Chapter IGeneral Provisions
Article 1 To promote the construction and development of Guangming Science City, build it into a world-class science city, and accelerate the construction of a Shenzhen-centered comprehensive national science center in the Guangdong-Hong Kong-Macao Greater Bay Area, these Regulations are formulated in accordance with the foundational principles specified in relevant laws and administrative regulations and in light of the specific circumstances in Shenzhen Special Economic Zone.
Article 2 Guangming Science City shall consist of the area specified in the overall development plan of Guangming Science City and the extended areas to be approved by Shenzhen Municipal People’s Government.
Article 3 Shenzhen Municipal People’s Government shall, in accordance with the national strategic plan for building a pilot area for comprehensive national science centers in the Guangdong-Hong Kong-Macao Greater Bay Area, build Guangming Science City into a world-class, large-scale and welcoming cradle of innovation, an international scientific and technological innovation hub in the Guangdong-Hong Kong-Macao Greater Bay Area, a comprehensive core area of comprehensive national science centers, a verification and outcome deployment base that drives high-quality development, and a forward position for deepening the systematic reform for scientific and technological innovation.
Article 4 Shenzhen Municipal People’s Government shall support Guangming Science City in strengthening the inter-connection and coordination between key education resources and advantageous industrial clusters in the Guangdong-Hong Kong-Macao Greater Bay Area, advancing the holistic improvement of the innovation chain, the industrial chain, the capital chain and the human resources chain, enhancing scientific and technological innovation, facilitating the formation of a major science and technology infrastructure cluster with a reasonable layout and world-leading functions, and promoting the development of future industries and emerging industries.
Article 5 Guangming Science City shall focus on such areas as information, life and new materials, and strive to build major science and technology infrastructure, new-type research and development institutions, cutting-edge cross-discipline research platforms and underpinning service platforms for scientific and technological progress.
Guangming Science City shall promote the establishment of research-oriented higher learning institutions and hospitals, put more effort into exploring key disciplines and clinical medical research, and yield more research outcomes.
Article 6 Shenzhen Municipal People’s Government shall make holistic arrangements for scientific research institutions and major scientific and technological infrastructure in key areas for scientific and technological innovation such as Guangming Science City and Hetao Shenzhen-Hong Kong Science and Technology Innovation Cooperation Zone, and strengthen the coordinated and inter-connected development of Guangming Science City with Dongguan Songshan Lake Science City, Guangzhou Nansha Science City and Hong Kong Science Park.
Article 7 The construction and development of Guangming Science City shall adhere to new development concepts such as innovation, coordination, green, openness and sharing, contribute to the realization of carbon peaking and carbon neutrality goals, and strike a balance among development, utilization and ecological and environmental protection.
Article 8 Shenzhen Municipal People’s Government shall support Guangming Science City in institutional innovation as well as its pioneering efforts in basic research, technological research, outcome deployment, scientific and technological financial development, and introduction and cultivation of professionals.
Guangming Science City shall ensure an open and inclusive environment that favors collaboration and innovation, and establish a sound mechanism for positive incentive, fault tolerance and liability exemption.
Chapter II Governance Structure
Article 9 Shenzhen Municipal People’s Government shall strengthen organizational leadership, establish a well-functioning administrative mechanism for the construction and development of Guangming Science City, clarify the duties of all parties involved, and promote the construction and development of Guangming Science City in a coordinated manner.
Article 10 The municipal authorities of development and reform, science, technology and innovation, industry and information technology, finance, human resources and social security, urban planning and natural resources, state-owned assets supervision and administration, market regulation, local financial supervision, tax service and customs shall strengthen cooperation and support the construction and development of Guangming Science City within their respective duties.
Article 11 Guangming District People’s Government shall be responsible for social administrative activities, provide public services in Guangming Science City, such as municipal infrastructure, living environment of surrounding neighborhoods, public services and sufficient construction and development space, and ensure a sound working and living environment with high-quality services for professionals.
Article 12 Companies that have been established for the development and operation of Guangming Science City as approved by Shenzhen Municipal People’s Government shall manage the investment, financing, construction, operation and outcome deployment of the innovation platforms and infrastructure within the scope of Guangming Science City.
Shenzhen Municipal People’s Government shall support companies that have been established for the development and operation of Guangming Science City in promoting the sharing of major scientific and technological infrastructure for various innovative entities at home and abroad through market-oriented operation.
Article 13 It is encouraged that all kinds of social organizations join the social governance of Guangming Science City according to relevant laws, and improve the social governance system featuring co-construction, co-governance and sharing.
Chapter III Planning and Construction
Article 14 The municipal urban planning and natural resources authority shall, based on the overall development plan and the spatial plan of Guangming Science City as well as the municipal and district national spatial plans, make holistic arrangements for the preparation of the detailed plan and special plan within the scope of Guangming Science City to ensure a favorable environment for scientific and technological innovation in the whole process.
Article 15 The municipal urban planning and natural resources authority shall organize the formulation of the plan for ecological units inside Guangming Science City but outside the urban development boundary, clarify specific indexes within such units with the goal of enhancing ecological functions, and take them as the basis for granting the planning permission.
Article 16 Shenzhen Municipal People’s Government shall optimize the working mechanism for selecting sites for projects in the cluster area of scientific devices in Guangming Science City and create a negative list for projects based on statutory plans and other space control requirements.
Article 17 Shenzhen Municipal People’s Government shall support Guangming Science City in being enrolled as a national high-tech industrial park, by providing policy and financial support for the construction of innovation platforms, enterprise agglomeration and cultivation, scientific and technological financial services, introduction and training of professionals, and construction of brands from the high-tech zone.
Article 18 Shenzhen Municipal People’s Government shall promulgate rules on the distribution of incomes from land granting and the investment of land consolidation funds for Guangming Science City, and support the construction and development of Guangming Science City.
Article 19 Shenzhen Municipal People’s Government shall ensure sufficient construction land for Guangming Science City. The integrated implementation of the quotas of new construction and forest land in the cluster area of scientific devices in Guangming Science City shall be explored within the total quotas that are set during the planning period. Construction and forest land quotas shall be first used for scientific and technological infrastructure projects in the cluster area of scientific devices.
The scientific research land within the cluster area of scientific devices in Guangming Science City can be regarded as new-type industrial land when the proportion of industrial land is calculated.
Article 20 In Guangming Science City, secondary and tertiary industry areas shall be mixed. Major facilities for scientific research and production and supporting facilities for accommodation, commerce and public services shall be installed in the same area. Without changing the use of major facilities, supporting facilities may be installed in a certain area and supplied with the same land as that for major facilities.
Article 21 Shenzhen Municipal People’s Government shall strengthen land use administration. For scientific research land that is allocated or supplied by agreement, strict limits shall be set on the user and the land use purpose, so as to ensure land supply for scientific research institutions and major scientific and technological infrastructure in Guangming Science City.
Article 22 Guangming Science City shall establish a well-functioning intelligent infrastructure system, integrate the Internet of Things perception facilities and communication systems into the unified planning of public infrastructure, and promote the construction of a smart city.
Chapter IV Scientific Research
Article 23 Shenzhen Municipal People’s Government shall focus on the frontiers of information, life and new materials, make centralized arrangements for general and dedicated major scientific and technological infrastructure in Guangming Science City, and build a major scientific and technological infrastructure cluster that features compact design, correlated disciplines and mutual support, so as to promote original innovation and scientific and technological breakthroughs.
Article 24 Shenzhen Municipal People’s Government shall raise funds through multiple channels to promote the construction and operation of major scientific and technological infrastructure in Guangming Science City.
Shenzhen Municipal People’s Government shall support Guangming Science City in working with Chinese and foreign higher learning institutions, scientific research institutions, enterprises and other social entities in applying and constructing major scientific and technological infrastructure that meets the actual needs of Shenzhen’s industrial development in accordance with relevant regulations.
Article 25 Shenzhen Municipal People’s Government shall design and build cutting-edge cross-discipline research platforms for the development of high-end scientific research instruments and precision measurement, as well as scientific and technological support platforms such as big data centers and international science and technology information centers in Guangming Science City. Shenzhen Municipal People’s Government shall also encourage key generic technologies, cutting-edge and leading technologies, modern engineering technologies, and disruptive technological innovations, thus forming an innovation chain that features fusion, close collaboration and mutual support based on major scientific and technological infrastructure clusters.
Article 26 It is encouraged to support Guangming Science City in designing and constructing national laboratories, provincial laboratories and key laboratories above the provincial level, and its efforts in strategic, forward-looking and systematic basic research and key generic technology research, so as to promote breakthroughs and innovations in disciplinary theories and cutting-edge technologies.
Article 27 Guangming Science City shall promote the reform of the management mechanism for new-type research and development institutions, design and develop new research and development institutions that are invested by diversified investors and equipped with modern management systems, market-oriented operation mechanisms, and efficient and flexible employment and evaluation mechanisms for professionals.
Article 28 The municipal science, technology and innovation authority shall support major innovators in Guangming Science City in initiating or joining international big science plans or projects, and encourage innovations in the initiation, operation and management mechanisms for international big science plans.
Article 29 The municipal authorities of development and reform, science, technology and innovation, and industry and information technology shall support major innovators in Guangming Science City in initiating or joining major national, provincial or municipal science and technology projects, and encourage the deployment of the research and development outcomes of national, provincial or municipal major science and technology projects in Guangming Science City.
Article 30 The municipal science, technology and innovation authority shall take preferential measures to ensure the basic research, applied research, technology research and development and the deployment of scientific and technological outcomes by major innovators in Guangming Science City.
The municipal development and reform authority shall organize the implementation of the financial support plan to support Guangming Science City in exploring potential technological frontiers, basic principles and technical concepts, making breakthroughs in key core technologies, experimenting through engineering approaches, independently developing major scientific instruments and equipment, and building frontier cross-discipline research platforms.
Article 31 The municipal science, technology and innovation authority and the municipal finance authority shall explore ways to reform scientific research fund management in Guangming Science City, enhance the autonomy in managing scientific research funds and improve the mechanism for stimulating scientific research with project funds.
The above authorities shall also support scientific research institutions engaged in basic, cutting-edge or public welfare research as independent legal entities in Guangming Science City in exploring ways to implement the complete rationing system for financial research funds together with the negative list system. Specific measures shall be formulated by the municipal science, technology and innovation authority in conjunction with the municipal finance authority.
Article 32 It is encouraged to support Guangming Science City in exploring and establishing a risk control mechanism that can stimulate innovations in cutting-edge science and technology, and optimizing the review and supervision model according to relevant laws and regulations.
Article 33 It is encouraged that higher learning and scientific research institutions in Hong Kong and Macao establish branches or innovation platforms in Guangming Science City and contribute to the construction of Guangming Science City.
It is encouraged that higher learning and scientific research institutions in Hong Kong and Macao work with their counterparts in Guangming Science City to build industry-university-research cooperation platforms and work closely with them in such areas as project application, scientific and technological research and development, outcome deployment and incubation of enterprises.
Article 34 Guangming Science City shall increase exchanges with internationally renowned science cities. It is encouraged that international academic institutions, science and technology organizations, science and technology service institutions and research and development centers of multinational enterprises settle down or establish their branches in Guangming Science City.
Article 35 Higher learning institutions, scientific research institutions and enterprises that are committed to scientific and technological innovations in Guangming Science City shall enhance integrity in scientific research and take the primary responsibility for scientific and technological ethical review and supervision.
Chapter V Outcome Deployment
Article 36 Shenzhen Municipal People’s Government shall offer policy and financial support, advance the construction of platforms for the deployment of scientific and technological outcomes in Guangming Science City and facilitate the deployment of the outcomes of science and technology projects.
Article 37 Shenzhen Municipal People’s Government shall encourage the establishment of service platforms for the deployment of scientific and technological outcomes such as the international technology transfer and deployment center in Guangming Science City, so as to facilitate international high-end scientific and technological outcomes to be deployed in Guangming Science City. Concept proof centers, pilot bases and pilot production lines shall also be designed and built to transform scientific and technological outcomes into large-scale production.
Article 38 Shenzhen Municipal People’s Government shall support Guangming Science City in building industrial innovation centers and manufacturing innovation centers, promoting technological development, formulating innovative technical standards, developing key core technologies, processes, components and major equipment prototypes, and accelerating large-scale commercial availability of innovative products.
Article 39 Shenzhen Municipal People’s Government shall support Guangming Science City in building new-type industrial parks to attract higher learning institutions and enterprises, which will set up research institutions in the municipality to incubate high value-added sci-tech enterprises that mainly create intellectual property rights and promote the medium-high end development of the value chain of the industrial system.
Article 40 Shenzhen Municipal People’s Government shall design holistic plans and policies for practical applications, create opportunities for the deployment of the scientific and technological outcomes in Guangming Science City, support the testing, trial and application of new technologies, new products, new business forms and new models formed alongside the deployment of scientific and technological outcomes in Guangming Science City, and offer necessary services to facilitate the deployment of the scientific and technological outcomes in Guangming Science City according to the law, such as data sharing, infrastructure, technical verification, standard testing and demonstration application.
Shenzhen Municipal People’s Government shall encourage the procurement of innovative products and services with core intellectual property rights that have been put on the national market for the first time by innovators in Guangming Science City in government-invested projects and investment projects of state-owned enterprises.
Article 41 The municipal science, technology and innovation authority shall support major innovators in Guangming Science City in reforming the ownership system of scientific and technological outcomes achieved by employees. The ownership of or long-term use rights to the scientific and technological outcomes that have been achieved completely or partially with financial funds may be granted to the persons or the teams that achieved such outcomes in accordance with relevant regulations.
The municipal science, technology and innovation authority shall support higher learning and scientific research institutions that have settled in Guangming Science City in applying for serving as pilot sites for the separate management of scientific and technological outcomes achieved by employees in accordance with relevant national regulations, and exploring special management and supervision mechanisms for scientific and technological outcomes achieved by employees.
Article 42 It is encouraged to support major innovators in Guangming Science City in their market-oriented evaluation of scientific and technological outcomes through contractual pricing, going public for trading, asset evaluation or auction.
Article 43 Guangming Science City shall establish a sound service chain for scientific and technological innovation, and encourage the founding of scientific and technological service institutions that offer such services as research, development, design, pilot incubation, scientific and technological counseling, inspection, testing, formulation of technical standards, and outcome deployment.
Article 44 It is encouraged to introduce technical managers in Guangming Science City, who shall participate in the deployment of scientific and technological outcomes during the whole process, such as invention disclosure, value assessment, patent application and maintenance, technology promotion, matchmaking and negotiation.
Article 45 Professional technical personnel from higher learning and scientific research institutions in Guangming Science City may, with the consent of their employers, start their on-the-job businesses with the scientific and technological innovation outcomes they helped to achieve in accordance with relevant regulations.
Chapter VI Talent Policy
Article 46 Guangming Science City shall, based on the actual needs of cutting-edge scientific research and industrial development, fully leverage the decisive role of the market in human resources allocation as well as the role of the government, innovate the mechanism for professionals, bring public services such as healthcare, culture and education to the international level, optimize supporting services such as housing, life and leisure for professionals, and attract more high-end professionals from home and abroad.
Article 47 Shenzhen Municipal People’s Government shall support Guangming Science City in exploring ways to implement a more proactive, open and effective talent policy, compile the talent development plan and the list of urgently needed professionals of Guangming Science City, and accurately attract professionals according to the actual circumstances.
Article 48 It is encouraged to establish high-level higher learning institutions in Guangming Science City, which will innovate discipline design, training of professions and independent enrollment, and nurture high-level research-oriented professionals.
It is encouraged to support Guangming Science City in working with higher learning and scientific research institutions in Hong Kong and Macao, thus making innovation and entrepreneurship easy for outstanding university students from Hong Kong and Macao in Guangming Science City.
Article 49 The municipal human resources and social security authority shall support the higher learning institutions, scientific research institutions, enterprises and public institutions in Guangming Science City in applying for the establishment of postdoctoral research programs, scientific research work stations (substations) and postdoctoral innovation practice bases.
The municipal human resources and social security authority shall support eligible postdoctoral scientific research stations (substations) in Guangming Science City in applying for independent recruitment of post-doctoral students.
Article 50 The municipal talent affairs authority shall coordinate with the municipal authorities of human resources and social security, housing and construction, public hygiene and health, public security and education, to strengthen policy coherence, and provide convenience for professionals such as household registration, healthcare, children’s schooling, and housing in Guangming Science City.
The municipal talent affairs authority shall support Guangming Science City in establishing an international talent service center, fostering a talent service team familiar with the rules on international exchanges, and optimizing international talent services.
Article 51 The municipal human resources and social security authority shall support industry-leading enterprises and new research and development institutions in conducting independent professional title evaluation, so as to ensure the extensive evaluation of professionals and technical personnel in key areas.
Article 52 Relevant authorities of Shenzhen Municipal People’s Government and Guangming District People’s Government shall grant corresponding subsidies to high-level and urgently-needed professionals that are engaged in basic research, applied research, technological research, outcome deployment and management of scientific research organizations in Guangming Science City in accordance with relevant regulations.
Chapter VII Guarantee and Service
Article 53 Stable and predictable financial guarantee mechanisms at the municipal and district levels shall be established to support the construction and operation of major scientific and technological infrastructure, scientific research, outcome deployment, the optimization of public services, and ecological and environmental protection in Guangming Science City.
Article 54 Relevant investment funds and industrial funds of this municipality shall be utilized to support the projects that are settled in Guangming Science City.
Guangming District People’s Government shall work with the municipal authorities of development and reform, and finance to design special bonds for Guangming Science City and financially support the construction and development of Guangming Science City.
The above authorities shall encourage enterprises and other social entities to increase investment in basic research, applied research, technology research and development and the deployment of scientific and technological outcomes in Guangming Science City by setting up foundations and making donations.
The above authorities shall encourage Hong Kong and Macao residents to actively invest in sci-tech enterprises and financially support major projects in Guangming Science City.
Article 55 It is encouraged that policy- and development-based financial institutions support the construction and development of major projects in Guangming Science City within their business scopes approved by the state.
It is encouraged to construct a functional area for scientific and technological finance in Guangming Science City. As all kinds of financial institutions settle in Guangming Science City and engage in financial innovations, they can provide financial services for innovators in Guangming Science City, such as credit loans, science and technology insurance, financial guarantee and finance lease for sci-tech enterprises.
It is encouraged to support sci-tech enterprises in Guangming Science City in their listing, bond issuance, mergers and acquisitions and refinancing. The municipal authority to promote enterprise listing shall improve the coordination mechanism for enterprise listing, and provide comprehensive coordination and counseling services for enterprise listing during shareholding reform and filing.
Article 56 Shenzhen Municipal People’s Government shall support classified and graded supervision over the entry and exit of self-use scientific research materials, experiment reagents, instruments and devices. Shenzhen Municipal People’s Government shall simplify the customs clearance procedures for scientific research materials on the premise of safety.
For the instruments, devices and low-risk supplies used by the innovators in Guangming Science City for scientific research, teaching, calibration, testing or comparison experiments and certified by relevant authorities of Shenzhen Municipal People’s Government, as well as the instruments and tools for installation, commissioning, testing or maintenance, the customs shall implement preferential customs clearance policies in accordance with relevant regulations, optimize the entry and exit procedures, and accelerate customs clearance.
Article 57 Shenzhen Municipal People’s Government shall advance the holistic administration of the scientific data generated by major scientific and technological infrastructure in Guangming Science City and promote the sharing of scientific data while ensuring national security and protecting intellectual property rights.
Article 58 It is encouraged to construct new-generation information infrastructure in Guangming Science City, so as to promote classified supervision over cross-border data flow under the cross-border transfer safety management system for national data.
Article 59 It is encouraged that higher learning institutions, scientific research institutions, enterprises, industry organizations and professional service institutions jointly set up an operation center for industrial intellectual property rights in Guangming Science City for patent mining, patent operation and rights protection. A high-value patent portfolio featuring a large scale, a rational layout and international competitiveness will enhance the industrial competitiveness of Guangming Science City.
Article 60 The municipal market regulation authority shall support Guangming Science City in building a market-oriented open licensing platform for patents, a patent licensing database and a matchmaking database for enterprises’ sourcing requirements, to accurately and efficiently match high-value patents created in Guangming Science City with the demands of the market and the industrial chain, and enhance commercialization efficiency.
Article 61 The municipal market regulation authority shall support Guangming Science City in building a public service platform for intellectual property rights that runs through intellectual property creation, protection, application, management and service and covers various intellectual property rights such as patents, trademarks and copyrights, explore and then realize rapid and prioritized review and recommendation of key patents that are created in Guangming Science City with reliance on China (Shenzhen) Intellectual Property Protection Center.
Article 62 It is encouraged to support Guangming Science City in optimizing the financing service system for intellectual property rights, promoting pledging and securitization of intellectual property rights, increasing direct financing channels, and building the financial service market for intellectual property rights.
Chapter VIIISupplementary Provisions
Article 64 Shenzhen Municipal People’s Government may formulate specific implementation measures in accordance with these Regulations.
Article 64 These Regulations shall come into force on June 1, 2023.
