The General Office of the Standing Committee of the Guangdong Provincial People’s Congress:

Request for Instructions on the Issue of Application of the Laws and Regulations Made by the Shenzhen Municipal People’s Congress and Its Standing Committee to the Administrative Areas of the Municipality was received. A reply is now given, after studying, as follows:

It is agreed that the laws and regulations made by the Shenzhen Municipal People’s Congress and its Standing Committee apply to the administrative areas of the Municipality (including Baoan, Longgang Districts). However, the stipulations in these laws and regulations concerning the special policies given by the state to the special economic zone can only apply to the special economic zone under the Municipality’s jurisdiction. If the law and regulations made by the Shenzhen Municipal People’s Congress and its Standing Committee have conflicts with the local laws and regulations made by the Guangdong Provincial People’s Congress and its Standing Committee when the former being implemented in Baoan, Longgang Districts which are not a special economic zone, the latter shall apply.
