deceptive advertisement.
Article 14  Anyone who issues an advertisement of Shenzhen Universiade without the approval of Organizing Committee of Shenzhen Universiade, in violation of the Rules of Shenzhen on the Intellectual Property Protection for the 26th Summer Universiade or the Regulations on the Protection of the Special Signs of Shenzhen 26th Summer Universiade, shall be investigated and punished by the administrative department for industry and commerce according to relevant regulations.
Article 15 Anyone who issues an advertisement of Shenzhen Universiade without the approval of Organizing Committee of Shenzhen Universiade, and causes damages to the rights holder of the advertisement of Shenzhen Universiade shall bear corresponding civil liabilities according to law.
Article 16 These rules shall come into force as of June 1, 2007.
