(Discussed and adopted at the 30th meeting of the Executive Committee of the Fourth Shenzhen Municipal People’s Government, promulgated by Decree No. 154 of Shenzhen Municipal People’s Government on June 15, 2006)
Article 1 In order to establish a scientific and democratic decision-making mechanism and improve it, to enhance the democracy and transparency of important decision making progress made by government, to raise the working abilities of government, these Rules are formulated in combination of the actual circumstances of this city.
Article 2 The suggestions and plans for important matters which shall be decided by the municipal government may be publicized to the society according to these Rules, before they are submitted to the general meeting of the municipal government or the meeting of the executive committee of the municipal government for deliberation.
Article 3 Under any one of the following circumstances, the suggestions and plans for an important decision matter shall not be publicized:
1. keeping secret is required by law;
2. a natural disaster or an unexpected event threatening public safety is happening, so that the municipal government must make a settlement decision immediately;
3. other circumstances under which the municipal government decides not to publicize the suggestions and plans.
Article 4 The principles of publicity, justice and completion shall be observed in the activity of publicizing important decisions. The information for publication and the opinions being collected and feed-back shall be complete and sufficient.
Article 5 The suggestions and plans for important decisions shall be put forward by the municipal government or its departments. The suggestions and plans which are put forward by the municipal government shall be signed and issued by the mayor or the vice mayor in charge, those that are put forward by a department shall be signed and issued by its person mainly in charge.
Article 6 The suggestions and plans for important decisions may be publicized by relevant media, by model exhibition or by picture exhibition.
Article 7 The following items of a suggestion and plan for important decision shall be publicized:
1. the main content;
2. the specific statement on making of the suggestion and plan, including the reason and main basis;
3. the methods, starting and dead lines for persons and organizations to express their opinions and suggestions;
4. other items which shall be publicized by law.
Article 8 The period for openly soliciting social opinions and suggestions shall be no less than 10 working days, starting from the next day of the publication date of the suggestions and plans for important decisions.
Article 9 Every person and organization may put forward their opinions and suggestions about the publicized suggestions and plans for important decision of the municipal government by writing, email or other methods stipulated in the publication notice.
Article 10 The unit carrying out the publication shall be responsible for collecting and sorting the opinions and suggestions which are put forward by citizens, study them earnestly, and adopt reasonable ones.
Article 11 The suggestions and plans for important decisions shall be submitted to the municipal government for deliberation together with the reports of publication situations.
When the draft of an important decision is deliberated in a decision-making meeting of the municipal government, all the opinions and suggestions got from the publication procedures shall be fully put in consideration.
Article 12 Every district people’s government may make its own rules for publicizing the suggestions and plans for important decisions according to these Rules in combination with the actual circumstance of the respective district.
