488 Decision of the Shenzhen Municipal People's Government on the Function Adjustment of Administrative Agencies Stipulated in the Government Regulations and Normative Documents of the Shenzhen Municipality in the Institutional Reform 深圳市人民政府关于机构改革涉及本市政府规章和规范性文件规定的行政机关职责调整问题的决定

　　In order to ensure that such government regulations and normative documents meet the needs of institutional reform and that the administrative agencies perform their functions and duties according to law, the function adjustment of administrative agencies provided in the regulations and normative documents of the Shenzhen municipal government is hereby made subject to the following decisions:

　　1. The functions and duties to be performed by the administrative agencies as provided in current regulations and normative documents of the Shenzhen municipal government, which are determined by the Institutional Reform Plan of Shenzhen Municipality to be undertaken by the administrative agencies newly established or those assigned to such functions and duties, shall apply, with appropriate adjustment, relevant regulations and normative documents of the government before any amendment or abolishment of the same. Before the relevant functions and duties are properly adjusted, the administrative agencies currently in charge shall continue to be in charge.
　　The functions and duties undertaken by the district people's governments (including the new district management authorities) and the departments thereunder in accordance with the regulations and normative documents of the municipal government, if requiring any adjustment, shall be subject to the above-mentioned principles.
　　2. Where, as the regulations and normative documents of the municipal government stipulate, the administrative agencies at a higher level shall be responsible for the administration, supervision and guidance of those at a lower level, such as approval, filing and reconsideration, and the function adjustment has been completed in those at a higher level but not yet in those at a lower level, the higher administrative agencies designated in the Institutional Reform Plan of Shenzhen Municipality shall perform such functions of administration, supervision and guidance.
　　3. If, for the purpose of implementing the Institutional Reform Plan of Shenzhen Municipality, it is necessary to formulate, modify or abolish any regulation and normative document of the municipal government, or relevant decisions should be made by the municipal government, the relevant departments shall, subject to the principles of "the authority who exercises the authority shall be in charge of settling issues and taking responsibilities", put forward opinions and suggestions in a timely manner, and proceed with such formulation, modification or abolishment following statutory procedures.
　　4. If, for the purpose of implementing the Institutional Reform Plan of Shenzhen Municipality, it is necessary to formulate, modify or abolish any normative document of the departments or the district governments, the relevant departments and district governments shall promptly complete the work of sorting out such normative documents and proceed with such formulation, modification or abolishment in a timely manner. If the function adjustment has been completed, but the relevant provisions concerning such adjustment in any normative documents formulated by the administrative agency originally undertaking the functions and duties have not been amended or abolished, the taking-over administrative agency shall carry out such functions and duties for the time being.
　　5. The administrative agencies at all levels should well organize and cause sophisticated deployment to ensure the continuity, stability and effectiveness of their work in performing their statutory duties and in carrying out daily work, especially in key areas related to people's livelihood, emergency response and production safety. The municipal administrative agencies should strengthen supervision and guidance over those at the district level, and the departments with changed responsibilities should take the initiative to cooperate and strengthen coordination, to prevent any interruption in work, buck-passing, negative acts, improper acts, and to effectively protect the legitimate rights and interests of all citizens, legal persons and other organizations.
　　6. This decision shall be implemented as of the date of promulgation.
